RE: SET HEARING DATE FOR CHANGE OF ZONE #530 FROM A (AGRICULTURAL)
ZONE DISTRICT TO E (ESTATE)ZONE DISTRICT FOR A FIVE-LOT MINOR
SUBDIVISION - DANIEL OCHSNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #993006 dated December 22, 1999, the Board did refer the
request of Daniel Ochsner for Change of Zone #530 from (A (Agricultural) Zone District to
E (Estate) Zone District for a Five-Lot Minor Subdivision, back to the Weld County Planning
Commission for its recommendation because various changes had been requested by the
applicant, and
WHEREAS, by letter dated January 26, 2000, from Susan Barrett, Vice President of
Denver Canadian, Inc., the applicant has now requested the original Change of Zone
application proceed with a hearing before the Board of County Commissioners, and
WHEREAS, after review, the Board deems it advisable to set March 1, 2000, at
10:00 a.m. as a hearing date for Change of Zone #530.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that March 1, 2000, at 10:00 a.m. be, and hereby is, established as the
appropriate time to hear the original application of Daniel Ochsner for Change of Zone #530.
BE IT FURTHER RESOLVED by the Board that the applicant be, and hereby is,
requested to appear before the Board at the above-stated time to be heard in the matter of his
original request for Change of Zone#530 From A (Agricultural) Zone District to E (Estate) Zone
District for a Five-Lot Minor Subdivision.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 7th day of February, A.D., 2000.

COLORADO SUBJECT: Setting Hearing Date for Change of Zone#530 - Daniel
Ochsner
Pursuant to a letter received from Denver Canadian, Inc., on behalf of Daniel Ochsner, dated
January 26, 2000, it is necessary to schedule a new hearing for Change of Zone #530. Due to
publication requirements, the earliest date available would be February 23, 2000; however, a
Probable Cause Hearing for SUP #454 for Howard Duckworth, as well as Change of Zone #533
for Shawn and Paula Petersburg, have already been scheduled for this date.
I would recommend setting the hearing date for either March 1 or 8, 2000, at 10:00 a.m., which
have no conflicting hearings scheduled, and the entire Board will be present.

RE: Final Scheduling for Board of County Commissioners Hearing
Minor Subdivision -- Ivy Crest
Dear Monica:
Pursuant to the scheduled hearing on December 22, 1999, authorization from the
Planning and Zoning staff indicated that the Ivy Crest 'reconfigured' lots would be
categorized as a major change. This major change would require the case to be
resubmitted and the entire process to be repeated. Mr. Ochsner sincerely would like the
approval for the Change of Zone and wishes to proceed with the original application.
At your earliest convenience, Mr. Ochsner would like to request a date for a Board
of County Commissioners hearing. The processing time for this application has been a
concern for all. An immediate date, if possible, would sincerely be welcomed.
Your time and attention to this matter has always been greatly appreciated.
