City of Brighton Ordinance No. 1630 approving the Conoco Annexation
Dear Sir/Madam:
I recently became aware of an annexation into the City of Brighton of one of Weld County's liquor licensees_
specifically the Conoco above-referenced. I immediately contacted the manager of this store, Eloisa Castro, to
inquire if the store offered for sale alcoholic beverages. She informed me that it held a 3.2% Beer, Off-Premise_
Liquor License(#40-14732-0002), issued through Weld County. I could not find any statute, regulation lr code that
governed this type of situation, so I telephoned the State Liquor Enforcement Division, and was instructed Mal
Conoco would be required to file an application for a new liquor license through the City of Brighton.
At that time, I contacted Assistant City Attorney Christopher Ernst to determine a course of action and wh_iher ni
not the Conoco #06355 should be allowed to continue to sell fermented malt beverages until a new luluot license
was approved through City Council, acting as the Local Licensing Authority (noting that the City did not issue
Temporary Permits). However, when he contacted Matt Cook, State Licensing Administrator. hew is irtbrmed
that the licensee would be permitted to continue to sell 3.2% beer with certain conditions (see attached later_ I v.ill
also notify Conoco that they must submit an application for a new liquor license at least 120 days Drier to the
expiration of their current license. which is November 8, 2000.
Pursuant to the City Attorney's instructions, I am therefore requesting that Weld County transfer its tiquoi license
file to the City of Brighton.
