RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE
A public hearing was conducted on February 8, 2000, at 10:00 a.m., with the following present:
Commissioner Dale K. Hall, Chair
Commissioner Barbara J. Kirkmeyer, Pro-Tem
Commissioner George E. Baxter
Commissioner M. J. Geile
Commissioner Glenn Vaad

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld
County Zoning Ordinance. Cases were heard as follows:
VI #9900280 - MILLER: Victoria Brown, Department of Planning Services, presented the case
report for the record and stated the property is in violation of the Weld County Zoning Ordinance.
Ms. Brown played a video of the property. Responding to the Commissioners Hall and Geile, Ms.
Brown said four (4) horses are allowed per acre with a total of 32 horses allowed on this property.
Ms. Brown further stated derelict vehicles are still present on the property.
Richard Miller, property owner, was present at the hearing. Mr. Miller stated he has been
considering several solutions for bringing the property into compliance but has not applied for a
Use By Special Review Permit(USR). Responding to Commissioner Hall, Mr. Miller said he will put
fencing in place by this weekend to screen the derelict vehicles. Mr. Miller further stated he would
like to sell 10 horses but did not know how long this would take. Chair Kirkmeyer instructed Mr.
Miller of his options.
Commissioner Hall moved to refer VI#9900280 against Richard and Margaret Miller to the County
Attorney for legal action, with the instruction to delay action upon such referral until
April 10, 2000, to allow adequate time for the property owners to bring the subject property into
compliance. The motion was seconded by Commissioner Geile, and it carried unanimously.

VI #9900378 - RABEN: Ms. Brown presented the case report for the record and stated the
property is in violation of the Weld County Zoning Ordinance. Responding to several
Commissioners, Ms. Brown clarified the number of animal units allowed in the R-1 Zoning District.
Galen and Nancy Raben, property owners, were not present or represented at the hearing. Tracy
Dougherty, neighbor, stated the Raben's bring in horses from time to time for breeding or training
which are kept on the property, and also have rabbits living in their home. Monica Mika-Daniels,
Department of Planning Services, clarified the Zoning Ordinance regarding training/breeding
animals in the R-1 Zoning District.
Commissioner Hall moved to refer VI # 9900378 against Galen and Nancy Raben to the County
Attorney for legal action, with the instruction to delay action upon such referral until March 9, 2000,
to allow adequate time for the property owners to bring the subject property into compliance. The
motion was seconded by Commissioner Geile, and it carried unanimously.
VI #9900251 - CURTIS: Ms. Brown presented the case report for the record and stated the
property is in violation of the Weld County Zoning Ordinance. Ms. Brown showed the video of the
property. Responding to several questions regarding contacts made with the property owner, and
who is the current property owner, Ms. Brown could not clarify either point.
Mr. Curtis, property owner, was not present or represented at the hearing.
Commissioner Geile moved to continue VI # 9900251 against Gary Curtis to March 14, 2000, at
10:00 a.m., to allow adequate time for Department of Planning staff to confirm the details of said
violation. The motion was seconded by Commissioner Hall, and it carried unanimously.
VI #9900348 - ROSEMAN: Ms. Brown presented the case report for the record and stated the
property is in violation of the Weld County Zoning Ordinance. Ms. Brown stated the property
owners have been before the Board of Commissioners previously for the same violation. Julie
Chester, Department of Planning Services, confirmed the previous violations. Ms. Brown showed
the video of said property.
Mr. and Mrs. Roseman, property owners, were not present or represented at the hearing.
Commissioner Hall moved to refer VI # 9900348 against Dale and Elizabeth Roseman to the
County Attorney for immediate legal action. The motion was seconded by Commissioner Geile,
and it carried unanimously.
