RE: GRANT MOBILE HOME PERMIT, ZPMH #2235-VICENTE MARTINEZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 18th
day of December, 2000, considered the request of Vicente Martinez, 15236 Highway 52, Fort
Lupton, Colorado 80621, for a mobile home to be used as a principal dwelling, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 2, Block 24, Aristocrat Ranchettes. located in
Section 27, Township 2 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard all of the testimony,
finds that said request should be granted subject to the following conditions:
1. The applicant shall apply for a building permit for the mobile home prior to
locating the mobile home on the property.
2. Prior to the occupancy of the mobile home, the mobile home shall be connected
to an approved septic system and a legal water supply.
3. The mobile home shall not be occupied until such time that the applicant has
complied with Conditions 1 and 2 stated above.
4. A derelict manufactured (mobile) home is defined as: a manufactured (mobile)
home that is partially or totally damaged by fire, earthquake, wind, or other
natural causes, or is in a state of general dilapidation, deterioration, or decay
resulting from improper lack of maintenance, vandalism, or infestation with
vermin or rodents. Any such derelict manufactured (mobile) home shall be
returned to and maintained in the condition as originally established on site and
as inspected by the Weld County Department of Building Inspection, or it shall
be removed from the site.
5. Nancy Avenue is designated on the Transportation Plan Map as a subdivision
road, which requires a 60-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of setback in the Weld County Zoning Ordinance, the required setback
is measured from the future right-of-way line.
6. The access shall be placed in such a location to have adequate sight distance in
both directions and not below the crest of a hill or where physical obstructions
are present.

7. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's
minimum size requirement. If the applicant chooses to place a larger culvert, he
shall contact the Public Works Department to adequately size the culvert.
8. Direct access from a public road shall be limited; only one access is allowed per
legal residential parcel. No circle drives will be allowed. This policy shall apply
to all new and existing accesses within the unincorporated areas of Weld
County.
9. Pursuant to Ordinance No. 169A, if noxious weeds exist on the property or
become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
10. The applicant shall maintain compliance with Section 43.2.6 of the Weld County
Zoning Ordinance at all times.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Vicente Martinez for permission to place a mobile
home to be used as a principal dwelling on the above described parcel of land, which was found
to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is,
granted subject to the hereinabove listed conditions.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 18th day of December, A.D., 2000.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be approved for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 43.2.6 of the Weld County Zoning Ordinance, as follows:
a. Section 43.2.6.1.1-The proposed mobile home is compatible with the surrounding area, is
in harmony with the character of the neighborhood and its effects upon the immediate area.
The surrounding area is an Agricultural subdivision with mostly mobile homes and
manufactured homes and Agricultural uses.
b. Section 43.2.6.1.2-The proposed mobile home is compatible with the Weld County
Comprehensive Plan. The mobile home will be placed in an Agricultural subdivision to be
used as a principal residence and will not interfere with agricultural uses.
c. Section 43.2.6.1.3-There is available water and sewage disposal facilities for the mobile
home. The applicant has public water with Aristocrat Ranchette Water and a septic permit
(G-920293)with the Weld County Health Department.
d. Section 43.2.6.1.4-The general health,safety and welfare of the inhabitants of the area and
the county will not be jeopardized or compromised by the location of the mobile home on
this site.

The Department of Planning Services' staff recommendation for approval is conditional upon the
following:

Dear Mr. Martinez:
Your zoning permit for a mobile home application is being processed by our office. If it is determined that
the application meets the approval criteria of Section 43 of the Weld County Zoning Ordinance,you will be
notified that the zoning permit is approved. If the staff determines that the application does not meet the
approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a
public hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of
County Commissioners will then consider your application and make a final decision on the zoning permit
for the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the Fort Lupton Planning Commission for their review and comments. It is
recommended that you and/or a representative be in attendance at the Fort Lupton Planning Commission
meeting to answer any questions the Commission members may have with respect to your application.

of this meeting.

A local residential/agricultural access shall be a minimum distance of 75 feet from an intersecting county or state
roadway, and 150 feet for commercial type use.

drives will be allowed. This policy shall apply to all new and existing accesses within the unincorporated areas of
Weld County. Properties within municipalities or other counties that access Weld County roads are also subject
to this policy.
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.

This letter is written to oppose the above referenced Application for Mobile Home as a

We own the prrty to the south of proposed lot, and have lived there since 1989. Mr.
Martinez has owned Lof5'1, 2, 3, and a portion of Lot 4 of Block 24 for several years. Basically,
other than our house, M4.Martinez owns the remain& of Block 24, Aristocrat Ranchettes. While
we have no objection twills) reasonable and orderly development of lots surrounding our home,
and have no objectioc to the development and si ie of the developed property to an owner-
occupant,we do object V' development of the pr perty as a rental home, because our home
would become the only kOwner-occupied house on the block. Based on the lack of maintenance
of Mr. Martinez's existirt rental, we question whether Mr. Martinez is capable of reasonable and
orderly development end subsequent maintenance of a rental property.

