Tuesday, May 16, 2000
A regular meeting of the Weld County Planning Commission was held Tuesday, May 16, 2000, in the Weld
County Public Health/Planning Building, (Room 210), 1555 N. 17th Avenue, Greeley,Colorado. The meeting
was called to order by Vice-Chairman, Cristie Nicklas, at 1:35 p.m.

approved as read.

APPLICANT: Daryl and Carol Propp (Long's Peak Estates)
PLANNER: Julie Chester
LEGAL DESCRIPTION: Part of the NW4 and part of the NE4 of Section 9, Township 1 North, Range
68 West of the 6th P.M., Weld County, Colorado.
REQUEST: Planned Unit Development Change of Zone for thirteen (13) Residential Lots and 3.3 acres
of Common Open Space.
LOCATION: South of and adjacent to WCR 12, between WCR's 5 and 7.
Julie Chester, Planner, presented Z-543 and stated that the Department of Planning Services is requesting
a continuance until July 6,2000, in order to receive information from the applicant that was requested by the
Department of Public Health and Environment, Public Works, and Colorado Geological Survey.
The Chair asked if there was anyone in the audience who wished to speak for or against this continuation.
No one wished to speak.
Stephen Mokray moved that Case Z-543 be continued until July 6,2000. Michael Miller seconded the motion.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. John
Folsom, yes; Stephan Mokray, yes; Michael Miller, yes; Bryant Gimlin, yes; Cathy Clamp, yes; Cristie
Nickles, yes. Motion carried unanimously.

Sheri Lockman, Planner, presented USR-1246 and stated that the Department of Planning Services and the
applicant are requesting a continuance until June 20,2000,as the legal notice was published with inaccurate
information. The notice will be re-published correctly in the South Weld Sun.
The Chair asked if there was anyone in the audience who wished to speak for or against this continuation.

Michael Miller moved that Case USR-1246 be continued until June 20,2000. Stephen Mokray seconded the
motion.

LEGAL DESCRIPTION: Part of the SE4 of Section 20, Township 3 North, Range 68 West of the 6th
P.M., Weld County, Colorado.
REQUEST: Site Specific Development Plan and Special Review Permit for a kennel in the Agricultural
Zone District.
LOCATION: West of and adjacent to WCR 5 and north of State Highway 66
Sheri Lockman, Planner, presented Case USR-1269 and stated that the Department of Planning Services is
recommending approval of this application. Sheri noted that Development Standard# 11 has been removed
and Development Standard # 12 has been changed to Condition of Approval #2 G.
Todd Hodges, Representative for the applicant, stated that the area is great for the kennel with all the growth
in the area and that the applicant is trying to find out who owns the ditch on the west side of the property and
discover if there is an easement for that ditch. Todd further noted that the illegal land split was done before
the applicant owned the property and that they will be working that out with the neighbors before the case is
brought before the Board of County Commissioners.
Discussion followed concerning the language of Condition of Approval # 2 E, which deals with the ditch
located on the west property line. The condition was amended to read"The applicant shall submit a copy of
an agreement with the ditch operators/owners stipulating that all concerns of the ditch have been adequately
addressed or submit evidence that reasonable accommodations have been made.".

Bryant Gimlin moved that Case USR-1269 be forwarded to the Board of County Commissioners along with
the amended Conditions of Approval and Development Standards with the Planning Commissions
recommendation of approval. Stephen Mokray seconded the motion.

CASE NUMBER: Z-542
APPLICANT: Harlan Schultz/Schultz First Subdivision
PLANNERS: Kim Ogle and Robert Anderson
LEGAL DESCRIPTION: Part of the W2 SW4 of Section 7, Township 4 North, Range 68 West of the
6th P.M., Weld County, Colorado.
REQUEST: Change of Zone for a 5-Lot Minor Subdivision.
LOCATION: East of and adjacent to WCR 1; north of and adjacent to WCR 46.
Kim Ogle, Planner, presented Case Z-542 and stated that the Department of Planning Services is
recommending approval of this application. Kim also noted that a paragraph has been added to Condition
to Approval #2 D, some grammatical corrections, and the#3 C should read "fifty" instead of"sixty".
Deanne Frederickson of Landmark Engineering, Representative for the applicant, noted that the area in the
vicinity of this application has several homes on property of this size and that the water service is provided by
Little Thompson, not North Weld, as stated in Condition of Approval # 1 B.
John Folsom asked if more than one entrance to the subdivision is required for the Fire District. Deanne
stated that the fire code only requires one access if the cul-de-sac is less than 600' in length.
Cathy Clamp asked why Berthoud is recommending denial of the application. Deanne stated that the letter
received by the Department of Planning Services is a basic letter, but that upon review of the area to be
included in the future growth area of the new Berthoud Comprehensive Plan, this area is not included.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Mary Hein, a surrounding property owner, noted that she, her husband, and a neighbor were concerned with
the application for more lots in their area. She noted that most of the neighboring property is 80 acres farms,
that WCR 1 is a dirt road, that lower-valued houses might affect the value of their property.
Farrin Stroh, a nearby property owner stated that he feels traffic may affect the county road, and that there
are already four houses on the original 80 acres owned by Mr. Schultz. Cristie Nicklas asked Don Carroll to
speak concerning a traffic impact study for this property. Don Carroll, Public Works, noted that this many lots
creates about 30 cars a day on the road and that Public Works does not generally request a traffic impact
study for a subdivision of this size.
Michael Miller asked if this property is prime farm ground. Kim stated that it is listed as Prime Irrigated land,
but that the land has not been irrigated for over 9 years. Cristie Nicklas asked about the possible trash
business or kennel on the property. Kim noted that the trash dumpsters were being temporarily stored on the
property for the applicant's son and have subsequently been moved to a business in Larimer county. Kim also
noted that the Code Compliance officer for the county saw no evidence of a kennel on the property and there
are no standing violations on the property.
Deanne Frederickson noted that the applicant's home was valued at $600,000 four years ago and that the
applicant does not want to lower the value of his property. Deanne further noted that Estate Zoned property
usually has higher value homes on it and that covenants will be drawn up at the Final Plat submittal process.
Harlan Schultz, Applicant, noted that he hurt his back years ago and it was not financially sound to hire
someone to irrigate, so he has been growing dryland hay. Michael Miller noted that a goal of the county is to
keep Prime Farmland in production.
Cathy Clamp asked if any provisions will be made to accommodate Larimer County if they need more for the
roads. Don Carroll noted that Weld Count Public Works generally works with Larimer County to find a
medium that works for both counties.

Cathy Clamp moved that Case Z-542 be forwarded to the Board of County Commissioners along with the
Conditions of Approval and Development Standards and amendments to text with the Planning Commissions
recommendation of approval. Stephen Mokray seconded the motion.
