The Resolution adopted by the Town Board for such purpose is in words, letters, and figures as follows: RESOLUTION NO. 00-3 BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF EATON: 1. That annexation proceedings be initiated upon a Petition for Annexation of the following described territory to the Town of Eaton, which Petition appears to be in substantial compliance with the applicable provisions of Chapter 31, Article 12, Colorado Revised Statutes. Description of territory proposed for annexation: Schmunk Annexation: Approximately 154 acres east of town with East 10th Street (W.C.R. 76) on the north boundary, Weld County Road 39 on the east boundary and East Fifth Street (W.C.R. 74'/) on the south boundary. 2. Therefore, 7 o'clock p.m on June 15, 2000 is hereby established as the time, and the Town Hall at 223 First Street in Eaton, Colorado as the place, for a public hearing to be held before the Town Board to determine if the proposed annexation complies with Sections 31-12-104 and 31- 12-105, C.R.S. or such parts thereof as may be required to establish eligibility under Part 1 of Chapter 31, Article 12 of said statutes. Bagley, To C rk 5=+ f IMPACT REPORT SCHMUNK ANNEXATION The property proposed for annexation into the Town of Eaton is located south of the Hawkstone Development and north of the Eaton Commons Development. This parcel extends from East 5th Street (WCR 74 1/2)to WCR 76, and from WCR 39 to the centerline of Section 31. The perimeter of this parcel is not less than 1/6 contiguous with the Town of Eaton, Colorado. The total acreage of this property is 157.564 acres. (Plus or minus) This report is provided as per state statute and contains information on the impact the proposed annexation and development may have on the current infrastructure of the Town of Eaton. WATER The town buys treated water from the North Weld County Water District through two master meters. Our contract includes a maximum flow of 2 million gallons of water per day or a total of 730 million gallons per year. In 1999 the town purchased 161 million gallons or 22% of capacity. Peak flows are currently at 79%of capacity. As current projects such as Hawkstone, Eaton Commons, and Haythom are built both average flow and peak flow will reach capacity which will require a new contract with North Weld and additional water storage projects to serve the Schmunk Annexation as it begins to fill. As with all annexations, raw water rights will have to be dedicated to the town in sufficient quantities to serve this new area. Parks and open space can be irrigated with well water. SEWER The Town of Eaton Sewage Treatment Plant is designed and has been permitteI by the Colorado Department of Health for the following loads: 1) Flow into the plant= 340,000 gallons per day 2) BOD5 (A measure of oxygen demand to break down solids) = 887 pounds per day based on a 30-day average. We are currently at 60%of capacity on flow into the plant and 66%of BOD5 capacity. As Hawkstone, Eaton Commons and Governor's Ranch continue to add taps. these current rates will approach the 85% level when we need to plan for expansion. Haythorn, Governor's Ranch and Schmunk will eventually add enough flow to necessitate the expansion of the plant. All tap fees on new buildings are placed in a Sewer Construction Fund, which has a current balance of$313,000. Current development tap fees will increase this fund to over $770,000 (without interest) and Schmunk will also add enough to finance a good size expansion to the existing plant. The Schmunk Annexation will drain to the west where the existing main built to scrve Hawkstone is located. A capacity study on this main should be completed and a separate arrangement with Hawkstone, LLC, should be completed before any development agreement is done. STORM DRAINAGE By ordinance the developer will be required to submit a drainage plan which will include the location and size of storm sewer lines and detention ponds. The storm sewer discharge will be into the Eaton Draw. Once these improvements are completed and approved,they become the responsibility of the town to maintain. STREETS The town currently maintains 18.0 miles of streets. The Schmunk Annexation would include the north half of WCR 74 1/2 from East Eaton East to WCR 39, as well a s the streets that would be built within the subdivision. WCR 39 would continue to be outside the town limits. The Highway Users Tax Fund money, which the town receives from the stage, is based on street mileage maintained along with other factors. As this mileage increases so too does the tax fund revenue. SCHOOLS Enrollment in the Eaton School District has been very stable over the last 4 -- 5 years. Total capacity for all grades is 1,500 students with 1,338 students enrolled for the 1998-99 year or 89.2%of capacity. The district average yield is .67 student per dwelling unit, so the Schmunk Annexation could generate 280 new students once it is completed. Combined with Haythorn, Eaton Commons, and Governor's Ranch, the School District will need to increase their capacity by adding to existing facilities or building new ones or a combination of the two. A site within the Schmunk property may make a good location for a school facility. The Town and School District recently signed an agreement, which provides for a fee on each residential building permit to be forwarded to the school for land acquisition. This fee is reviewed annually and is currently $681 per dwelling unit. Gary A. (Plus or minus) Legal Description Legal description of this parcel is as follows: The NE 1/4 of Section 31, T.7N, R.65 of the 6th P.M., Weld County, Colorado. Location The Schmunk Property is located solely within Weld County and within the Urban Growth boundaries set forth by The Town of Eaton. Water This proposed annexation is in North Weld County Water District. Library District This property is located in the Weld Library District. Schools The school district that will service this proposed annexation will be Eaton School District RE-2. Fire Protection District Eaton Fire Protection District will be responsible for this annexation. Water Conservancy District This property lies in the Northern Colorado Water Conservancy District Community College District The Schmunk property is in the Aims Community College District. Urbanization of Property The urbanization of the Schmunk Property is targeted to be a mostly residential addition to the Town of Eaton. Included in this proposed annexation is a proposed school district property/ community park site with ball fields (soccer and baseball), single family housing, multi-family housing and senior multi- family units. There is also a small commercial site that would be well suited for a Medical Clinic and Doctor's offices. We will also continue the trail system that is proposed for Eaton Draw and existing in Hawkstone. This property is an "in- fill" which makes it a logical next-step for the Town of Eaton. The water and development will be in accordance with the Town of Eaton ordinances and the annexation agreement. It would be desirable if 5th Street is improved from WCR 39 to Highway 85. PU zoning The PU zoning on this parcel is a proposed school district property/community park site complete with two soccer fields and two baseball diamonds. This parcel is nestled in a residential setting away from busy streets. It also features plenty of parking for children's sporting events and access to the proposed trail system in the Eaton Draw. If the school district or the Town of Eaton does not choose to acquire this site, it will become residential lots in all areas except the flood plain. C-1. zoning The C-1 zoning for this property is ideal for a residential commercial need. Due to its proximity to the senior housing it would lend itself nicely to becoming a medical clinic and doctors offices.
