memorandum. If the Town has not received comments from your agency within this 30-day period, the
Town will consider the lack of a response to be a positive response to the proposal in its current form.
However, for the purposes of having a complete file on this proposal, the Town would appreciate a
response from your office even if your only comment below is "no comment." Thank you very much for

Public Hearings: The Windsor Planning Commission will hold a public hearing at 7:00 p.m. on
Thursday, November 2, 2000 and the Windsor Board of Trustees will hold a public hearing at 7:)0 tin. on

RESOLUTION NO.2000- 77
BEING A RESOLUTION MAKING CERTAIN FINDINGS OF FACT AND ESTABLISHING THE;
TOWN OF WINDSOR'S INTENT TO ANNEX CERTAIN REAL PROPERTY KNOWN AS THE;
WINDSHIRE PARK ANNEXATION AND A DETERMINATION OF SUBS'IANTIAI.
COMPLIANCE WITH THE MUNICIPAL ANNEXATION ACT OF 1965
WHEREAS, a petition has been filed by Windsor Northern Farms I, LLC, to annex to the Town
certain real property known as the Windshire Park Annexation, more particularly described within the
petition which is attached hereto and incorporated herein by this reference; and
WHEREAS, pursuant to the Municipal Act of 1965, the Town is required to establish a date, time
and place for a public hearing on said annexation; and
WHEREAS, the Town is further required to determine that the petition for annexation is in
substantial compliance with the Municipal Annexation Act of 1965.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED BY 'THE BOARD OF
TRUSTEES OF THE TOWN OF WINDSOR., COLORADO, AS FOLLOWS:
1. The petition for annexation has been signed by more than 50 percent of the land owners in
the proposed annexation, said land owners owning more than 50 percent of the land in the
area to be annexed.
2. At least 1/6 of the boundaries of the proposed annexation are contiguous to the boundaries of
the Town of Windsor, pursuant to Section 31-12-104(1)(a), Colorado Revised Statutes, as
amended.
3. A community interest exists between the area proposed to be annexed and the Town 01
Windsor.
4. A public hearing shall be held by the Windsor Planning Commission at 7:00 p.m. on
Thursday, November 2, 2000 and by the Windsor Board of Trustees at 7:00 p.m. on Monday,
November 13, 2000 at the Windsor Town Hall, 301 Walnut Street, Windsor, Colorado.
Upon motion duly made, seconded and carried, the foregoing Resolution was adopted this 9" day of
October,2000.

ANNEXATION IMPACT REPORT
WINDSHIRE PARK ANNEXATION AND MASTER PLAN
The parcel proposed for annexation contains approximately 202.29 acres located north of
and adjacent to Weld County 68.5 and west of and adjacent to Weld County Road 15.
being more particularly described as part of Sections 7 and 18, Township 6 North, Range
67 West of the 6'h P.M., Weld County, Colorado.
1) Please see the enclosed Vicinity and Land Use Plan Maps.
2) The application materials did not include a draft or final pre-annexation agreement.
3) Municipal services will be provided as follows:
➢ Water — The applicant has indicated that the proposed development will be
served with Town of Windsor water.
➢ Sewer System — The applicant has indicated that the proposed development will
be served by Town of Windsor public sewer.
➢ Drainage Facilities — Infrastructure is to be constructed by the developer at the
developer's expense.
➢ Fire Protection—Windsor-Severance Fire Protection District
➢ Police Protection—Town of Windsor Police Department
➢ School — Windsor-Severance School District (enclosed please find an Impact
Statement from the School District)
4) Installation and financing of water infrastructure extensions shall be the responsibility
of the applicant.
5) Enclosed please find a list identifying all existing districts within the area to be
annexed.
6) Enclosed please find an Impact Statement from the Windsor-Severance School
District.
All development proposals are required to comply with the Town of Windsor
Comprehensive Plan, Zoning and Subdivision Ordinances, and any applicable Corridor
Plans.

APPLICATION SUBMITTAL CHECKLIST j
The following checklist is intended to provide an outline for applicants to ensure a complete
submittal and to avoid processing delays due to inadequate information. Land use applications
shall include all items listed in the following checklist. If an item is not checked as included in
the submittal, a detailed narrative statement outlining reasons why the item has not been
submitted shall be included. Lack of such statement or required item shall constitute an
incomplete submittal and shall be rejected by the Town. Please see the Town of Windsor
Planning Procedures Manual for complete application requirements.
SUBMITTAL REQUIREMENTS FOR ANNEXATION & MASTER PLAN APPLICATIONS (See
Article I, Section 15— Planning Procedures Manual for complete requirements):

In order to maintain efficiency and reduce Planning Department staff tin e
involved in collating applications for mailing, all copies shall be collated into
complete application packets. With the exception of utility drawings which
contain more than ten (10) sheets per set, all maps, plats and plans are tc t,e
folded and included with each individual packet.

Three (3) copies of preliminary utility plan. Such utility plan shall include size
and location of all existing utility lines and facilities and the approximate size
and location all proposed utility lines and facilities. A table with estimates of
peak hour and maximum day water and wastewater demands shall tie
included on the utility plan.

including off-site contributions; detention and retention areas; and dischanle
areas.

mailing addresses on self-adhesive labels and a copy of the most rec ent
zoning map (at a minimum scale of 1" = 400' without further reductions)
indicating all such surrounding property owners, with each property being
indexed with the list of mailing addresses.

proposed annexation and zoning
✓ For all annexations in excess of ten (10) acres, the applicant shall obtain a
statement from the applicable school district regarding the effect cf the
proposed annexation upon the school district, including an estirnale of the
number of students generated by the proposed annexation and the capital
construction required to educate such students. Thirty-five (35) copies of the
school district statement shall be included in the application materials.
Note: It shall be the responsibility of the applicant or the applicant's representative to
provide documentation to the Planning Department confirming that the site plans and
respective notices were distributed and received by the referral agencies in a timely
manner.

