RE: APPROVE REDUCTION AND PARTIAL RELEASE OF COLLATERAL -T.S.
SKYWAY, LLC, THE SKYWAY COMMERCIAL CENTER, SITE PLAN REVIEW,
SPR#314
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on January 7, 2000, Department of Planning Services staff did approve a
Site Review Plan, SPR#314, for T.S. Skyway, LLC, 1232 Boston Avenue, Longmont, Co orado
80501, on the following described real estate, to-wit:
Lots 2 and 3, Block 3, Vista Commercial Center,
itself a part of the Richardson Planned Unit
Development, Phase 1; a part of the S1/2 of
Section 5, and the N1/2 of Section 8, all in
Township 2 North, Range 68 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, by Resolution dated February 16, 2000, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and T.S. Skyway, LLC„ with terms and conditions being as stated in said
agreement, and did accept Irrevocable Letter of Credit#383, drawn on the First National Sank
of Longmont, 401 Main Street, P.O. Box 1159, Longmont, Colorado 80502-1159, in the amount
of$223,911.00, and
WHEREAS, based upon staff recommendations from the Departments of Public Works,
Planning Services, and County Attorney's Office, that certain improvements have been
accepted, the Board deems it advisable to reduce said collateral to $55,000.00
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Irrevocable Letter of Credit with the First National Bank of
Longmont, in the amount of$223,911.00, be, and hereby is, reduced to 55,000.00.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 6th day of December, A.D., 2000.

Subject: Partial Release of Collateral, SPR-314 Sun Construction
Date: November 28, 2000
At the request of the applicant, the Department of Planning Services is requesting a partial
release of collateral by the Board of County Commissioners. The site location is in Vista
Commercial Center, 1804, 1822 and 1840 Skyway Drive.
Sun Construction has completed landscaping, internal parking and vehicular improvemerts to
the satisfaction of the Department of Planning Services and the Department of Public Works,
with the exception of a small landscaping area and the final lift of asphalt and the pavement
striping.
Sun Construction has requested a partial release of the total collateral accepted by the Board
on February 16, 2000 ($223,911.00). The amount requested to be released is $168,911.00.
The remaining sum of $55,000.00 shall be released at the completion of the final project.

Re: T.S. Skyway Letter of Credit
Dear Commissioners:
After a site inspection by the Weld County Planning Department, it was brought to
my attention that a 1,500 to 2,000 sq. ft. area North of the 1840 Building, which
was used for staging, has not been finished landscaped yet. Therefore, please
increase the amount still to be held from our Letter of Credit of$51,000.00 to
$55,000.00 which allows $4,000.00 for three trees, 10 to 12 bushes, landscape
fabric and mulch to be placed, and 10' of concrete curb.

Re: T.S. Skyway Letter of Credit
Dear Commissioners:
Our project at 1804, 1822 and 1840 Skyway Drive in the Vista Subdivision
on Highway 119 is almost complete. The only item we have left to complete
as far as our letter of credit is concerned, is the final lift of asphalt and the
stripping, which according to the contractor-Sun Construction &Design
Services, Inc. is $51,000.00, which was scheduled three weeks ago and is
now waiting for three nice days above 50 degrees to finish the job. So, we
are requesting a partial release of the $223,911.00 letter of Credit in order to
free up money from the bank on our construction loan.
Please let us know when this can be accomplished and what else we need to
do.
