RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #2779 - LEN AND
LORI LINDHOLM
WHEREAS., the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption #2779 was submitted by Len and Lori
Lindholm, 9754 Weld County Road 80, Fort Collins, Colorado 80524, for property which is
located in part of the W1/2 NE1/4 of Section 22, Township 7 North, Range 67 West of the 6th
P.M., Weld County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 25 acres and 21.5 acres, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony
presented, the Board determined that said request shall be denied for the following reasons:
1. It is the opinion of the Board of County Commissioners that this proposal evades
the purpose of the Weld County Subdivision Ordinance as defined in Section
1.3.
2. The Board feels this division would be inconsistent with efficient and orderly
development.
3. The Board feels this proposal is not consistent with the Weld County
Comprehensive Plan.
4. It is the opinion of the Board that any further division of these lots will create
additional accesses onto Weld County Road 80 and will increase the density of
the existing linear subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request for Recorded Exemption #2779, submitted by Len and
Lori Lindholm be, and hereby is, denied.

The Department of Planning Services' staff has reviewed this request and recommends that it be
denied for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has Pot shown
compliance with Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as
follows
A. Section 11.4.2.3 - Consistency with the intent of the zone district that the recorded exemption
is located within, as expressed in the Weld County Zoning Ordinance. The applicant's parcel
is currently zoned Agricultural. Approval of this Recorded Exemption would not be consistent
with the intent of the Zone District. The parcel has been identified by the United States
Department of Agriculture, Important Farmlands of Weld County Map as"Prime"farmland. The
Agricultural Zone District was established to maintain and promote agriculture as an essential
feature of Weld County and to provide areas for the conduct of agricultural activities and
activities related to agriculture as well as agricultural production without the interference of other,
incompatible land uses. The proposed division and residential use of this property is considered
incongruous with agricultural uses.
B. Section 11.4.2.4 - Consistency with the purpose of efficient and orderly development us
expressed in Section 1.3 of the Weld County Subdivision Ordinance.
1) Section 1.3.1 - Assisting orderly and integrated development. Weld County Planning
Services' Staff maintains that further division of this property does not assist in orderly
or integrated development of Weld County. A. Goal 4 of the Weld County
Comprehensive Plan states - Provide a mechanism for the division of land which is
agriculturally zoned. The intent of this goal is to maintain and enhance the highest level
of agricultural productivity in Weld County.

2) Section 1.3.2 - Promoting the health, safety, and general welfare of the residents of the
County. Continued increases in the number of residential or small lots in predominantly
agricultural areas may detract from the health, safety and welfare of the indigenous
residents of the area as well as residents of the County. Continued urbanization of rura:
Weld County further pressures already strained services, such as but not limited •o, fire
protection and law enforcement services.
3) Section 1.3.10-Preserving agricultural land and promoting its most productive agrarian
u.se. The preservation of prime farmland is one of the primary goals of the Weld County
Comprehensive Plan. A. Goal 9 states "The minimum lot size of parcels in the
Agricultural zone district should remain at 80 acres to encourage parcels large e lough
to retain viable farming operations or to accommodate modern agricultural equipment'
and irrigation practices." Further land division of this type through the Recorded
Exemption process is expected to diminish agrarian uses of the area.
C. Section 10.5 - Lot Size Standards. Section 10.5.10-A flag lot configuration shall be avoided
when possible. Given the existing flag configuration of the parcel before the application, turther
subdivision would result in the creation of an island lot with access dependent on Flag Lot A
Should the Board of County Commissioners approve this request, the Department of Planning
Services' staff recommends the following conditions be attached:.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel
B Lots A and B shall use the existing residential, agricultural, oil and gas, or ditch road access
point as no additional accesses shall be granted. The access shall be graded and drained to
provide all weather access and shall be a minimum distance of 75 feet from any intersecting
County or State roadway.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the
Weld County Department of Public Works to determine if a culvert is necessary at any approved
road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is
Weld County's minimum size. If the applicant chooses to place a larger culvert please contact
the Weld County Department of Public Works to adequately size the culvert.
D. Weld County Road 21 is designated on the Windsor Study Area Improvements Need Map as
a rural paved road, which requires 60 feet of right-of-way at full build out. There is presently
60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 21 snail be
delineated on the plat. This road is maintained by Weld County.
E. Weld County Road 80 is designated on the Windsor Study Area Improvements Need Map as
a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60
feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 80 shall be
delineated on the plat. This road is maintained by Weld County.
F. A 30 foot wide joint easement extending across Lot A from Weld County Road 80,for the benefit
of Lots A and B, shall be shown clearly on the plat. The joint access easement shall be
dedicated for the use as shown using the language set forth in Section 11.7.1.12.5 of the Welc
County Subdivision Ordinance and shall specify whether it is dedicated, private or deeced to
provide access to the parcel.
G. Due to the prime agricultural soils on Lot B, the applicant shall submit a Building
Envelope to the Weld County Department of Planning Services for review. Upon
approval by the Department of Planning Services, the Building Envelope shall he
delineated on the plat.
H. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Zoning Ordinance, the required setback is
measured from the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
4) Prior to the release of building permits. the applicant shall submit evidence to
the Department of Planning Services that the lot has an adequate water supply
of sufficient quality, quantity and dependability.
5) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Weld County Ordinance 169A.
6 ) Effective December 1, 1999, Building Permits issued on the proposed lots hill be
required to adhere to the fee structure of the Windsor Service Area Road mpact
Program. (Ordinance 210)
7) In accordance with Section 10.5.10 of the Weld County Subdivision Ordinance.
the flag lot configuration will be avoided where possible. The minimum width
of a flag lot is 30 feet.
8) RIGHT TO FARM COVENANT: Weld County is one of the most productive agricultural
counties in the United States. The rural areas of Weld County may be open and
spacious, but they are intensively used for agriculture. Persons moving into a rural area
must recognize there are drawbacks, including conflicts with longstanding agricultural
practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area
Well run agricultural activities will generate off-site impacts, including noise from tractors
and equipment; dust from animal pens,field work, harvest, and gravel roads; odor from
animal confinement, silage, and manure; smoke from ditch burning; flies and
mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial
spraying. Ditches and reservoirs cannot simply be moved"out of the way"of residential
development without threatening the efficient delivery of irrigation to fields which is
essential to farm production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware)with more than 3,700 miles of state and county roads outside of municipalities.
The sheer magnitude of the area to be served stretches available resources Law
enforcement is based on responses to complaints more than on patrols of the county and
the distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who
must leave their jobs and families to respond to emergencies. County gravel roads, no
matter how often they are bladed, will not provide the same kind of surface expected
from a paved road. Snow removal priorities mean that roads from subdivisions to
arterials may not be cleared for several days after a major snowstorm. Snow removal
for roads within subdivisions are of the lowest priority for public works or may be the
private responsibility of the homeowners. Services in rural areas, in many cases, will not
be equivalent to municipal services.
Children are exposed to different hazards in the country than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of the
farmer's livelihood. Parents are responsible for their children.
3. The applicant shall submit a Mylar plat to the Weld County Department of Planning Services io be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in
accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance The
plat shall be submitted within sixty (60) days from the date of approval by the Weld County.

