RE: ACCEPT PROPOSAL FOR 2000 CONSULTING RIGHT-OF-WAY ACQUISITION
SERVICES AND AUTHORIZE CHAIR TO SIGN -WESTERN STATES LAND
SERVICES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Proposal for 2000 Consulting Right-
of-Way Acquisition Services between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, and Western States Land Services, Inc., with terms and conditions being as stated in
said proposal, and
WHEREAS, after review, the Board deems it advisable to approve said proposal, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Proposal for 2000 Consulting Right-of-Way Acquisition
Services between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and Western
States Land Services, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign any forthcoming documents.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 1st day of May, A.D., 2000.

RE : Consulting Right of Way Acquisition Services
Dear Drew,
Please accept this letter as our brief proposal to perform
consulting right of way acquisition work for Weld County during
calendar year 2000 . This proposal is based on providing assistance
to Weld County on specific projects you identified during our
meeting at your offices on March 27 , 2000 .
I . PROJECT DESCRIPTIONS
The projects you identified are as follows, listed in order of
priority:
l. . Intersection of Weld County Roads 74 and 15 .
This project involves 4 to 5 property owners with some fairly
complicated design issues relating to the private ownerships .
The schedule is for construction to occur tt-.is summer and
negotiations should begin in the next several weeks .
2 .Weld County Road 15 , between WCRs 72 and 74
This project is in close proximity to the one above and will
likely entail acquisition of right of way from 4 owners . As
with project #1, there will be some complicated issues and
predesign meetings are scheduled to begin soon. Construction
is scheduled to occur in 2001, however due to current design
issues, Weld County would like to pursue acquisition of the
right of way this spring\summer.
3 .Weld County Road 149 near Stoneham
This project is the development of an existing dirt trail into
a typical county road. Right of way is required from 3
property owners with construction scheduled for fall 2000 .
Acquisition activities are needed to begin this spring\summer.

4 .Bridge 5616A - South of Keenesburg
The project is the replacement of an existing bridge . There
are 2 private property owners from which right of way must be
acquired to accommodate the project . Construction is scheduled
for 2000 . Acquisition activities are scheduled to begin this
spring\summer.
5 .Weld County Road 17 - South of Windsor
Project includes acquisition from 6 owners in primarily
agricultural area. Construction is scheduled for 2001 and
acquisition activities should begin this summe \fall
6 .Weld County Road 62
Project requires acquisition of right of way from 8 owners in
agricultural area. Construction is scheduled for 2001 with
acquisition activities to begin this summer\faLl .
7 .Weld County Road 9 1/2 - North of Highway 66
Project involves 8 property owners in rural commercial area
along Interstate 25 . Construction is scheduled for 2001 with
acquisition activities beginning during summer\fall 2000 .
8 .Weld County Road 32 - South of Platteville
Right of way and construction parameters to be determined .
II . SERVICES PROVIDED BY WESTERN STATES LAND SERVICES, INC.
As we discussed and according to previous work we have performed
for Weld County, Western States will perform the following services
for non-statutory acquisitions :
1 . Meetings and General Coordination/Research
A. Assist County staff to determine ownership of parcels
across which the right-of-way and construct.ion rights are
necessary.
B . Other general coordination as required, including reports
to the Public Works Department and general coordination
and assistance with the project surveyor and the county
attorney.
C. General review of property values in the Project area for
use during negotiations .

2 . Preparation of Documentation
A. Incorporating legal descriptions, ownership/title work
and value information, we will prepare documentation for
the proposed acquisitions . The documentation will
consist essentially of introductory letters as necessary
and contract/easement forms as approved by Weld County.
3 . Negotiations
A. Using the documentation referenced above, we will present
the County' s offer and negotiate in good faith with the
subject property owners . Typical negotiation procedures,
including negotiator logs, will be adhered to and as
pursuant to our Proposal . As negotiations progress, we
will confer with your office and the County Attorney' s
office if necessary, as to any negotiation terms tha: may
come up, either relative to value or contract language
and agreements .
4 . Close Acquisitions
A. Provided that negotiations are successful , we will work
with the County staff and title company, if any, in order
to obtain clear title, obtain County' s approval of any
contracts and documents and effect exchanges of agreed-
upon consideration for the necessary document.at,, on.
Included in this process we will attempt to obtain
necessary releases from financial encumbrances or the
property, if any. Once acquisitions are complete a
transmittal packet will be prepared of all necessary
documentation and articles involved with each acquis _tion
in a form for submission to the County.
III . SERVICES PROVIDED BY COUNTY
1 . It is understood that the County will provide the following
services :
A. Engineering and Design information, including necessary
construction plans .
B. Surveys and legal descriptions including indivLdual
descriptions and exhibits for each parcel crossed.
C . Title commitments and\or ownership information including
assessor' s printouts and assessor' s maps .
D. Legal Assistance

IV. ESTIMATED COST OF SERVICES
In order to perform the services delineated above, Western States
provides the following estimate for services necessary to
accommodate project 1, 2, 3 and 4 above, entailing acquisitions
from approximately 14 property owners. Costs for the remaining
projects will be estimated at a later date pursuant to your
request . All time and expense will be billed according to the
attached fee schedule
A. Western States Land Services, Inc. Direct:
Principal Agent 340 hours X $40 . 00 = $13, 600 . 00
Senior Agent 60 hours X $50 . 00 = $ 3 , 000 . 00
Clerical 100 hours X $25 . 00 = $ 2 , 500 . 00
Sub-total $19, 100 . 00
Expenses (copies, postage, telephone, mileage, etc . ) $ 1 , 500 . 00
Total $20, 600 . 00
Please note the above estimates involved are services through
voluntary acquisition only, and in the event condemnation pro-
ceedings are necessary, or negotiations are prolonged due to
difficulties with the property owners, then the costs associated
with that additional time would need to be added. On the other
hand, if we complete our work assignment prior to reaching the
costs estimated herein, then the County would not be liable for
paying the entire quoted price .
We are available to begin work on this project immediately,
pursuant to contact by the Project Manager or yourself that a
purchase order number has been approved and assigned. Thank you,
