Dear Ms. Chester: The Town of Windsor Planning Commission reviewed this request at its regular meeting of February 16, 2000 and determined that the proposal is consistent with the Town's Land Use Plan map depiction as the subject property is delineated as Very Low Density Single Family Residential. However, the property is located outside the Town's Growth Management Area (GMA), as well as being located outside the Urban Growth Boundary area as recognized by Weld County. The Town of Windsor Comprehensive Plan states 'The GMA is intended to define those specific areas within the planning area where it is most logical to extend urban services in the near term, that is, within the next five to ten years." The Plan further discourages annexation of areas outside of the Town's GMA boundary. Therefore, since the property is located outside the Town's GMA boundary and urban services will not likely be available to the property in the near term, annexation is not recommended at this time. Therefore, the Planning Commission recommends approval of the PUD Change of Zone, subject to the condition outlined below: 1. LOCATION: East of and adjacent to State Highway 257;bisected by Weld County Road 76 extended LAND USE PLAN DEPICTION: Very Low Density Single Family Residential RECOMMENDATION: Staff recommends that the Planning Commission forward a recommendation of conditional approval of the PUD Change of Zone to the Weld County Department of Planning Services DISCUSSION: The applicants, represented by Mr. Stanley K. of Everitt Enterprises, Inc., are requesting approval of a Planned Unit Development Change of Zone in order to subdivide approximately 390 acres into one hundred fourteen (114) estate zoned lots which would be served by individual sewage disposal systems. The total acreage of 420 acres indicated on the Change of Zone application form is inconsistent with the 382.75 acres shown on the plat. It should be noted that the minimum lot size of 1.75 acres indicated in the Sketch Plan application has been reduced to 1.5 acres in the current application materials. The internal road system shall include adequate right-of-way and pavement widths and thicknesses per the Town of Windsor standards so that adequate infrastructure exists in the event that the subdivision is annexed to the Town of Windsor in the future. 2. Per Section 16-205 of the Town of Windsor Municipal Code, all lots within the subdivision containing individual sewage disposal systems shall contain a minimum lot size of two and one-half(2'/z)acres. 3. Our comments and requirements are as follows: COMMENTS: I have contacted Gloria Idler at CDOT and this plan seems to incorporate their concerns. We do not encourage Local/Arterial connections for new subdivision. After a phone conversation with the Stanley Everitt, I have agreed that only the east 150 feet of Mountain Meadow Drive and Cullison Ridge Road need to be upgraded to collector status. Based on the traffic projections the 60 feet of storage will be acceptable for left and right turning vehicles, however, the right turn taper should be increased to 90 feet. This project lies within the Windsor Service Area Road Impact Fee boundary. At this time, I am unaware of any credits that can be applied to these fees. A final drainage report shall be required prior to recording the plat. Health Department VP/ COLORADO CASE NO.: Z-537 NAME: George Nelson Farms/Soaring Eagle Ranch The Weld County Health Department has reviewed this proposal. The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will be provided by the North Weld County Water District and sewer will be provided by septic systems. The proposed lot sizes (minimum of 1.75 acres) and the overall density of septic systems per acreage (1 per 3.42 acres) complies with Ordinance No. 197 and our Departmental policy. The environmental impact plan provided in the application materials and required in section 6.3.1 of the PUD Ordinance appears to address all potential impacts described in the Ordinance. Based upon the most recent groundwater monitoring provided by the applicant, the hydrology and the geology of the site is not ideal for septic systems. Groundwater was observed in pieziometers P-1, P- 4, P-6, P-8, P-9, and P-10 within 3 feet of existing grade. From previous reports, bedrock was observed from 3 to greater than 15 feet across the site. However, it does appear that conventional septic systems can be installed on a portion of the lots. On those lots that a conventional system cannot be installed an engineer must design a system that complies with County and State Regulations. Our primary concerns are with groundwater conditions and shallow bedrock. Due to the proximity of Windsor Reservoir, groundwater levels beneath the lots can fluctuate seasonally. There are several surface water ponds on the site that may also affect groundwater conditions. The Department is recommending that groundwater conditions be monitored through at least September to determine maximum season high groundwater. The Weld County Individual Sewage Disposal Regulations require that systems be designed around maximum season high groundwater. Horizontal setbacks to surface water must also be met. It appears that the septic envelopes for Lot 6, Block 4, and Lots 1 & 2, Block 5 may not meet the minimum 200 foot setback. As you are aware, in a memo concerning this sketch plan dated October 12, 1999 we requested four items of information be provided so that a thorough recommendation could be made on the proposed project. Only one of those items was submitted for review. Therefore, we will withhold our formal recommendation and referral until the above information has been provided and reviewed by our staff. In addition, the source of water supply is to be the North Weld County Water District, however a letter of commitment was not included in submitted materials.
