BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION
RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Stephen Mokray that the following resolution be introduced for passage by the Weld County
Planning Commission. Be it resolved by the Weld County Planning Commission that the application for:

LEGAL DESCRIPTION: SE4 of the SE4 of Section 18, T3N, R66W of the 6th P.M., Weld County,
Colorado
LOCATION: North of and adjacent to WCR 32, Approximately 1/2 mile east of State Highway 85
be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 25.7 of the
Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section
25.8 of the Weld County Zoning Ordinance, as follows:
a. Section 25.8.1 -- Reasonable efforts have been made to avoid irrigated cropland or to
minimize the impacts on such lands in those cases where avoidance is impractical. The
applicant is proposing to mount 12 antennas, 3 sectors of 4 antenna each, to the top
perimeter of the existing water tank as well as construct a 12'x 22'equipment building. The
proposed telecommunications facility is not located in an area designated as prime farm
ground.
b. Section 25.8.2 --The facility will not have an undue adverse effect on existing and future
development of the surrounding area as set forth in applicable MASTER PLANS. The
facility does lie within the urban growth boundary area of the Town of Platteville. The Town
has reviewed this request and finds it consistent with the Towns Comprehensive Plan. The
surrounding land uses include agricultural production to the north, cemetery to the south
and east and residential properties and the Town of Platteville to the west.
c. Section 25.8.3 -- The design of the proposed facility mitigates negative impacts on the
surrounding area to the greatest extent feasible. The proposed facility will be compatible
with surrounding land uses. There are currently antennas located on the water tower. The
addition of four sectors will have a negligible impact on surrounding properties.
d. Section 25.8.4--The site shall be maintained in such a manner so as to control soil erosion,
dust, and the growth of noxious weeds. The conditions of approval and development
standards will assure that there is no fugitive dust or erosion and will ensure the control of
noxious weeds.

e. Section 25.8.5--The applicant has agreed to implement any reasonable measures deemed
necessary by the Planning Commission to insure that the health, safety,and welfare of the
inhabitants of Weld County will be protected and to mitigate or minimize any potential
adverse impacts from the proposed facility. The applicant agrees to implement any
reasonable measures deemed necessary by the Planning Commission to ensure that the
health, safety, and welfare of the inhabitants of Weld County will be protected and to
mitigate or minimize any potential adverse impacts from the proposed use. The Conditions
of Approval and Development Standards ensure protection of the inhabitants of Weld
County.
f. Section 25.8.6--The proposed facility will be supplied by an adequate water supply which
has been evaluated with reference to the impacts of the use of such supply on agricultural
uses. All reasonable steps have been taken by the applicant to minimize negative impacts
on agricultural uses and lands. The proposal will not require additional water demands on
the site. The proposed location of the telecommunications facility will be unmanned and
will not require water or sewage disposal. The Conditions of Approval and Development
Standards minimize negative impacts on the existing agricultural uses and lands of the
area.
g. Section 25.8.7 -- All reasonable alternatives to the proposal have been adequately
assessed and the proposed action is consistent with the best interests of the people of
Weld County and represents a balanced use of resources in the affected area. The
proposed location of the facility has been adequately assessed by the applicant as well as
by the referral agencies and Weld County Department of Planning Services.
h. Section 25.8.8 -- It has been determined that the nature and location or expansion of the
facility will not create an expansion of the demand for government services beyond the
reasonable capacity of an impacted community or the county to provide such services.
Where it is indicated that such an expansion of the demand for services will occur beyond
the reasonable capacity to provide such services,the applicant must clearly show how such
impacts will be mitigated prior to approval of the proposal by the County. This criteria is not
applicable for this proposed use.
Section 25.8.9 -- It has been determined that the nature and location or expansion
of the facility will meet Colorado Department of Health and Weld County air quality
standards. The Conditions of Approval and Development Standards will ensure that
the nature and location of the facility will meet Colorado Department of Health and
Weld County air quality standards.
j. Section 25.8.10--Adequate electric,gas,telephone,water,sewage,and other utilities exist
or can be developed to service the site. Adequate utilities exist to service the site.
k. Section 25.8.11 --The nature and location or expansion of the facility will not unreasonably
interfere with any significant wildlife habitat and will not unreasonably affect any
endangered wildlife species, unique natural resource, historic landmark or archaeological
site within the affected area. The location and type of proposed use to the existing facility
will not have an unreasonable impact on the above items.
Section 25.8.12--The applicant's engineer has certified that the drainage plans developed
for, and to be implemented on the site, will prevent surface drainage from leaving the site

