Home My WebLink About20001493.tiff RESOLUTION RE: APPROVE QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF TRANSPORTATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Quit Claim Deed between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the Colorado Department of Transportation, 4201 E. Arkansas, Denver, Colorado 80222, with terms and conditions being as stated in said Quit Claim Deed on the following described real estate, to-wit: All of the south 37.5 feet of the Western Hills Subdivision, being a right-of-way designated as "Access Road" and dedicated as such on the plat recorded on September 23, 1963, at Book 10, Page 29, File No. 823, in the Office of the Weld County Clerk and Recorder; and all of the South 60.0 feet of Lot A and Lot B of Recorded Exemption Number 260, being designated as "60.0' dedicated ROW " as dedicated as such on the plat recorded on July 10, 1979, at Book 874, Reception Number 1996276, in the Office of the Weld County Clerk and Recorder WHEREAS, after review, the Board deems it advisable to approve said Quit Claim Deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners cf Weld County, Colorado, that the Quit Claim Deed between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the Colorado Department of Transportation be, and hereby is, approved. Barker igeDATE: June 8, 2000 COLORADO SUBJECT: Quit Claim Deed to CDOT You may recall that last year an issue came up regarding a right-of-way located on the nor h si le of West 10`h Street, immediately to the west of 59`h Avenue. The right-of-way is from an old r obi i vi sic r and an old recorded exemption. Copies of plats showing the right-of-way are attached. The right-oi=waY was used last year by a church for the purpose of erecting a fireworks tent. The reason w}n we became aware of the right-of-way was that the operator of the fireworks tent needed to obtain the e nse ut of nci' land owner(the Board of County Commissioners)prior to and during the sale of the fireworks the recuirement was by the Union Colony Fire Authority. The right-of-way has no use to Weld County. It is, however, of value to the Colorado Departn ent of Transportation. In September, 1999, and later in the fall,I had conversations with Mr. Bob (ir the of CDOT. Bob checked with his superiors at CDOT and the determination was made that CD( 'E would appreciate having the Board of County Commissioners convey by Quit Claim Deed the rig 11-e! \Amu/ such that the additional space could be used for acceleration lanes coming off of 59"1 Avem te. Attached is a Quit Claim Deed for that purpose. I have asked Bob to review it and he has r o o )uectlons to any of the language or description contained therein,.
