Lots of lesser size are not generally practical to farm due to large scale management practices existing today." b. Section 11.4.2.4 - Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. 1) Section 1.3.1 -Assisting orderly and integrated development. 2) Section 1.3.2-Promoting the health, safety, and general welfare of the residents of the County. 3) Section 1.3.8-Securing equitable handling of all subdivision plans by providing uniform procedures and standards. Planning staff has consistently approved lots on prime farm ground that are approximately 9 acres or less, unless other circumstances exist. This size is based on a pivot sprinkler corner which is approximately 8 acres. 4) Section 1.3.10-Preserving agricultural land and promoting its most productive agrarian use. 5) Section 1.3.11 -Ensuring irrigation water currently associated with a farm or rural unit of land will be retained for agricultural uses. c. Section 11.4.2.5-Compliance with the recorded exemption standards set forth in Section 11.8 of the Weld County Subdivision Ordinance. 1) Section 11.8.3-An adequate legal access exists for all proposed lots to a public road. The Weld County Department of Planning Services approves the applicant's proposed building envelope for Lot C located west of and adjacent to Weld County Road 55 north of the Henrylyn Irrigation Lateral. Evidence shall consist of an access agreement with the Ditch company or evidence that they retain ownership of the property along the ditch. Lot C shall use the existing agricultural /oil and gas /ditch road access points necessary for agricultural operations. The proposed residential access is a ditch access. The applicant shall submit evidence that the access is a ditch easement and not owned by the ditch company. Should the access be a right-of-way owned by the ditch company,the applicant shall submit to the Weld County Department of Planning Services a recorded copy of an agreement signed by the ditch company. The access shall be for ingress and egress and shall be referenced on the plat by the Weld County Clerk and Recorders reception number. No additional accesses shall be granted. F. Lot A shall use the existing residential/agricultural access point. No additional accesses shall be granted. G. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. Weld County Roads 18 and 55 are designated on the Weld County Transportation Plan Map as local gravel roads, which require 60 feet of right-of-way at full build out. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work, harvest, and gravel roads; odor from animal confinement, silage, and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient that urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. Mark Kauffman and Julius Plus have applied to split 180 acre parcel into a 120 acre and two 30 acre parcels. The site is located north of and adjacent to Weld County Road 18 and west of and adjacent to Weld County Road 55; 1 mile northwest of the Town of Keenesburg. Surrounding properties are agricultural in nature with limited residences. The site has been planted in corn and is designated "Prime" farmland by the USDA and the Southeast Weld Soil Conservation District. One uninhabitable home lies on Lot A. MAP 8 referral agencies reviewed this case, 4 responded favorably or included conditions that have been addressed through development standards and conditions of approval. 3 referral agencies did not respond. The Weld County Department of Public Works indicated the flag lot configuration should be avoided where possible. The Weld County Department of Planning Services has concerns regarding the lot size of 30 acres each proposed for lots A and B. The preservation of prime farmland is one of the primary goals of the Weld County Comprehensive Plan. A.Goal 4 states "Provide a mechanism for the division of land which is agriculturally zoned. The intent of this goal should be to maintain and enhance the highest level of agricultural productivity in Weld County." This proposal will take sixty acres of prime farmground out of production. The second concern is in regards to the flag lot configuration. Section 10.5.10 of the Subdivision Ordinance states "A flag lot configuration shall be avoided when possible." Many alternatives exist along the two road frontages that would be acceptable alternatives to the proposal. Planning Staff would like to make it clear, we were very willing to approve an alternative proposal with smaller Lots A and B along the road frontage. Planning staff is very consistent with the dividing of Prime farmground. Our preference would be 2 '/2 acre lots with road frontage, however, we have consistently approved lots of up to 9 acres based on the size of an average pivot sprinkler corner. Planning staff is confused by conversations with the applicants representative. The fact that extra water has to be leased to properly irrigate the site was used as justification for the split. However, it has also been suggested that since the for sale signs went up, great interest has been achieved because of the lot size and that they have water. There is one non-working well at the improvements that may be late- registered and/or re-drilled in order to provide a water supply to proposed Lot "A." The remaining parcels should be able to obtain domestic wells with outside use since the property lies within the Lost Creek Ground Water Management District. The applicant proposes that as a condition of approval the placement of a note on the final plat that states no building permits will be issued on Lots "A," "B," or "C" without demonstrating an adequate domestic water supply. b. Irrigation: The property is mostly irrigated farmland typical to the area. Irrigation supply is derived from a pro-rata share of all waters derived from inclusion of the property in the Henrylyn Irrigation District. These waters do not supply an adequate amount of water to produce crops typical to the area without leasing additional waters. There is adequate vegetative cover to prevent undue erosion. 2. Statement regarding sewage disposal/septic: The dwelling on proposed Lot "A" is of salvage value only and is uninhabitable. There is no existing septic system permitted by the Weld County Health Department. All proposed lots are of sufficient size to be eligible for a future septic system. 3. Description of current use of the property: The current use of the property in total is as an irrigated farm. 4. Reason for the Recorded Exemption and proposed use of the property: The applicants seek approval of a Recorded Exemption to re-configure the property for potential sale of lots on the west side with a large lot on the east. This will more closely match the way the farm is being operated and will afford the applicants the ability to sell off less productive portions of the property in order to reduce debt and increase efficiency. 5. Description of location, size, use of new lots: Proposed Lot "A is located in the southwest part of the parcel, consists of 30 acres +/-, and will be used as a rural residential parcel. Proposed Lot "B" is located in the southwest part of the parcel, consists of 30 acres 4-, and will be used as a rural residential parcel. Lot "C" is the balance of the property, consists of 120 acres +/-, and will be used for agricultural production and would be a legal building site for one single-family dwelling. 6. Statement regarding unique physical properties: There are no unique physical properties of the parcel that affect the consideration of a Recorded Exemption. The configuration of the lots is made to accommodate the slope of the land, the shape of the existing fields, and the location of irrigation lateral ditches. 7.