Most of the homes along Patrick Street are owner-occupied dwellings where the owners
care about the condition'of their property. Landscaping, trees and grass are evident to the extent
allowed by the soil and,vvater conditions. The Lots adjoining ours, owned by Mr. Martinez, are
overgrown with volunteer wheat and noxious weeds, such as thistle, sandburrs and goatheads
which we neighbors attempt to keep off our property
Since our house could be the only owner-occupied dwelling on the block, if the within case,
along with Case ZPMH,;2236, are approved, having three rental homes surrounding ours will not
be compatible. In addition, we are concerned about the lessening of our property value. Our
home recently appraise for$146,000. The appraiser verbally told us that the value would have
been higher if not for tli: erelict rental next door. With three such rentals, we believe the ability
to sell our house at curilent market value will be greatly diminished.

Since Mr. Martinez purchased the property to the west t us, located at 15977 Caroline
Avenue, we have struggled to convince Mr. Martinez to maintain • tat property. as well as the rest
of the block, which is vacant land. Enclosed are copies of letters dated June 25, 1995, Jun( 10,
1996, October 28, 1996; and July 2, 1998, showing that Mr. Martinez has a consistent pro, lem
with weed control, and trash/fire hazard removal. More than once, the Fire Marshall was fo ced
to contact Mr. Martinez to request that the weeds be cut. Since Mr. Martinez has owner the
property at 15977 Caroline, the building has never been painted, weeds grow unchecked, trash
is strewn about, and the garage door of our common wall garage is in such disrepair that during
a recent wind storm a p{ece flew over the fence and damaged our 1997 Geo Metro.
It is our opinion that the property at 15977 Caroline woul ivalify as a substandard building
as defined in Sections 20.13.4, Attractive Nuisance, and 2r 3.11, Hazardous or Unsanitary
Premises, of the Building Code. We have not filed a formal i nplaint with Zoning Compliance
against Mr. Martinez, in an attempt to remain good neighbors. However, we are not willing to
deliberately contribute;:to additional problems, i.e., more rentals developed and maintained in
similar condition.
Further, on November 24, 1993, in Case No. ZPMH-1875, Mr. Martinez attempted to
develop Lot 1 of Block Z4:' Shortly before the case was to be heard, Mr. Martinez moved a single-
wide, dilapidated, mobile home onto the property in anticipation of approval of his Application.
Upon our questioning tie Planning Staff, we came to learn that a Petition was in the file which
purported to comply with Sectiion 43.4.1 of the Zoning Ordinance, indicating that the surrounding
property owners had n4bbjection to the issuance of a zoning permit. We found this interesting,
since only one of the tti ee petitions in the file had ever been presented to, or signed by us.
After investigation, it was found that Mr. Martinez, or an agent of Mr. Martinez, had
submitted a petition or petitions with our signatures forged. The r ,ter was forwarded to the Weld
County District Attorney' It is our understanding that Mr. Martirez received a deferred sentence
for this act. After deli 1 of his Application, the derelict mobile home remained until repeated
zoning violations force shim to move it.

We have beerOcurrently informed that Mr. Martinez has not submitted a Petition of
Approval of the Surrouri ing Property Owners for the within Application. No surprise, considering
the attitude toward Mr. ` artinez by the surrounding neighbors, based on r ast experience.

Finally, we are;';'"4oncemed about Mr. Martinez's continuing disregard for his duties as a
landowner. We have ittle confidence that, if this Application is approv 3d, Mr. Martinez will
suddenly become a mgjlel property owner and landlord.

A. Based on the surrounding properties being either stick-built homes, modular homes
or higher-end mobile homes, we do not believe that a mobile hon a of the type
previously proposed by Mr. Martinez is in character with this neighs orhood. We
believe that either a manufactured house, or a mobile home with a cosmetically
enhanced exterior, as defined in the Zoning Ordinance, should be required.
2. Section 43.2.6.1.4 deals with the proposed lot being compatible with the gem al
health, safety and welfare of the inhabitants of the area and the Courty.

A. The existing Lot is infested with noxious weeds and volunteer grain of a
type that attract rodents, snakes and skunks, which we endeavor to keep
offi our property each year. The existing landscaping is incompatible with
the safety and welfare of the surrounding inhabitants. We believe that the
nOzious weeds and volunteer wheat should be permanently removed.

Further, landscaping, such as sod (or decorative rock), shrubs and trees,
such as is required under Section 9.3.2.1 and 9.3.2.3 of the Planned Use
D4elopment Ordinance, should be a requirement, to prevent the return ,>f
such pests. Such landscaping would also contribute to harmony of tie
neighborhood, under Section 43.2.6.1.1.
B. Now that adequate water has been made available through a tap from
Aristocrat Ranchettes Water Project, there is no reason why landscaping
cannot be achieved.
Although the Aristocrat Ranchettes subdivision has been rrglected in the past, there is a
new sense of community, shown by the actions of people who are fixing their properties and
improving the beauty of the neighborhood. The mere fact that the subdivision is platted under an
earlier rule is not a sufficient reason to inflict on the surrounding property owners the results of
those substandard rules, when the surrounding property owners have attempted to comply with
existing regulations. ; e ask that reasonable measures be put in place to benefit both the
Applicant's property as,, ell as surrounding property owners. Thank you for your consideration.