MEETING THIS MORNING THAT WE WANTED TO CLARIFY.
AS YOU CAN EXPECT WE ARE VERY UPSET ABOUT THE BOARDS DECISION TO DENY OUR
REQUEST, BUT CAN UNDERSTAND THAT BECAUSE OF THE LACK OF INFORMATION AND
PROBABLY THE LENGTH OF TIME IT WAS TAKING THEY FELT THE NEED TO MAKE A
DECISION. UNFORTUNATELY, THIS DECISION HAS COST US OUR APPLICATION FEE, PLUS
OTHER COSTS THAT WE HAVE INCURRED.
WE RELIED TOTALLY ON YOU & YOUR ADVICE ON THIS ISSUE, AND IT SEEMS THAT EVEN
THOUGH WE DID WHAT WE WERE TOLD, WE WERE DENIED.
WE ARE CONFUSED REGARDING THE DISCUSSION THAT TOOK PLACE REGARDING OUR
RIGHTS FOR RECONSIDERATION.
IT IS OBVIOUS THAT WE NEED TO TAKE THOSE STEPS IN ORDER TO GET IT
RECONSIDERED BY THE BOARD, BUT LEN & I NEED TO KNOW WHAT WE NEED TO DO IN
ORDER FOR IT TO GET APPROVED, NOT DENIED FOR THE SECOND TIME.
WE UNDERSTOOD FROM YOU, THAT WE NEEDED TO HAVE OUR OWN LEGAL ACCESS TO
OUR PROPERTY, AS EVERYONE ELSE WITH A LOT. WHAT THE BOARD IS SAYING TO US
REGARDING SHARING THE ACCESS TO LOT A & B IS CONFUSING?? WOULD NOT THIS BE
CONSIDERED AN "EASEMENT" THAT COULD BE REVOKED? COULD WE DEED BACK TO
BOB & IZETTA THE WEST ACCESS, HAVE THE WETHINGTON'S DEED THE EAST ACCESS TO
US, AND THEN HAVE IT AS A SHARED ACCESS ROAD FOR LOT A & B.
WHY COULD WE NOT HAVE JUST TABLED THIS MEETING WITHOUT A DECISION MADE,
UNTIL FURTHER DOCUMENTS COULD BE PROVIDED??

