Planning staff did not feel they could make a recommendation to the Weld County Planning Commission without the following information. 1. A Storm Drainage Design and Technical Criteria Regulations, as found in Section 10.13 of the Weld County Subdivision Ordinance was not provided with this application. Please refer to page 15 of the PUD Procedural Guide for further information regarding this requirement. 2. The requirements, as outlined on the attached letter from the State Division of Water Resources needs to be met. 3. An Improvements Agreement describing the proposed road improvements and method of guaranteeing installation of the improvements in conformance with the Weld County Policy on Collateral for Improvements was not submitted. Please refer to page 15 of the PUD Procedural Guide for further information regarding this requirement. In addition, this requirement was conveyed on page 6 of the Sketch Plan comments dated September 9, 1999 from the Department of Planning Services. Please submit the above information prior to 4 p.m. Friday, April 7. If you are unable to meet this deadline, Planning Staff will not have sufficient time to finalize the case and have no choice but to ask for a continuance at the Planning Commission hearing scheduled for April 18, 2000. The proposed water source is Left Hand Water District, however, a letter of commitment for service has not been submitted. As required in Section 30-28-136(1)(h)(II), C.R.S., a municipality or quasi- municipality, upon receiving the preliminary plan designating said municipality or quasi- municipality as the source of water for a proposed subdivision, shall file, with the board of County Commissioners and the State Engineer, a statement documenting the amount of water which can be supplied by said municipality or quasi-municipality to proposed subdivision without causing injury to existing water rights. A report of this nature has not been submitted to this office. The "Water Supply Information Summary" form which was provided to the county along with the State Engineer's August 7, 1995 letter was not included with this submittal. As stated in the State Engineer's letter, this form is required to be submitted along with each subdivision referral in order for our office to respond to the county. Based upon the above and pursuant to Section 30-28-136(1)(h)(II), it is our opinion that the District has not submitted sufficient evidence documenting that the proposed water supply can be provided without causing injury to existing water rights. This project falls primarily under the purview of the Weld County Mixed Use Development Area (MUD) Planned Unit Development Sketch Plan Standards. Our requirements are as follows: 1. WCR 5.5: The MUD Structural Transportation Network Map 2.2 identifies this roadway as a two-lane collector. This review was based on equivalent two-lane roads with painted median. There is currently 100 feet of right-of-way at this location. 2. Road Improvements Agreement: The developer shall be required to enter into a Road Improvements Agreement to construct the remaining one half of WCR 5.5 as per Figure 2.10. 3. Internal Roads: All internal roads shall conform to the MUD Local Street Standards. All cul-de-sac rights-of-way shall have a minimum radius of 65 feet with a paved radius of 50 feet from edge of pavement to edge of pavement. A. Weld County will assign road numbers if the developer chooses not to name the internal streets. B. All lots will access from an internal road system with no direct access to WCR 5.5. 4. Storm Water Drainage: A statement describing how the applicant intends to handle the storm water drainage was not included. 5. Access: A. The applicant is indicating a private lake access to a small parking area adjacent to the park. This access point shall be a minimum of 24 feet wide to accommodate two-way traffic. A locked gate shall be at the property line to allow vehicles to pull off WCR 5.5. B. A proposed Weld County Library access shall line up directly across from Meadow Vale Farms main access. This access and improvements to this site shall be addressed at a site plan review process. C. The main access to the PUD shall be incorporated into the WCR 5.5 widening to match asphalt grades, curb, gutter, and sidewalk. 6. WCR 5.5 Cross Section: A typical cross section shall be modified to reflect Figure 2.10, collector/two-lane road with painted median. The applicant shall construct one half of the typical cross section of the road adjacent to the proposed PUD to include additional asphalt, curb, gutter, and sidewalk. A. Survey plat sheet 2 of 5 should be changed to reflect the realignment of WCR 5.5 to State Highway 119. B. In Item V of the Development Project Narrative, sheet 3 of 5, verify WCR 5.5 as being-t or 100 feet of right-of-way on all plats. In the local definition include curb, gutter, and four feet of concrete attached sidewalk on each side. C. The applicant is indicating that WCR 5.5 has already been improved to collector status along the project frontage. Dear Ms. Torrey: The drainage study for the aforementioned application was reviewed by Weld County Department of Public Works. Public Works staff did not feel they could make a recommendation to the Weld County Planning Commission. Please ask your engineering consultants to contact Diane Houghtaling at the Department of Public Works to address the following isues: 1. The submitted Drainage Report was not inclusive of the entire site. The northern portion of the site was not included. 