RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DONALD AND JACQUELINE GARDNER FOR VIOLATION
OF THE WELD COUNTY BUILDING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Donald and Jacqueline Gardner, VI #0000284, are allegedly in violation of
the Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of November, 2000, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Donald and Jacqueline Gardner were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until December 12, 2000, to allow adequate time for the property
owners to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000284 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Donald and Jacqueline Gardner to remedy the violation
of the Weld County Building Code Ordinance, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until
December 12, 2000, to allow adequate time for the property owners to bring the subject
property into compliance.

The property located at 18737 WCR 44 remains in violation of the Weld County Building Code Ordinance. Your
property is in violation of Section 83 of the Weld County Building Ordinance. I have scheduled a meeting with the
Board of County Commissioners on November 14, 2000 at 10:00 a.m.,to consider the violations occurring on the
property. This meeting will take place in the County Commissioners' Hearing Room, first floor, Weld County
Centennial Center,915 Tenth Street, Greeley, Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Board of Commissioners might have concerning this violation. This hearing
would give you an opportunity to explain all issues regarding this violation. By making contact with me prior to this
hearing to acknowledge your willingness to comply with this matter,we will not proceed with the hearing. If no
contact is made, we will proceed with the hearing.
The Department of Planning Services'staff will be recommending the Board of County Commissioners authorize the
County Attorney to proceed with legal action to remedy the violation if you and/or a representative are not available.
Our records indicate that you were made aware of the nature of this violation, the action necessary to correct the

The building official has determined that the property located at 18737 WCR44 is in violation of Section
83 of the Weld County Building Ordinance, which requires all inspections to be inspected within 180
days from the date of issue or within 180 days from the last approved inspection. A final approval must
be completed within 180 days after the permit is issued. At this time, we kindly ask that you call in for
the final inspections if the work is completed on the 540sf deck on existing house.
It is not necessary for you to contact me personally to schedule the inspection(s) when ready. Our 24
hour inspection request line number is 356-8016 or 1-800-234-2534 if the phone number is long distance.
If you call before 4:00 P. M., you may schedule the inspection(s) for the next working day. Please make
reference to your name, building permit number and the inspection(s) desired. Inspections needed are
Setbacks, Footing/Caissons &Final Approval.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter. If you fail to correct this violation by September 30, 2000,
it will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action.

Dear Bank of New York Co-Trustee:
I am writing this letter in reference to building permit BC-9700391 that was issued to Dolald&
Jacquiline Gardner for a 540 sq ft deck on the existing house. Our records indicate that there has not
been any work activity within the last 180 days since the last inspection. A site inspection was
previously conducted and it appeared that the construction on the deck was not started and that the home
itself did not meet code requirements for the steps and landing. This is to inform you that all permits
issued by the building official under the provisions of Section 83 of the Building Code Ordinance, are
required to have regular inspections conducted within 180 days of issue. This building permit has
exceeded the time period allowed and if not completed in a timely manner, a violation will be issued for
this permit, in which it may be scheduled for a hearing with the Board of County Commissioners, and if
necessary, referred to the County Attorney's Office to proceed with legal action. We encourage you to
complete all necessary inspections or contact our office with a status of completion on your building
permit before July 27, 2000 to avoid receiving a violation. We also ask that you please call us regarding
any difficulties you may encounter with completing all necessary inspections.
