HomeMy WebLinkAbout20001058.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MAY 8, 2000 TAPE #2000-13 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, May 8, 2000, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad - EXCUSED Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Hall moved to approve the minutes of the Board of County Commissioners meeting of May 3,2000,as printed. Commissioner Geile seconded the motion,and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Baxter moved to approve the Certification of Hearings conducted on May 3, 2000, as follows: 1)A Site Specific Development Plan and Use by Special Review Permit #1260, Jimmie and Sharon Wolfrum. Commissioner Hall seconded the motion, which carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Hall moved to approve the consent agenda as printed. Commissioner Geile seconded the motion, and it carried unanimously. PUBLIC INPUT: There was no public input. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $756,083.68 Commissioner Geile moved to approve the warrants as presented by Mr. Warden. Commissioner Hall seconded the motion, which carried unanimously. 2000-1058 BC0016 NEW BUSINESS: CONSIDER UNIVERSAL HIRING PROGRAM ADDITIONAL OFFICER REQUEST FORM AND AUTHORIZE CHAIR TO SIGN: Mr. Warden stated this is a grant application for funding of the Community Oriented Policing Services (COPS) Program. Chair Kirkmeyer clarified this is only the application and the budget has not yet been adjusted for additional funding. Commissioner Baxter moved to approve said request form and authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON TWO RIVERS PARKWAY, PHASE III,AT VARIOUS INTERSECTIONS: Frank Hempen, Jr., Director of Public Works,stated this is a request to place"Stop"signs at various intersections on Two Rivers Parkway. In response to Commissioner Geile, Mr. Hempen stated traffic on Two Rivers Parkway will be stopped at Weld County Road 54, it will not be a four-way stop. He further stated traffic counts will be conducted to help determine traffic flow and whether traffic control adjustments are necessary. Commissioner Hall moved to approve said installation of traffic control devices on Two Rivers Parkway. Commissioner Baxter seconded the motion, which carried unanimously. CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES AND AUTHORIZE CHAIR TO SIGN - MERRICK AND COMPANY: Mr. Warden stated this agreement will allow GIS maps to be linked into the Weld County web site for public access. He further stated this will also be linked into Assessor and Treasurer records so when a parcel is clicked on, the address, property ownership, and tax information will be displayed. He stated the project will cost approximately$36,273.00 which has been included in the budget for this year. Commissioner Hall moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Baxter, the motion carried unanimously. PLANNING: CONSIDER REQUEST TO PRE-ADVERTISE USE BY SPECIAL REVIEW PERMIT #1270 - NORTH AMERICAN RESOURCES COMPANY, C/O WILLIAM CREWS: Sheri Lockman, Department of Planning Services, stated the applicant has submitted a letter requesting Use by Special Review Permit#1270 be pre-advertised to expedite the process. In response to Chair Kirkmeyer, Ms. Lockman explained the applicant wants to speed up the process and begin renovation of the site to return it to the gas compressor operation. Commissioner Hall stated the applicant was upset about being required to go through the amendment process when it is planning on reducing the existing permit. Commissioner Baxter commented this should not be a matter of conflict with the public because the permit area is being reduced. In response to Chair Kirkmeyer, Bruce Barker,County Attorney, reviewed the pre-advertisernent process and stated the Board needs to make its decision based on the reasons given by the applicant. Chair Kirkmeyer clarified the applicant is not present. Commissioner Baxter moved to approve said request of North American Resources Company, c/o William Crews, to pre-advertise Use by Special Review Permit#1270, and set the hearing date for June 21, 2000, at 10:00 a.m. The motion, which was seconded by Commissioner Hall,carried unanimously. Chair Kirkmeyer commented future applicants should be advised to include a reason for the pre-advertisement in their request. CONSIDER RECORDED EXEMPTION #2669 - YONGGE VUE: Chair Kirkmeyer advised Yongge Vue, applicant, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes to pass, or in the case of a tie vote, Commissioner Vaad will listen to the record and make the determining vote. Mr. Vue indicated he would like to proceed today. Ms. Lockman gave a brief description of the location of the site. She stated the Department of Planning Services staff has concerns because the applicant has not shown compliance with the Weld County Subdivision Ordinance or the Comprehensive Plan. Ms. Lockman indicated Mr. Vue purchased a 151-acre farm consisting of two legal parcels. On October 12, 1998, the I3oard of Commissioners approved Recorded Exemption#2300 located north of the Bull Canal. She stated Minutes, May 8, 2000 2000-1058 Page 2 BC0016 if this request is approved the applicant will own four lots in the A (Agricultural) Zone District which do not meet the 80-acre minimum lot size as determined by the Zoning Ordinance. She further stated no consideration has been given to preserve agricultural land. Ms. Lockman stated Lot A of Recorded Exemption#2300 was created for the applicant's brother-in-law; however,since that time, no structure has been built. Ms. Lockman stated three referral agencies submitted comments which have been addressed by the proposed Conditions of Approval and four agencies did not respond. In response to Commissioner Baxter, Ms. Lockman explained that Lot A of the Recorded Exemption #2300 has been sold back to Mr. Vue and no improvements have been made. Responding to Chair Kirkmeyer, Ms. Lockman stated access to the lots of the previous Recorded Exemption is from Weld County Road 13. Mr.Vue stated he is requesting this Recorded Exemption to create a 10-acre parcel south of the Bull Canal to sell to his other brother-in-law. In response to Commissioner Baxter, Mr. Vue stated he plans to continue farming the remainder of the land. He stated the land is leased to the previous owner to farm. Mr. Vue stated small equipment will be used to farm the small parcels, but the larger parcels will be leased and farmed with large equipment. In response to Commissioner Geile, Ms. Lockman stated two lots were approved through Recorded Exemption #2300 and the applicant is now requesting two additional lots be created through Recorded Exemption #2669 which will total four buildable lots in this quarter section. Responding to Commissioner Hall, Mr. Vue stated the area south of the canal is 33 acres in size. He explained the previous request was a joint request with one of his brothers-in-law and this request will create a lot for the other brother-in-law. Chair Kirkmeyer clarified Mr. Vue currently owns both lots north of the Bull Canal and one lot south of the canal. Commissioner Baxter commented there are already three legal lots so there should be no need to split the southern parcel. Shoua Vue, co-applicant, explained she has two brothers; one went through the Recorded Exemption process with them last year, and now they are requesting to split off a ten-acre parcel for her other brother because he does not want to own the entire southern parcel. In response to Commissioner Geile, Ms. Lockman stated there is no right-of-way through the property. She further stated Recorded Exemption #2300 is adjacent to the City limits for the City of Dacono which expressed no concerns. Chair Kirkmeyer commented there is a race track and composting facility in the immediate area. No public testimony was offered concerning this matter. In response to Commissioner Baxter, Ms. Lockman reiterated staff feels this application does not comply with Sections 11.4.2.1 and 11.4.2.6 of the Weld County Subdivision Ordinance. Commissioner Hall moved to deny Recorded Exemption #2669 for Yongge Vue based on the concerns expressed by the Department of Planning Services staff. Seconded by Commissioner Geile, the motion carried unanimously. Commissioner Baxter commented he understands why the applicant is requesting this change; however, it conflicts with Weld County planning standards. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
