Donald French Landman DF:df Enclosure RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #2781 - DALE AND LYNN JOHNSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2781, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #2781 was submitted by Dale and Lynn Johnson, 505 Weld County Road 16.5, Longmont, Colorado 80504, for property which is located in part of the W1/2 NE1/4 of Section 30, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit"A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 33 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. B. In accordance with Weld County Department of Public Works Ordinance #180, as amended, Lot A shall be granted one residential access. If the applicant intends to use the existing oil and gas and/or ditch access as his residential access, he shall provide the Department of Planning Services with written authorization for such use from the owner of the oil and gas and/or ditch access. Lot B shall use the existing residential, agricultural, oil and gas, or ditch road access points as no additional accesses shall be granted. The access road shall be graded and drained to provide all-weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where physical obstructions are present, and shall be a minimum distance of 75 feet from any intersecting County or State roadway. C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. D. Weld County Road 16.5 is designated on the Weld County Transportation Plan Map as a paved rural road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet of right-of-way from the centerline of Weld County Road 16.5 shall be delineated on the plat. This road is maintained by Weld County. E. Weld County Road 1 is designated on the Weld County Transportation Plan Map as a arterial status road, which requires 100 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 50 feet from the centerline of Weld County Road 1 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 1. This road is maintained by Weld County. F. A 30-foot wide joint easement extending across Lot B from Weld County Road 16.5, for the benefit of Lot A, shall be clearly shown on the plat. The access easement shall be dedicated for the use as shown using the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance and shall specify whether it is dedicated, private or deeded to provide access to the parcel. G. The applicant shall attempt to address the requirements of the Mountain View Fire Protection District as stated in the referral response dated July 25, 2000. The preservation of prime farmland is one of the primary goals of the Weld County Comprehensive Plan. A. Goal 9 states "The minimum lot size of parcels in the Agricultural zone district should remain at 80 acres to encourage parcels large enough to retain viable farming operations or to accommodate modern agricultural equipment and irrigation practices." Further land division of this type through the Recorded Exemption process is expected to diminish agrarian uses of the area. C. Section 10.5 - Lot Size Standards. Section 10.5.10-A flag lot configuration shall be avoided when possible. Given the existing flag configuration of the parcel before the application further subdivision would result in the creation of an island lot with access dependent on Flag Lot A. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rura area Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads odor from animal confinement,silage,and manure;smoke from ditch burning;flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved"out of the way"of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the S:ate of Delaware) with more than 3,700 miles of state and county roads outs de of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all erneigency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners Services in rural areas, in many cases, will not be equivalent to municipal sery ces. Children are exposed to different hazards in the country than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. To the best of our knowledge, the following statements answer the questions in the recorded exemption questionnaire: 1. Water Supply. a. Domestic use. A tap request #1966 was approved by Left Hand Water for the proposed lot. See attached letter. b. Irrigation Water. Currently, we have 30 shares of Big Thompson(northern Colorado water conservancy) and 10 shares of Boulder White Rock Ditch Co. We have not removed water since purchasing the property in 1972. 2. Sewage Disposal. Sewage disposal will be available in the form of a septic system and leach field. The current property has an approved septic system. See permit # G19740378. 3. Use of Property. The property has one primary residence, originally built in the 1950's with several subsequent additions. There is a. 36' by 72' metal barn, multiple livestock sheds, a machine shed, chicken coop, hay storage shed. two irrigation ditches and on natural gas well. Approximately 28 of the 35 acres are fenced, irrigated pasture. Presently, we have 25 ewes, 5 lambs, 2 rams, 4 cows, I llama, and 3 chickens. 4. Purpose for Exemption. The principal lot will continue to be used as addressed in question 3. The secondary lot will be used as a residence for a single-family dwelling. 5. Proposed Lot. The proposed lot is approximately 1.9 acres in the NW corner of the 35 acres. It is irrigated pasture. 6. Physical Characteristics. No unique physical characteristics exist. 7. Setback Requirements. Existing structures meet setback and offset requirements, and any proposed structures will be built in accordance with the setback and offset requirements. 8. Conservation Easement. Due to the size and physical characteristics of the property. this should not apply. 9. Building Envelope. The proposed lot will not have a building envelope. 10. Weld Co. Comprehensive Plan. To the best of our knowledge, this proposal conforms to the standards of the Weld Co. Plan and should not be affected by any rnunicipal or intergovernmental agreements. 11. n:he proposed use as a single residence home and the upkeep, maintenance, and preservation of the parcel is compatible with the existing surrounding land uses. 12. The District does not object to the recorded exemption, but does have the following comments and requirements for the construction of new residences: • All construction shall be in accordance with the provisions of the Uniform Fire C;xie, as ratified by the Weld County Commissioners, and all other codes and ordinances, as enforced by Weld County. • Water supply for fire protection may be required for a new residence. In instances when a request is for a recorded exemption and not a subdivision, water supply for fire protection is not required for a single family residence that is not larger than 3,600 gross square feet and is placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet, or is placed on less than 2.5 acres, water supply for fire protection requirements apply. It appears the smaller parcel is less than 2.5 acres. • When water supply for fire protection is required, a minimum fire flow of 1,000 gallon; of water per minute, measured at a residual pressure of 20 pounds per square inch (p s.i.l, is required for one- and tv .-family dwellings net exceeding 2.609 gross square. A:i other buildings (including larger one- and two-family dwellings) require a minimum fire flow of 1,750 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.) and may require more depending on the building size and type of constructioi as per Appendix III-A of the Uniform Fire Code. Water supply must be provided by hydr wits located within 650 feet of the residence as measured along the fire apparatus access road and around the exterior of the residence. Fire apparatus roads shall be extended so fire apparatus may reach to within 150 feet of all portions of the building. Apparatus access roads shall be a minimum of 20 feet in width and be designed and maintained to support the imposed loads of fire apparatus(60,000 pounds). When residential sprinkler systems are installed, the minimum required road width is reduced to 14 feet. Roads must have a surface that provides all-weather driving capabilities. This development could impact all levels of school in the current attendance area. In addition, there are other approved developments, which would, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in this attendance area with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in otner areas becomes increasingly difficult. Therefore, the District would oppose this land use amendment because it would add to the enrollment of an already overcrowded school. Should this proposal be considered for approval, the District would request the cooperation and participation of the developer and County in working towards mitigating the impacts on the schools- This mitigation would include the calculation and payment of an appropriate cash in-lieu of land dedication fee to address the capacity concerns and the need for future school sites (per the attached chart).
