HomeMy WebLinkAbout20002028 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO AUGUST 23, 2000 TAPE #2000-23 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, August 23, 2000, at the hour of 9:00 a.m. ROLL. CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter - EXCUSED Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden READ ORDINANCE BY TAPE: READ ORDINANCE #119-Q BY TAPE: Commissioner Hall moved to read Ordinance #119-O by tape. Commissioner Geile seconded the motion, which carried unanimously. MINUTES: Commissioner Vaad moved to approve the minutes of the Board of County Commissioners meeting of August 21, 2000, as printed. Commissioner Hall seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: The following was added under Planning: 2)Consider Request to Vacate Site Specific Development Plan and Use by Special Review Permit #1161 for a Commercial Use (custom woodworking shop) in the A (Agricultural) Zone District - Paul and Ann Linn [2000-2034]. CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Geile seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. PUBLIC INPUT: There was no public input. 2000-2028 BC0016 WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $484,902.05 Commissioner Hall moved to approve the warrants as presented by Mr. Warden. Commissioner Geile seconded the motion, which carried unanimously. BIDS: PRESENT LAB EQUIPMENT AND SUPPLIES BID - DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Mr. Warden presented the three bids received. Said bids will be considered for approval on Wednesday, September 6, 2000. APPROVE 2000 SEALCOAT PROJECT BID - DEPARTMENT OF PUBLIC WORKS: Mr. Warden stated the Department of Public Works recommends approval of the low bid for Alternate #1 from Thompson Valley Sealcoat, in the amount of $30,328.32. Commissioner Hall moved to approve said bid as recommended by staff. Commissioner Geile seconded the motion, which carried unanimously. APPROVE SMALL TOOL BID-DEPARTMENT OF PUBLIC WORKS: Mr. Warden stated the Department of Public Works recommends approval of the low bid from Centurion Tool and Supply Company, in the amount of$9,848.24, and the low bid from Snap-On Tools for items#12 and#18, in the amount of$33.08. In response to Commissioners Geile and Vaad, Mr. Warden stated the Department of Purchasing split out the various tools and priced them individually, therefore, the original bid amount is slightly different than what is being considered for approval, and staff will need to turn in a broken tool before a new one is issued. Commissioner Geile moved to approve said bid as recommended by staff. The motion, which was seconded by Commissioner Hall, carried unanimously. PLANNING: FIRST READING OF ORDINANCE #119-Q, IN THE MATTER OF AN AMENDMENT TO ORDINANCE NO. 119,WELD COUNTY BUILDING CODE ORDINANCE,AS CURRENTLY AMENDED,REVISING AND ADDING CERTAIN SECTIONS CONCERNING ENGINEERED BUILDINGS BEING ALLOWED AS AGRICULTURALLY EXEMPT BUILDINGS AND GRAMMATICAL CHANGES: David Sprague, Department of Building Inspection, stated the Building Code currently requires any engineered building to have a building permit and is not considered agriculturally exempt. The proposed change would allow engineered structures to qualify as agriculturally exempt if they meet the definition. In response to Commissioner Geile, Mr. Sprague stated the agriculturally exempt buildings are defined and only allow for certain uses. He further stated these buildings will be allowed to have electricity; however, any other utility will require a building permit and will not be agriculturally exempt. Mr. Sprague stated the remaining changes include grammatical corrections and minor clarifications to the existing restrictions. In response to Commissioner Geile, Mr. Sprague stated there are several instances in Aristocrat Ranchettes where multiple mobile homes were joined to create one residence and this amendment will clarify that no more than two mobile homes will be allowed to be connected. He further stated that those sites that already exist with multiple mobile homes, will be grandfathered in. Mr. Sprague stated the definition of "groundset" has also been added to the code for clarification. No public testimony was offered concerning this matter. Commissioner Geile moved to approve Ordinance #119-Q on first reading. Commissioner Hall seconded the motion, which carried unanimously. Minutes, August 23, 2000 2000-2028 Page 2 BC0016 CONSIDER REQUEST TO VACATE SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT #1161 FOR A COMMERCIAL USE (CUSTOM WOODWORKING SHOP) IN THE A (AGRICULTURAL)ZONE DISTRICT-PAUL AND ANN LINN: Chair Kirkmeyer stated vacation of this item is contingent upon approval the 10:00 hearing for Use by Special Review Permit#1273 for an Agricultural Service Establishment (wholesale/retail nursery) in the A (Agricultural) Zone District. Chair Kirkmeyer recessed this matter to be considered following the 10:00 hearing. Upon reconvening, Mr. Gathman referred to a letter from Paul Linn, dated, July 11, 2000, requesting vacation of Site Specific Development Plan and Use by Special Review Permit#1161 for a Commercial Use (custom woodworking shop) in the A (Agricultural) Zone District, contingent upon approval of Site Specific Development Plan and Use by Special Review Permit #1273. Mr. Gathman clarified that said permit was just approved and he recommends approval of the requested vacation. Commissioner Hall moved to approve the vacation of Site Specific Development Plan and Use by Special Review Permit#1161 for a Commercial Use (custom woodworking shop) in the A (Agricultural) Zone District for Paul and Ann Linn. Commissioner Geile seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinance #119-Q was approved on first reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
