RE, APPROVE EASEMENT FOR STORM SEWER ADJACENT TO WELD COUNTY
ROAD 5.5 FOR MEADOW VALE FARM PLANNED UNIT DEVELOPMENT, SECOND
FILING, AND AUTHORIZE CHAIR TO SIGN - KATHERINE OLIVER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Easement for a storm sewer
adjacent to Weld County Road 5.5 for Meadow Vale Farm Planned Unit Development, Second
Filing, between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and Katherine
Oliver, 2385 Homestead Place, Longmont, Colorado 80540-0260, with terms and conditions
being as stated in said easement, for property being more fully described in Exhibits A and B
attached hereto and incorporated herein by reference, and
WHEREAS, after review, the Board deems it advisable to approve said easement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Easement for a storm sewer adjacent to Weld County
Road 5.5 for Meadow Vale Farm Planned Unit Development, Second Filing, between the
County of Weld, State of Colorado, by and through the Board of County Commissioners o+`
Weld County, on behalf of the Department of Public Works, and Katherine Oliver be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 31st day of May, A.D., 2000.

3eq., THIS EASEMENT, granted this 45--day of 200(1 , between
Katharine H. Oliver, wh se legal address is 2385
Homestead Place, Longmont, Colorado 80540-0260 of the County of Weld, State of Colorado,
the Grantor, and Weld County, a Body Corporate and Politic, whose legal address is 1015 1O It
Street, Greeley, Colorado 8063lof the County of Weld and State of Colorado, the Grantee.
WITNESSETH, that the Grantor, for and in consideration of the sum of Ten dollar,,
paid to the Grantor by the Grantee, the receipt and sufficiency of which is hereby acknowledged,
does hereby grant, bargain, sell, and convey to the Grantee an easement for the purposes of a
Storm Sewer Easement over and across the following described parcel of real property situate in
the County of Weld and State of Colorado to wit:
See EXHIBIT "A" and EXHIBIT "B" attached hereto and made a part hereon.
This Easement is for the benefit of and appurtenant to that land, or any part thereof,
situate in the County of Weld and State of Colorado.
This Easement shall expire upon the happening of the following event, or at the time set
forth below, whichever is earlier:
Vacation of said easement by the aforesaid Grantee.
The Grantee agrees to repair and maintain the easement granted herein at the cost and
expense of the Grantee, and that said Grantee will in no way hinder or prevent the proper and
reasonable use and enjoyment of the property through which the easement is granted.

PROPERTY DESCRIPTION
20' Easement
A strip of land Twenty feet(20') in width and being part of the Southwest Quarter (SW 1/4) of
Section Four (4), Township Two North (T.2N.), Range Sixty-eight West(R.68W.) of the Sixth
Principal Meridian (6th P.M.), County of Weld, State of Colorado the center line of which is
inure particularly described as follows:
BEGINNING at the Center Quarter Corner of said Section 4 and assuming the North line of said
SW 1/4 as bearing South 89°21'48" West a distance of 2656.29 feet with all other bearings
contained herein relative thereto:
THENCE South 89°21'48" West along said North line a distance of 238.74 feet to the Northeast
Corner of Meadow Vale Farm PUD Second Filing (MVFPUD2F) as recorded May 12, 1997 m
Book 1605 as Reception Number 2547525 of the records of the Weld County Clerk and
Recorder. Said point also being on the Easterly ROW line of Weld County Road #5.5
(WCR#5.5);
TIIENCE South 00°21'25" West along the East line of said MVFPUD2F, also being the Easterly
HOW line of said WCR#5.5 a distance of 94.17 feet to the TRUE POINT OF BEGINNING of
said center line description:
THENCE South 37°44'57" East along said center line a distance of 297.98 feet to the
TERMINUS POINT of said center line description.
Said described parcel of land contains 5,960 Square Feet, more or less (±) and is subject to any
rights-of-way or other easements as granted or reserved by instruments of record or as now
existing on said described parcel of land.
It is the intent of this description that the sidelines of said easement be prolonged or shortened to
intersect the East line of said MVFPUD2F, also being the Easterly ROW line of said WCR#5.5,
and that the end line of said easement at the Terminus Point is to be perpendicular to the
described center line at that point.
