COLORADO April 12, 2000 M.D. Hopper 3656 WCR 20 'h Longmont, CO 80504 RE: Future Annexation of Weld County Road 20 'h Dear Mr. Hopper: This letter is in response to your letter of April 7, 2000, which states your request that Weld County Road 20 1/2 "not be given away to any municipality." The reason for your request is that in your opinion, other county roads annexed by various municipalities have not been well maintained. You believe that Weld County does a better job of maintaining roadways. The Colorado Municipal Annexation Act of 1965, as amended, authorizes a municipality to annex a roadway in the course of doing a "flag pole" annexation without first receiving a petition for annexation from Weld County. The situation is different, however, if the municipality desires to annex the roadway only without the attached "flag." Such annexation usually requires a petition to be signed and submitted to the municipality by the County. For example, last year the City of Greeley asked the Board of County Commissioners of Weld County to petition for the annexation of Cherry Avenue. The Board held a hearing for adjacent land owners to express their opinions regarding the proposed petition for annexation. At the hearing, the adjacent landowners expressed their desires against annexation of the roadway. The Board of County Commissioners voted to refrain from signing and submitting the petition for annexation. As of this date, the Board of County Commissioners has not received any requests from any municipality for the Board to sign and submit a petition for the annexation of WCR 20 'h. Additionally, the Board is unaware of any current efforts of a municipality to annex WCR 20'1 using the "flag pole" technique. The Board recommends that you contact the municipalities you believe may be inclined to annex WCR 20'/ to determine if, indeed,they have plans to do so. The recent experience of the landowners opposing the annexation to the City of Greeley of 20t Street and the proposed Cherrywood Subdivision property shows the efficacy of such grassroots advocacy. When the two bridges for the Godding Ditch and the Rural Ditch needed repaired, and county accessed the need and replaced them with large culverts. Also, the graveled road is routinely maintained, resulting in smoother riding on the road. The county roads that have been given to the towns to maintain, have deteriorated to the point where alternate routes are selected to drive on. Therefore, we do not want WCRd 20 '/2 to be given away to any municipality. The proposed annexation of Rinn Valley Ranch is still surrounded by Weld County on all four sides. We had contacted commissioner, Glen Vaad, over three months ago concerning this issue. He said he would research the law on transferring county roads to a municipality without a vote of the county residents residing there. As of this date, we haven't received this information. Please keep WCRd 20 'h a county controlled road. Thank you in advance for your cooperation in this matter.
