Re: Notice of Claim, Pursuant to C.R.S.24-10-109, et seq.
Dear Sir/Madam:
(1) The following is a notice of claim which is hereby served upon you pursuant to C.R.S. 24-
10-109, et. seq.

(b)The claim of Larry J. Lee is based upon the negligence of the Weld County Sheriff's
Department, Investigating Sheriff Alan Price, Weld County Police Department and the Weld
County District Attorney's Office to properly investigate the identity of the Defendant in Case
Number 2000 CR 788, Weld County District Court, State of Colorado. The arrest warrant was
issued for Larry Dale Lee on June 27, 2000, but the Weld County Sheriff arrested Larry Jonathan
Lee. When Larry Jonathan Lee turned himself in to the Sheriff's Department for arrest, he stated
on many occasions that he was Larry Jonathan Lee, not Larry Dale Lee. The Weld County
Sheriff's Department ignored those statements and consequently bond was posted at $ 25,000.00,
based upon the criminal record of Larry Dale Lee.
The claimant, Larry Jonathan Lee was unable to post that bond and remained in the Weld
County Jail. On July 14, 2000,the Court reduced the bond for Larry Jonathan Lee to $10,000.00,

based upon the determination by the Weld County Sheriff's Department, the testimony of
Investigator Alan Price and the representations of the Weld County District Attorney's Office
that the Defendant (Larry Jonathan Lee) in Case Number 2000 CR 788, Weld County District
Court, State of Colorado, was actually Larry Jonathan Lee and not Larry Dale Lee. At that time
Larry Jonathan Lee was able to post bond and was finally released from custody from the Weld
County Jail. Larry Jonathan Lee was unable to post bond and obtain a release from the Weld
County Jail at the time of his arrest solely because the Weld County Sheriff's Department,
Investigator Al Price and the Weld County District Attorney's Office could not determine the
actual identity of the person whom they had arrested.
During his preliminary Court appearances, Larry Jonathan Lee repeatedly informed the Weld
County Sheriff's Department officers, the Weld County Police Department, the Weld County
District Attorney and the Weld County District Court that he was not Larry Dale Lee, but Larry
Jonathan Lee. Judge Hale, of the Weld County District Court, chose to ignore Larry Jonathan
Lee's and his attorney's requests for a reduced bond solely because of the inability of the above
named entities and individuals to ascertain the true identity of the person in custody regarding
Case Number 2000 CR 788, Weld County District Court, State of Colorado. The Claimant is
claiming false arrest, false imprisonment and malicious prosecution.

The Claimant was unlawfully detained on a defective warrant, which was issued for the arrest of
a person who was not the Claimant. The Claimant was detained in the Weld County Jail for over
fifteen days, solely because the Weld County Sheriffs Department, the Weld County District
Court and the Weld County District Attorney's Office insisted that Larry Jonathan Lee was Larry
Dale Lee, without any attempt to conduct a proper and immediate investigation of the Claimant's
true identity. As a result of the failure of the above named entities and individuals to

act in a timely fashion, the Claimant lost his home because of his inability to pay the mortgage,
was forced to relocate his family temporarily to Washington state and was forced to move from
his neighborhood because of the inability to make the lot payments while he was incarcerated.
The Claimant also suffered public humiliation in Weld County and Boulder County because of
the statements and articles published about the Claimant.
(e) The amount of monetary damages requested is $350,000.00.
