HomeMy WebLinkAbout20001125.tiff From: "David Siple" <DSIPLE@patinaoil.com> To: <charding@co.weld.co.us> Date: 3/28/00 2:15pm Subject: Docket# 2000-14 Dear Ladies and Gentlemen: With respect to the referenced public hearing for the Site Specific Development Plan and Amended Special Review Permit#897 for a sand and gravel mining operation and asphalt batch plants, please be advised that Patina Oil & Gas Corporation ("Patina") is the owner of the oil and gas estate under the lands to be impacted by this project. Patina is very concerned about the impact the mining operation with have on Patina's ability to develop, produce, operate and maintain oil and gas wells on the lands. Patina has not waived any rights it has to access the existing wells or the oil and gas under the lands. As previously stated in a letter dated December 7, 1999, Patina has the right to drill additional oil and gas wells on the lands pursuant to existing Colorado Oil and Gas Commission well location rules. Patina requests assurance from CAMAS Colorado, Inc. that the proposed mining operation will not block access or preclude Patina from drilling, producing, operating and maintaining oil and gas wells on the lands. No agreement has been reached with CAMAS Colorado, Inc. Therefore, until this matter is resolved by agreement with CAMAS Colorado, Inc., Patina is not waiving its rights as a leasehold owner. Any approval of the mining operation should be conditioned upon the preservation of Patina's real property rights that allow it to make a reasonable use of the surface of the lands for oil and gas development. Once again, Patina requests that these comments be entered into the record for this matter.