A parcel of land being part of the Southeast Quarter (SE1/4) of Section Seven (7), and part of the
Northeast Quarter (NE1/4) of Section Eighteen (18), all in Township Six North (T.6N.), Range
Sixty—seven West (R.67W.) of the Sixth Principal Meridian (6th P.M.), County of Weld, State of
Colorado and being more particularly described as follows:
BEGINNING at the Northeast Corner of said Section 18 and assuming the East line of said
NE1/4 to bear South 00'23'10" East with all other bearings contained herein relative thereto:
THENCE South 00'23'10" East along said East line a distance of 129.31 feet to the

ANNEXATION PETITION
We the landowner of more than 50% of the territory, excluding public streets and alleys,
described on Exhibit A, containing 206.086 acres more or less, allege the following to be true and
correct:
The perimeter of the proposed annexation has a distance of 13,031.25 l.f. of which 2,524.60 feet
are contiguous to the existing TOWN limits of the TOWN OF WINDSOR. A minimum of I/6 of
the perimeter of the proposed annexation is contiguous to the TOWN OF WINDSOR
We further allege:
1. It is desirable and necessary that said territory be annexed to the TOWN OF WINDSOR.
2. A community of interest exists between the said territory and the TOWN OF WINDSOR.
3. Said territory is urban or will be urbanized in the near future.
4. Said territory is integrated or capable of being integrated with the TOWN OF
WINDSOR.
5. No land held in identical ownership is divided into separate parcels unless the owner of
said tract has consented in writing or joins in this Petition.
6. No land held in identical ownership comprises 20 acres and together with improvements
had an assessed valuation in excess of$200,000.00 in the year preceding the filing of this
Petition.
7. No proceedings for annexation of the territory have been commenced for annexation to
another municipality.
8. The signers hereof comprise the landowners of more than 50% of the territory proposed
to be annexed exclusive of streets and alleys, and are in fact owners of 100% of the
hereinafter described property.
Therefore, the undersigned hereby request that the TOWN OF WINDSOR approve the
annexation of the area described above and do herewith pay the required fees.
In addition to the annexation, the undersigned request the zoning of RMU, SRI, SF-2 MF.-2 and
GC for the above described property.

oThis memorandum presents my findings with regard to the
relative contribution of Windshire Park generated traffic to the
• CO SH392/15th Street intersection and the WCR68B/15th Street intersection
oN in Windsor. This analysis used traffic forecasts contained in the
E m "Safeway Retail Center Traffic Study," December 1998 and the "Brunner
CSD Farms Traffic Impact Study," August 1996. The afternoon peak hour
wwas used in my analysis, since that is the only peak hour provided
in the "Safeway Retail Center Traffic Study."

w z With the land uses shown on the site plan for Windshire Park,
d 2it is expected that the trip generation will be: daily - 9050 trio
c\: ends, morning peak hour - 738 trip ends, and afternoon peak. how -

At the SH392/15th Street intersection, the sum of the highest
afternoon peak hour approach volumes from the cited studies in the
long range future (year 2018+) was 5887 vehicles. The assignment of
Windshire Park site generated traffic would add 785 afternoon peak
hour vehicles resulting in a total of 6672 vehicles at this
intersection. The portion of Windshire Park traffic at this
intersection would be approximately 12% (785/6672) .
At the WCR68‘ /l5t1 Street intersection, the sum of the afternoon
peak hour traffic from. the "Brunner Farms Traffic Impact Study" _ n
W the long range future was 366 vehicles. The assignment of Windshire
Park site generated traffic would add 825 afternoon peak hour
0 vehicles resulting in a total of 1191 vehicles at this intersection.
The portion of Windshire Park traffic at this intersection would to
w approximately 69% (825/1191) .

STATEMENT OF COMMUNITY NEED
The proposed Windshire Park is appropriate for annexation into the Town of Windsor
based on the following:
1) It is directly contiguous to existing Town limits and new development.
2) Utilities of the Town can be practically extended to serve the property.
3) Roadways can be practically extended to serve the property.
4) A non-potable irrigation water system for each lot is consistent with the goals of
the Town of Windsor.
5) A metro district management and funding mechanism is consistent with the goals
and policies of the Town of Windsor.
6) The mixed-use Master Plan, including land for commercial uses and land for
other community uses such as parkland, church sites, recreation center, and
mixed-densities of housing is consistent with the goals and policies of the Town
of Windsor.
7) Major transportation and utility linkages through and adjacent to the property are
reflective of the Windsor Comprehensive Plan.

Based on the attached letter describing the re-submission of Windshire Park to the
Town of Windsor, the RE-4 District estimates an impact of about 785 students to
the Windsor School district. As this development might support 300 or more
elementary school students, the District would like to have future discussions
regarding the most appropriate commitment from the developer regarding either a
cash-in-lieu payment or a land dedication for an elementary school site.
This decision is uncertain at this time as the District is currently discussing a land
dedication site in the Jacoby Farm that may serve these students. At this time the
District may require cash in lieu due to the proximity of the other site dedicatio_i.
However, we remain open for discussions in this regard depending on a possible
school site in Windshire. We should have further discussions in this regard as you
have more defined site planning available.

We arc re-submitting our application to onnex approximately 200 acres known as
Windshire Park to the Town of Windsor. This development proposal will consist of 884
single family lots.99 patio home lots, 60 apartment units and 7.5 acres of General
Commercial. This project is located at the northwest corner of WCR 68 1 and WCR 15,
directly north of the Jacoby annexation and New Windsor.
The Town requires a statement from the school district regarding this proposal. Would
