A public hearing was conducted on May 24, 2000, at 10:00 a.m., with the following present

The following business was transacted:
I hereby certify that pursuant to a notice dated May 8, 2000, and duly published May 11, 2000, in
the South Weld Sun, a public hearing was conducted to consider the request of James and Kristie
Docheff/Diamond D Dairy,for a Site Specific Development Plan and Use by Special Review Permit
#1262 for an Agricultural Service Establishment for a Livestock Confinement Operation (dairy)and
Animal Feeding Operation for 800 head of cattle in the A(Agricultural)Zone District. Lee Morrison,
Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning
Services, presented a brief summary of the proposal and entered the favorable recommendation
of the Planning Commission into the record as written. He stated the proposal would allow a
maximum of 800 head of cattle and it is an expansion of an existing use. He stated the sign was
posted on May 11, 2000, and 11 referral agencies commented on the proposal. Mr. Gathman
stated approval of the Use by Special Review would provide greater regulations since the dairy
does not currently function under Use by Special Review guidelines. Mr. Gathman also indicated
no letters have been received from surrounding property owners, and the site is within the three-
mile Urban Growth Boundary area of Mead; however, no response was received from Mead. Mr.
Gathman presented a memo indicating a proposed change to Condition of Approval#2.G, marked
Exhibit F.
Responding to questions from the Board, Mr. Gathman clarified the property boundaries and the
Use by Special Review boundaries and stated the Landscape and Screening Plan being requested
is to screen the existing double wide trailer because of its proximity to the cattle pens.
Commissioner Vaad questioned the accuracy of the map being used, and Mr. Morrison stated
Mead did also use portions of the interstate to annex property. Don Carroll, Department of Public
Works,stated he has recently received an annexation plan from Mead including Weld County Road

32 the way through the Harper property directly east of this facility. Chair Kirkmeyer clarified it is
in the process, not completed. Responding to Commissioners Vaad and Hall, Mr. Gathman stated
he has had no conversation with Mead;and explained the applicant will have to submit a screening
plan, since the trailer is in such close proximity to the cattle pens with nothing to separate it from
the dairy, even though employees of the dairy do live in it.
Responding to Commissioner Geile,Trevor Jiricek, Department of Public Health and Environment,
stated he did observe the site, reviewed the Service Water Plan and Waste Water Disposal Plan,
and he feels there is enough property to handle land application, although there are some runoff
problems,the Plan will address them. Mr Jiricek further stated the applicants were storing manure
in one location which had runoff going towards the center of the property; however, the Plan now
addresses that area. Mr. Jiricek clarified for Commissioner Geile that the CAFO regulations apply
even if there is only one cow, although there is a breaking point at 1,000 animal units; therefore,
with a dairy the breaking point is 1.4. He also stated with CAFO you have to consider all the
animals on the property, not just the ones being milked. Chair Kirkmeyer requested Develcpment
Standard #13 be amended to be consistent with the other dairy which was approved recently.
Jim Docheff, Jr. stated he, his wife, and three children live on the dairy and are the fourth
generation milking cows in Colorado. He sais he purchased this property in 1987 and started with
50 cows, growing progressively since then. He reviewed the numerous updates made on the
property, including free stall barns, and composting area, and indicated he is presently milking 600
cows, with the total being about 670 cows. Mr. Docheff stated the baby bull calves are sold
immediately; heifers are moved to Severance until two years of age, and the dry cows are f oused
in the pen to the north, as well as the pasture area along Weld County Road 32. Mr. Docheff said
he has installed automatic scrape systems so manure is scraped in barns and into a pit, and he
currently sells compost locally. He said he usually pumps the lagoons three or four times per year,
although he did plow it this year; and indicated the lagoons have worked well in the past but do
need to be increased. Mr. Docheff said the trailer is where his herdsman lives, and since part of
his job is to watch the herd, he would rather not screen the trailer from the pens. Responding to
Commissioner Geile, Mr. Docheff confirmed the trailer is on his property, which totals 77 acres.
Responding to Commissioner Hall, Mr. Docheff stated he was not planning on landscapinc much
since the neighbor has asked him not to block her view of the mountains by planting trees. He
stated the cow numbers are now at capacity, and he probably will not increase them.
Responding to Commissioner Vaad, Mr. Docheff stated there is a slew through the south dart of
the property, with two culverts, although none of the waste from the dairy is running off, sirce the
lagoons are all contained. Mr. Docheff further stated there was concern about runoff from the
composting area, although there has not been much in the past 13 years. Commissioner Vaad
emphasized the importance of getting the berm below the composting area done quickly, and
stated he observed runoff last week with only a one-half inch rain. Mr. Docheff stated there is
some irrigation runoff and the slew drains the property above him. Responding to Commissioner
Baxter, Mr. Docheff stated the berm is seven or eight feet above the level of water, and he will
pump the lagoons within the next month. Commissioner Geile indicated that the Use by Right
allows four cows per acre, which is approximately 308 cows, and the application requests 800.
With 675 cows currently being milked, he is currently out of compliance. Mr. Docheff agreed.
Responding to Chair Kirkmeyer, Mr. Docheff stated there are two pieces of property which are
contiguous; however only the front piece will be attached to the Use by Special Review.

Responding to Commissioner Baxter, Mr. Docheff stated he has not talked to the Saint Vrain Valley
School District, although his wife volunteers there two days per week and he does support the
district with cash donations at time, therefore, he can meet the stipulation requested, although he
thinks it is only a form letter response.
No public testimony was offered concerning this matter.
Mr. Gathman stated Conditions of Approval #2.G and #2.J can be deleted, since they were
originally included because it looked like the trailer was on another property. Mr. Docheff
reiterated the neighbor is concerned trees will block her view of the mountains. Mr. Jiricek read
the language approved at the last Use by Special Review Hearing, and Chair Kirkmeyer verified
the applicant understands and agrees with the Conditions of Approval and Development Standards
as modified.
Commissioner Hall moved to approve the request of James and Kristie Docheff/Diamond D Dairy
for a Site Specific Development Plan and Use by Special Review Permit#1262 for an Agricultural
Service Establishment for a Livestock Confinement Operation (dairy) and Animal Feeding
Operation for 800 head of cattle in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record, with the deletion of Condition of
Approval #2.G and #2.J, and Development Standard #13 changed to be consistent with that
approved in the last Use by Special Review. The motion was seconded by Commissioner Vaad
and carried unanimously.
This Certification was approved on the 31st day of May, 2000.
