HomeMy WebLinkAbout20002727.tiff RESOLUTION RE: APPROVE INDEMNITY AGREEMENT FOR LOST LETTER OF CREDIT INSTRUMENT FOR SITE PLAN REVIEW, AND AUTHORIZE CHAIR TO SIGN - KINGS COURT PROPERTIES, LLLP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Indemnity Agreement for a Lost Letter of Credit Instrument for Site Plan Review, SPR#315, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, and Kings Court Properties, LLLP, c/o Wells Fargo Bank Minnesota, National Association, with terms and conditions being as stated in said indemnity agreement, and WHEREAS, after review, the Board deems it advisable to approve said indemnity agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Indemnity Agreement for a Lost Letter of Credit Instrument for Site Plan Review, SPR#315, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, and Kings Court Properties, LLLP, do Wells Fargo Bank Minnesota, National Association, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said indemnity agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 1st day of November, A.D., 2000. To: Board of County Commissioners October 31, 2000 COLO ADO From: Kim Ogle, Plannery/{) • Subject: Release of Irrevocable Letter of Credit SPR 315 On March 13, 2000, Airborne Express delivered an Express Letter from Norwest Bank of Minnesota, Minneapolis Office, to the Weld County Commissioners Office. The Express Letter was received by Esther Gesick, as indicated on the Shipper's Copy. The Express Letter and the documents it held have not been located by the office of the Clerk to the Board or by the County Attorney's Office. The document in question is a Letter of Credit (LC Number S407521) in the amount of ten thousand and no/100s dollars (10,000.00) for improvements to the property described as Lot 12, Block 2, Rademacher Business Park PUD. This property is owned by Ken Williamson of K & C, R.V., Inc., a.k.a. King's Court Properties, LLLP. At the request of John Canny, legal counsel for Mr. Williamson, an Indemnity Agreement is required for the lost Letter of Credit. Wells Fargo Bank, formerly Norwest Bank of Minnesota, requires this document to be signed before it will re-issue the Letter of Credit for King's Court Properties, LLLP. Lee Morrison, Assistant County Attorney, has advised that the release of funds would be in accordance with the terms of the request by Wells Fargo Bank for re-issue of the Letter of Credit for King's Court Properties, LLLP.
