RE: APPROVAL OF RECORDED EXEMPTION NO. 548 - DAVID TRIMBER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 548 , being the property of David
Trimber, described as part of the Wi of the NWa of Section 2 ,
T5N, R64W of the 6th P.M. , Weld County, Colorado, being more
particularly described in Exhibit "A" , attached hereto and in-
corporated herein by reference, does not come within the purview
of the definition of the terms, "subdivision" and "subdivided
land" , pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the hereinabove described parcel of land owned
by David Trimber be, and hereby is, exempt from the definition
of the terms, "subdivision" and "subdivided land" .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 19th day of
May, A.D. , 1982 .

Re: A recorded exemption on part of the W2 NW4 of Section 2, T5N, R64W
Dear Commissioners:
The attached application, plat and related items are in reference
to a request from Mr. David Trimber for a recorded exemption. The parcel
of land on which this request is being made is described as part of the
W of the NW1 of Section 2, T5N, R64W of the 6th P.M. , Weld County, Colorado.
The property is located three and one-half (31/2) miles northeast of
Kersey at the intersection of County roads 57 and 62. The property
contains approximately forty (40) acres of Class He, IVe and IVs irrigated
and IVe, VIe non-irrigated soils.
The request is to divide the property into parcels of thirty-five (35)
acres and five (5) acres, more or less. The applicant has a buyer for the
property who is interested in the (35) acres for hay production; but has
no need for the improvements which exist on the proposed (5) acre parcel.
The applicant also has a buyer who is interested in the home on the five
acre parcel.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with section 9-2C of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with section 9-2E of the Subdivision
Regulations as follows :
- The forty (40) acres, more or less, under consideration will
allow agricultural and related uses to be the predominant uses.
The uses will be compatible with existing surrounding agricultural
uses. These facts support the proposal as being consistent with
the intent clause of the agricultural zone district.

- The proposal is in compliance with section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive plan;
therefore, the proposed use is not inconsistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum size requirements for land
division.
- The North Weld County Water District can service this proposal.
- The proposed lots are not part of a recorded exemption within
the last five years.
- The two lots proposed will have adequate access from County
road 57 and County road 62.
- The Weld County Health Department has indicated in a letter
dated April 28, 1982 that both lots have adequate sewage
capacity.

Recently, a 40 acre irrigated parcel of land came ap for
sale directly adjacent to o; 16 acres at 297?? WCR 57.
Unfortunately, there is a home on the N.W . corner of the
property of which we have no desire to own.
We run a cow/calf operation from our current property.
but have to rent. Yrass and stalks through out most of
the year. Our 16 acres is only large enough to calve
the cows out i.n the spring. This irrigated ground adjacent
to us would be used for hay production, and a portion
would be converted to Irrigated pasture for .summer grazing.
With your help in granting a recorded exemption to the
house and 5 acres which could be sold to Doug and Peggy
Hoff. We could purchase the remaining 35 acres to help
expand our cow/calf operation.
Our intentions are strictly .agriculturally oriented and
this land is so handy being across the road from our property.
Improvements would be limited to fencing, corrals, and a
stock waterer.
An additional factor we are looking at, by purchasing the
35 acres is that we are getting all the irrigation water
and running rights which we could use on both pieces of
property.
If there are any other questions which we could answer
for you which I have not covered or this letter costae. s
