RE : APPROVAL OF AMENDMENT TO UTILITY PERMIT AND UNIFORM FEE
SCHEDULE FOR THE USE OF COUNTY ROAD RIGHTS OF WAY FOR
EXTRAORDINARY USE IN WELD COUNTY , COLORADO .
WHEREAS , the Board of County Commissioners of Weld County ,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering
the affairs of Weld County , Colorado , and
WHEREAS , on the 10th day of December , 1979 , the Board of
County Commissioners of Weld County , Colorado adopted a
Resolution amending the Uniform Fee Schedule for the Use of
County Road Rights of Way for Extraordinary Use in Weld County ,
Colorado , and
WHEREAS , on the 26th day of December , 1979 , the Board of
County Commissioners of Weld County , Colorado adopted a Resolution
concerning the Amended Fee Schedule Concerning Overhead Utility
Permits in County Right of Way , and
WHEREAS , the Board of County Commissioners has determined that
utility permits , inspections , and fees shall not be required for
the installation of overhead utility distribution lines in the
county right of way .
NOW , THEREFORE , BE IT RESOLVED by the Board of County
Commissioners of Weld County , Colorado that the Amended Uniform
Fee Schedule as set forth in Exhibit A and adopted on
December 10 , 1979 be and hereby is rescinded , and
BE IT FURTHER RESOLVED that the Resolution adopted on
December 26 , 1979 , Concerning Overhead Utility Permits in
County Rights of Way be and hereby is rescinded , and
BE IT FURTHER RESOLVED that the Uniform Fee Schedule for
the Use of County Road Rights of Way for Extraordinary Use
in Weld County , Colorado , as set forth in Exhibit B , attached
hereto and made a part of this Resolution , be and hereby is
adopted and shall be effective as of April 30 , 1980 and shall
continue to be in full force and effect until further order
of the Board .
The above and foregoing Resolution was , on motion duly