which would exceed historic runoff flows. The proposed facility will not change the existing
drainage of the site. The Weld County Public Works Department has reviewed the plans
and finds no conflicts.
m. Section 25.8.13 -- Where a proposed power plant is to be located in an area where
a sufficient housing supply is unavailable for the anticipated immigrant construction
force, the applicant for the location of such a facility shall present plans showing how
housing will be provided for such workers without creating major negative impacts
on existing residents in the impacted communities. This criteria is not applicable for this
proposed use.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
This application has been determined to be in compliance with the proposed Amendment 24 to the Colorado
Constitution of a new article XXVIII, as development of land is consistent with a valid development
application which had been filed as of September 13, 2000 pursuant to proposed Article XXVIII 9 (2).
The Planning Commission's approval is conditional upon the following:
1. The attached Development Standards for the Special Review Permit shall be adopted and placed
on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the
Department of Planning Services and be ready for recording in the Weld County Clerk and
Recorder's Office within (60) days of approval by the Planning Commission. (Dept. of Planning

2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder. (Dept. of Planning Services)
3. Prior to recording the plat:
A. The applicant shall complete and have approved the 7460-1 Notice of Construction or
Alteration form if required by the Federal Aviation Administration. A copy of the approved
7460-1 shall be submitted to the Department of Planning Services. (FAA)
B. The applicant shall apply for and receive approval of a Subdivision Exemption (SE-)for a
Major Facility of a Public Utility to create the parcel the applicant intends to lease. (Dept.

C. The applicant shall address the requirements of the Weld County Department of Public
Works, including but not limited to, the width of the access road. Written documentation
shall be provided to Weld County Department of Planning Services indicating access

1. The Site Specific Development Plan and Special Review permit is for a Major Facility of a Public
Utility for a Telecommunications facility in the A (Agricultural) Zone District as submitted in the
application materials on file in the Department of Planning Services and subject to the Development
Standards stated hereon. (Dept. of Planning Services)
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County
Zoning Ordinance. (Dept. of Planning Services)
3. All construction on the property shall be in accordance with the requirements of the Weld County
Building Code Ordinance. (Dept. of Building Inspection)
4. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-
100, C.R.S., as amended)shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination. (Dept. of Public Health and Environment)
5. No permanent disposal of wastes shall be permitted at this site. (Dept. of Public Health and
Environment)
6. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust,

Department of Planning Services shall be granted access onto the property at any reasonable time
in order to ensure the activities carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
14. The Special Review are shall be limited to the plans shown hereon and governed by the foregoing
Standards and all applicable Weld County Regulations. Major changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the
permit by the Weld County Planning Commission before such changes from the plans or
Development Standards are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
15. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the permit by the Board of County Commissioners.

Lauren noted that the antennas will be placed on an existing water tower with existing antennas.
Cathy Clamp asked if the antennas would be larger than the existing antennas. Lauren noted the applicant
would be able to answer that.
Fred Walker asked why Development Standard#8 allowed industrial noise levels. Sheble McConnellogue,
Department of Public Health and Environment, noted that the past USR's for the same application have all
had this Development Standard. Sheble noted that this is usually for construction purposes.
Herb Quintana, Representative for Nextel Communications, noted that the antennae would be similar to the
existing antennae on the water tower.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
Herb Quintana noted that they are in agreement with the Development Standards and Conditions of Approval.
Stephen Mokray moved to approve Case USR-1290 with the Conditions of Approval and Development
Standards, noting that the application was in compliance with the proposed Amendment 24. Michael Miller
seconded the motion.

recommendation of approval into the record. Sheri noted that the City of Greeley asked for denial of this
application, but the City of Greeley is not part of an IGA with Weld County. The applicant will be required to
attempt to address the concerns of the city.

