LOCATION:Adjacent to the Coors Energy Site on a private road, approximately four miles north of 1-76 and
5 miles from the Town of Keenesburg.

Dear Ms. Chester:
My firm has been retained by Waste Management of Colorado, Inc., to represent it in :he
above referenced case.
As you know Waste Management of Colorado, Inc. is the owner of approximately 4600
acres of land adjacent to the proposed Rattler Ridge Organic Recycling Facility. According to
the Applicant's response to question 5a to the Use by special Review Questionnaire the site wi I I
generate approximately 50 truck visits a day based upon a 365 day year and up to 100 truck visits
per day after five years of operation. This usage equates to 100 —200 road trips per day
In December of 1993 Waste Management of Colorado, Inc. entered into a Road
Improvement and Maintenance agreement with The Board of County Commissioners of Weld
County. In that Agreement Waste Management committed to expend $187,000 to perform
certain identified improvements to County Roads 59 and 18. Waste Management has, in fact
continually bonded that obligation, since December of 1993. The current extension of that bout
runs through December 9, 2000. The condition of the obligation under the road improvenien
and Maintenance Agreement was that the improvements were to be performed between t 2 and
18 months after the disposal site was opened.
Although Waste Management has paid for over$60,000 of road improvements on
County Roads 59 and 18 over the past several years, it has not, as of this writing, commenced the
improvements required by the Agreement because the disposal site is not yet open.
Because of the potential for damage to and destruction of the existing roadway Fesaltin;._
from the increase in traffic due to the proposed operations of the composting facility, Waste
Management believes that Lambland, Inc, should also be required to enter into a Road

Improvement and Maintenance Agreement providing for an equitable split between Waste
Management and Lambland based on each organizations projected future use.
Waste Management requests an opportunity to meet with you and representatives of the
applicant in order to attempt to resolve this issue in an amicable fashion. Please contract the

Ladies and Gentlemen:
With respect to the referenced public hearing for the Rattler Ridge Organic Recycling Facility. please be
advised that Patina Oil & Gas Corporation ("Patina") is the owner of certain oil and gas leasehold rights
under the referenced lands (the "Lands") and operates six oil and gas wells on the Lands. Patina is very
concerned about the impact the facility will have on Patina's ability to develop, produce, operate and
maintain oil and gas wells on the Lands. Patina has not waived any rights it has to access the oil and gas
under the Lands.
Patina has the right to drill oil and gas wells on the Lands pursuant to existing Colorado Oil & Gas
Conservation Commission well location rules. Patina requests assurance from Weld County and the
applicant that the subdivision will not block access or preclude Patina from drilling, producing. operating
and maintaining oil and gas wells on the Lands.
Until this matter is resolved by agreement with the applicant, Patina is not waiving its rights as a leasehold
owner. Any approval of the Rattler Ridge Organic Recycling Facility should be conditioned upon the
preservation of Patina's real property rights that allow it to make a reasonable use of the surface of the
Lands for oil and gas development.
