R n„ bA G1146 iSo. - OWAASN BY DFW'PAW N0 G1146.RE1 Weld County Planning Di A0G 16 2000 RESOLUTION RECEIVED RE: APPROVAL OF AMENDED RECORDED EXEMPTION #1837 - CHARLES AUSTIN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1837, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Amended Recorded Exemption #1837 was submitted by Charles Austin, 35475 Weld County Road 43, Eaton, Colorado 80615, for property which is located in part of the SE1/4 of Section 4, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 4.4 acres and 3.25 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Amended Recorded Exemption #1837 by Charles Austin is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Prior to recording the plat: A. Amended Lot B shall utilize the existing access from Weld County Road 72, which shall be clearly shown on the plat. The plat shall show a 30 foot wide access easement across the western edge of Lot A for access to Lot B. The access easement shall be dedicated for the use as shown, utilizing the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. B. The minimum width of a flag lot shall be 30 feet. C. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the flood plain, as delineated on Federal Emergency Management Agency (F.E.M.A.) Community Panel Map 080266 0489 C, dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Section 26 of the Weld County Zoning Ordinance. 4) The installation of any septic system within the 100-Year Flood Plain shall comply with the Weld County I.S.D.S. Flood Plain Policy. In accordance with the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the floodway. 5) Prior to the release of building permits the applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. 6) The text of the Right to Farm Covenant as stated on Page 7-1 of the Weld County Comprehensive Plan, effective March 25, 2000. 7) Prior to the release of building permits, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. Section 11.4.2.1 - Conformance with the Weld County Comprehensive Plan Urban Growth Boundary Goals and Policies and any approved intergovernmental agreement(s) when the recorded exemption application is located within a specified intergovernmental boundary area(s). The lots lie within the 3 mile referral area of the Town of Eaton, which indicated no conflicts with their interests. b. Section 11.4.2.2-Compatibility with existing surrounding land uses.The surrounding properties are agricultural in nature. The proposal will not change the existing density or use. c. Section 11.4.2.3-Consistency with the intent of the zone district the recorded exemption is located within as expressed in the Weld County Zoning Ordinance. The proposal will create one large agricultural lot which will meet the intent A.Goal 9 of the Weld County Comprehensive Plan. d. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. 1) Section 1.3.1 -The proposal is consistent with orderly and integrated development. 2) Section 1.3.10 - The proposal helps to preserve agricultural land and promote its most productive agrarian use. e. Section 11.4.2.5-The proposal is in compliance with the recorded exemption standards set forth in Section 11.8 of the Weld County Subdivision Ordinance. f. Section 11.4.2.6-The amendment incorporates adequate provision for the protection of the health,safety, and welfare of the inhabitants of the neighborhood and the County. This road is maintained by Weld County. D. Weld County Road 72 is designated on the Transportation Plan Map as a local gravel road,which requires 60 feet of right-of-way at full build out. As it now exists we would be forced to sell the entire west 80 acre parcel when the improvements are made to the north west corner. The result being the conversion of 80 acres of prime irrigated farm land into dry land, as there is no practical way of irrigating the west parcel separately from the east parcel. The number one goal in Weld County's Agricultural Goals and Policies is to preserve prime farmland for agricultural purposes which foster the economic health and continuance of agriculture. My proposal does exactly this by joining two contiguous 80 acre parcels that can not be irrigated separately into one parcel. Thus preserving one of the 80 acre parcels from becoming dry land by being separated from its water source. 11. The proposed uses for the two parcels are typical of all the farms surrounding them and typical of all Weld Counties prime farm land. 12. The proposal is consistent with the agricultural zoning requirements of this county as well as the Weld County Comprehensive Plan. The proposal will more securely ensure that the property remains in compliance with the intent of the zoning district in perpetuity. 13.