take place in Room 210, Weld County Planning Department, 1555 N. 17th Avenue, Greeley, Colorado. It is
recommended that you and/or a representative be in attendance to answer any questions the Planning
Commission members may have.
It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the
property or if the property is located within the comprehensive planning area of a town or municipality.
Therefore, our office has forwarded a copy of the submitted materials to the Platteville Planning Commission

1. The proposed use of the property will be a telecommunications facility located on an existing water tank.
2. The Weld County Comprehensive Plan intends to anticipate the appropriate future land uses. This proposal
is consistent with anticipating future uses of the residents of Weld County.
3. The Weld County Zoning Ordinance section 31.4.12 allows the proposed use and is therefore consistent with
the Zoning Ordinance.
4. The surrounding land uses are: cemetery,residential and agricultural.
5a. The number of people who will use this site are innumerable as wireless communication growth and usage
is virtually exploding.
5b. No employees will be employed at this site.
5c. This site will operate 24 hours a day.
5d. One 12'x22' structure will be erected on this site to house the BTS equipment necessary to
run the telecommunications facility. The structure will be constructed of materials to match
existing buildings onsite.
5e. No animals will be housed at this site.
51 One service technician willaccess the site approximately once a month for preventative maintenance. The
vehicle used will likely be a standard pickup truck,but will always be less
than 10,000 GVWR.
5g. The Town of Platteville will provide fire protection for this site.

5j. No storage or warehousing is proposed.
6. There is no proposed landscaping.
7. When the Use by Special Review activity terminates,Nextel will be responsible for removing its' equipment

9. Construction is scheduled to begin within one year of receiving Weld County approval and is expected to
have a 3 month duration.

Dear Ms. Daniels-Mika;
Please accept this letter as a request for an interpretation of the above referenced section of
the Weld County Ordinance as it relates to the following facts:
Nextel Communications has leased a portion of the property located at 12837 Weld County
Road for installation of wireless telecommunications facilities. The subject property is developed as a
cemetery and is zoned "A". Within the cemetery there is a 48.6' water tower with US West Wireless
antennas attached at the top. Nextel is proposing to locate its antennas at the top of the water tower
also.
A Planner in your office has advised that to do so would require a Use by Special Review.
However upon reading your code, it is my interpretation that the proposed antenna location is a use
by right. The Ordinance reads "One(1)microwave, radio,television, or other communication
transmission or relay tower seventy (70) feet in height or less in height per lot..."leaving open the
possibility for more than one communications provider to occupy the same tower.
Additionally, Section 31.4.12 seems to indicate that Use by Special Review would only be
appropriate if we were proposing more than one tower on the lot, or if the tower was greater than 70'
in height. Nextel is not proposing to construct an additional tower on this lot or to increase the height
of the existing structure,but rather to use the existing structure on which to mount our antennas.

The Weld County Public Works Department has reviewed this proposal. This project falls under the purview of
the Weld County Use by Special Review Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 32 is designed on the Weld County Transportation Plan Map as a collector status road, which requires an
80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County.
The applicant indicated that the site will be unmanned. A service technician will visit the site at least once per
month.
REQUIREMENTS:
The applicant shall submit adequate documentation to the Weld County Public Works Department on the use of
the 15-foot dirt road existing access through the middle of the Platteville Cemetery to access the site.
Typically a 20-foot wide access is required for all fire and emergency facilities. Please verify with the Platteville
Fire Protection District that the 15-foot wide access is adequate for emergency purposes.
The approach to the site from the cemetery road shall be a graded and drained surface to provide an all-weather
access to the facility.
Storm Water Drainage: The new 12' x 28' equipment shed will be placed on a granular compacted surface,
which will allow for adequate drainage on site. No storm water drainage will be required.

Environmental Health Services has reviewed this proposal for a Telecommunications Facility. Our
Department recommends approval. The following conditions are recommended to be part of any approval:
I. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone
as delineated in 25-12-103 C.R.S., as amended.
6. The facility shall utilize potable toilets for the employees during construction of the project.
7. The facility shall utilize bottled water for drinking during construction of the project.
