I am writing this letter in regard to the Idaho Creek Gravel Company and their use of Road 5 South of their pit.
I understand their permit states they must use Road 5 North to Road 18, which is why it was paved. The dust
created by normal traffic on the dirt roads south of their pit is bad enough, and these gravel trucks, including their
own make it much worse. Having a livestock operation here,including cow/calf and horses, the dust creates
respitory problems for the animals which must be pastured near the road. For over a year, I have been trying to
find out why these trucks are allowed to use this road when they have a mining permit requiring them not to. I
have talked to ten people from Weld County, all promising to look into it, only to be passed on to someone else on
a follow up call. Although this is a semi-rural area near the corner of the county, it is still a part of Weld County.

COLORADO Subject: Inspection Report for Probable. ai"ise ZCH-007. in regard to USR-1 194
The property was inspected to ensure compliance with the Site Specific Development Plan and Special
Review Permit for a Sand & Gravel Mining Operation in the Agricultural Zone District (USR-1194). The
property owners are William and Margaret Kobobel. The following Conditions of Approval and Development
Standards are not in compliance or have not been met:
Conditions of Approval:
1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the
Special Review Plat prior to recording the plat. The completed plat shall be delivered to the Department of
Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days
of approval by the Board of County Commissioners.
3. Prior to recording the plat:
B. The applicant shall enter into a Road Maintenance Improvements Agreement with the Weld County
Public Works Department for upgrading and paving Weld County Road 20.5 due to heavy hauling.
A designated haul route will be established within the Improvements Agreement.
C. The applicant shall submit a Dust Abatement Plan to the Weld County Health Department for review
and approval. The facility shall have sufficient equipment available to implement the dust control as
required by the Weld County Health Department. Evidence of Health Department approval shall be
submitted to the Department of Planning Services.
D. The applicant shall submit evidence that an Air Pollution Emission Notice (APEN) and Emissions
Permit have been obtained from the Air Pollution Control Division, Colorado Department of Health
for emissions of criteria, hazardous or odorous air pollutants: Sources of such emissions include but
are not limited to the following: sandblasting operations. mining,spray paint booths, dry cleaners, haul
road traffic, composting, boiler and incinerators.
E. The applicant shall submit evidence that an NPDES permit has been obtained from the Water Quality
Control Division of the Colorado Department of Health for any proposed discharge into state
waterways.
4. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the
property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and
Recorder.
Development Standards:
1. The Site Specific Development Plan and Special Use Permit #1194 is for a Sand and Gravel Mining

Department of Planning Services and subject to the Development Standards stated hereon.
15. The applicant shall attempt to comply with all requirements of the Fire District.

16. The applicant shall maintain compliance with Section 44, Open-Mining, of the Weld County Zoning
Ordinance.
17. The property owner or operator shall be responsible for complying with the Design Standards of Section
24.5 of the Weld County Zoning Ordinance, as amended.
18. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24.6 of the Weld County Zoning Ordinance, as amended.
20. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
21. The property owner or operator shall post a sign indicating"Right Turn Only" and a sign indicating the
designated haul route.
22. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.
The property was inspected on Friday, April 28, 2000 by the Department of Planning Services. Removal of
materials is taking place on the property and the trucks from the site are not conforming with the designated
haul route. None of the above conditions have been met and the plat has not been recorded.