Dear Commissioners:
Mr. and Mrs. Len Lindholm have requested a Recorded Exemption on part of the Northeast Quarter of
Section 22, Township 7 North, Range 67 West of the 6th Prime Meridian. The 46.50 +/- acre parcel is
South of and adjacent to Weld County Road 80 and '/:mile East of the Weld County Road 19. There is
one existing home located on proposed Lot A.
Department of Planning Staff asserts that the application is not in compliance with Section 11.8.7 of the
Weld County Subdivision Ordinance. For this reason we are requesting the case be reviewed by the
Board of County Commissioners. Planning Staff is recommending denial of the Recorded Exemption
application Number 2779, for the following reasons:
Section 11.4.2.3 - Consistency with the intent of the zone district that the recorded exemption is located
within, as expressed in the Weld County Zoning Ordinance. The applicant's parcel is currently zoned
Agricultural. Approval of this Recorded Exemption would not be consistent with the intent of the Zone
District.
Section 11.4.2.4 - Consistency with the purpose of efficient and orderly development as expressed in
Section 1.3 of the VVeld County Subdivision Ordinance.

ANSWERS TO RECORDED EXEMPTION QUESTIONAIRE
1,A. We hereby present documentation that the proposed exemption will have
Sufficient domestic water, that will meet the standards set forth by Weld
County Department of Planning. We have contacted North Weld County
Water District, & they have confirmed that a water tap is available to the
Purchaser of said exemption. (See letter from NWCWD)
1,B. Currently both smaller & larger parcels are irrigated using 1/2 share of Water
Supply & Storage. Applicants of said exemption are the owners of the '/2 share
Of water. If the future purchasers of the Larger parcel desire to obtain
Irrigation water, '/ share will be made available for purchase by the
Applicants.
2. An approved Septic system already exists on the smaller parcel, see current
Sewage Disposal System Permit dated 12-30-1992. We will be held accountable
That the Proposed larger exemption will also have a Sewage Disposal System
That meets the requirements of the Zone District & Weld County Health Dept.
3. Current usage of the smaller exemption which measures approximately, 21.5
Acres, is made up of prime agricultural land, in which a primary family
residence is located. A fenced pasture for grazing cattle is to the South of the
home. A cattle/horse shed is on this property with an Automatic Waterer for the
Cattle. Three Registered Semintol Cattle make up the Livestock on this parcel.
Crops that are currently being farmed on this parcel are Corn & Pasture.
An irrigation ditch run's along the North edge of this Property, which feeds
farm's to the East half of this quarter. This parcel is irrigated by a portion of the
'A share of Water supply & storage. Domestic water is provided by NW CW D.
The Larger Parcel, approximately 25 acres is currently farmed as 10 acres of
Grass/barley, and remainder 15 acres is Corn, this parcel is currently irrigated
with a portion of the ''' share of Water Supply & Storage.
4. The Purpose of this exemption is to sell the Larger parcel for the
Intent of Farm/Agricultural use, with the construction of a Single Family
Residence. The smaller lot will remain as described above in #3, with Primary
residence & agricultural use.

8. We understand the need for conservation for Prime Farm/Agricultural land.
We feel that this land does not meet the needs for Wetland or Wildlife
Conservation, and therefore it is already being used for farming purposes.
At this time we are not proposing a Conservation Easement.
9. A building envelope will be designated on the Larger parcel, as long as the
Building envelope will allow construction on either the East or West ends of the
Larger parcel. The smaller parcel already meets Weld County Comprehensive
Plan.

11. Current section is currently Prime Agricultural/Farming Land, with primary
Residence's surrounding. The Proposed exemption will be compatible with the
existing neiighborhood for farming & livestock use.

exemption as farm use/residential property. We believe that Weld County is
rich because of its strength of the Farm Industry, but most importantly, the

2. V - North Weld County Water District is able and intends to provide water service to the ahoy(-
mentioned property,provided all requirements of the District are satisfied
If contracts have not been completed with North Weld County Water District within one year from the date of tlrs
letter,this letter shall become null and void. The Tap Fees quoted below,shall be valid for ten(10)business days
from the date the applicant receives this letter. After ten days,the costs will be subject to the current cost established
by the District. the applicant can avoid the Raw Water portion of the ap Fee,by permanently transferring one unit

this letter. After :.he water tap has been purchased(Raw Water AEU&Plant Investment Fee)the applicant has one
year in which to have the meter set. The District requires 45 days prior notice to setting a meter. If the meter has
not been set within one year Iiorn the purchase of such meter,the District shall refund the applicant 75%of the
purchase price that was paid by the applicant. If any line extensions,road bores or additional installation costs a e
estimated to be more than $5,000, then Proof that"Loan Funds or a Line of Credit" are Available and ready L1
reimburse the District at the time of completion, for 1100/ of the estimated cost. The applicant will pay such r oses

"1 he District recommends that anticipated water usage be purchased through the District. The District guarantees
treatment and delivery of water purchased_ All rental water and water that is delivered with surcharge is subject to
water availability and will be issued on a first come-first serve basis and is not guaranteed to be available. The
District requires that 1 Acre-Foot Unit (All)) is purchased. With I AEU purchased any usage beyond 228,000
gallons will be in surcharge. The Plant Investment Fee shown above pays for the infrastructure required to deliver