2. The submitted Drainage Report did not consider drainage coming from off-site sources. 3. The submitted Drainage Report did not discuss the amount of water that will be diverted to a detention site. In addition, the detention site was not placed. 4. The submitted Drainage Report did not discuss how the"Flood Plain" classification and the high water table of the entire site will influence storm water drainage. 5. The storm sewer maintenance and placement was not addressed for the northern Civic Site. In addition, the storm sewer maintenance on the eastern residential lots was not addressed. 6. The slope of 1:3 behind lot 2 on the eastern side is severe. The slope of 1:6 on lots 3 - 8 on the eastern side is also severe. It is important to note that a Traffic Impact Analysis for this Phase II of Meadow Vale will be required prior the final plan submittal for this development. It is the determination of Weld County Public Works and Planning Services that more time is required to review additional information regarding the Storm Water Drainage Plan, and shall therefore request that this case be continued. We were informed by our client,Mr.Floyd Oliver,on April 3',that County Planning required a drainage plan and report for this project prior to April 7th or it would not be on the Planning Commission's April 18th agenda. BHA Design had indicated on their Change of Zone plat (submitted to the County on January 19, 2000)that natural drainage patterns would be preserved and that the existing pond would collect stormwater runoff. Our drainage plan 8c report for Meadow Vale II did not incorporate the northern portion (Parcel B) of the PUD site because the type and extent of development in this area is not known at this time. A storm sewer,which serves The Elms at Meadow Vale,has recently been approved by the County's Public Works staff which crosses this Parcel and directs stormwater runoff into the adjacent wetlands. Currently,stormwater generated from this site will be historic and flow southeast onto property owned by the applicant. At this stage in the planning 8c design process,the only conceptually defined development is the fourteen lot subdivision and its associated streets. The stormwater runoff presently generated from Meadow Vale Subdivision is diverted around this proposed subdivision by drainage channels constructed along the west side of W.C.R. 5-1/2. The Preliminary Drainage Report we submitted to the County on April 7th stunmatized both the five-year and 100-year runoff generated by the proposed subdivision and indicated that runoff will flow undetained into the existing pond adjacent to the development. According to the Flood Insurance Rate Map for this area (Community Panel Number 080266 0850 C,map revised: September 28, 1982),the St. Vrain Creek floodplain extends to the eastern edge of W.C.R. 5-1/2. We anticipate during the final design of this subdivision that the grading plan will identify the finished floors of proposed homes so they are at least one foot above the level of the 100-year base flood. Much of the area where this subdivision is being proposed has already been raised higher than adjacent W.C.R. 5-1/2 when the topsoil from the gravel mining operation was relocated. We anticipate that a drainage easement will be provided on the final PUD plat for the storm sewer and drainage swale proposed in Meadow Vale II for maintenance by the County. We are not proposing overlot grading steeper than 3:1 for the subdivision,nor do we believe that a 3:1 slope is severe. The receipt of Ms.Johnson's letter regarding our drainage plan and report has me confused on two issues. First, I don't understand why if the January 19,2000 Change of Zone submittal by BHA Design was incomplete (i.e. drainage plan not provided)that it took until April 7`"to identify this concern to the applicant when he had been advised that he would be on the Planning Commission's April 18`1 agenda. Secondly,why does the County require (other than it is outlined in Section 6.3.2.2.1.7. of Ordinance 197) a detailed engineering drainage study at the Change of Zone step? It would appear that a conceptual drainage plan would be more appropriate at this level of the design process. We do not feel that any drainage issue raised by your letter could not be addressed during the preparation of the PUD Final Plan and we certainly do not agree that this project should be continued to a future Planning Commission hearing because of the concerns raised. II Dear Ms Best Johnson At the time I submitted Meadow Vale Farm Phase II for change of zone I did not know that Weld County was planning on building a services support building in the Del Camino area East of 1-25. I have since learned that Weld County plans to build a one million dollar building on property they already own East of I-25. This changes my thinking with respect to Parcel B a 1.7 acre site at the North part of the site. Parcel B is shown on our submittal as potential civic use, IE fire station, police/sheriff, recreation center. I would like to expand the definition of"civic uses"to include day care centers, professional offices, branch post offices, community church or other community services building. I am not requesting retail sales building of any kind of commercial/industrial buildings. I do not have a specific use in mind nor do I have any potential sales of the site, so I expect the site will remain open for quite some time. I hope this request is not to open ended for you.
