Dear Commissioners:
Subject: Lawsuit With Respect to National Hog Farms, Inc.
We received your letter on March 7, 2000 concerning the lawsuit filed in District Court by the Colorado Department
of Public Health and Environment("Department"),Air Pollution Control Division("Division") against National Hog
Farms, Inc. ("National"). We realize that we failed to appropriately contact you prior to filing the lawsuit and
apologize for our unintended slight and any inconvenience our error has caused the Board. As we told Trevor
Jiricek of the Weld County Health Department in February,we will redouble our efforts to ensure that in the future
we will notify you in advance of any other significant actions that we may take concerning facilities located in Weld
County.
I understand that National Hog is very important to Weld County's economy. The Department is sensitive to that
fact and we are willing to work with National to help them come into compliance with the law. I appreciate the
Board's offer to assist us in reaching a settlement in this case. If there are settlement discussions with National,I
would be interested in talking with the Board as to how those discussions can occur in a fashion that would be most
productive.
