Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. Prior to recording the plat: A. The lot shall utilize the existing residential access point. No circle drives or additional accesses shall be granted. B. The approved access shall be clearly shown on the plat. C. Weld County Road 48.5 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 48.5 shall be delineated on the plat. This road is maintained by Weld County. 2000-3342 D. The applicant shall provide the Weld County Department of Planning Services with a certificate from the County Treasurer showing no delinquent taxes for the original parcel (mother parcel)area. E. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the flood plain as delineated on Federal Emergency Management Agency(F.E.M.A.)Community Panel Map 080266 0750 C,dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Section 26 of the Weld County Zoning Ordinance. 4) Prior to the release of building permits, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. Th'e legal description on such deed shall include the lot and Recorded Exemption number. 5) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 6) Any disturbance of wetlands shall require the applicant to contact the Army Corps of Engineers for appropriate permits pursuant to Section 404 of the Clean Water Act. 2. The applicant shall submit a mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 3. The Weld County Department of Planning Staffs approval of this recorded exemption amendment is based upon satisfying the above conditions. Should an applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, then this case will be forwarded to the Board of County Commissioners with a recommendation for denial. The parcel the 5.64 acres is coming from will not be affected by this proposal other than a small reduction in total acreage. 5. The parcel adjacent to Lot B is 121 acres in size and will become 115 acres, more or less after approval of this proposal. The existing surrounding land uses comprise of mainly large agricultural/residential lots to the north, south, east and west (see attached site map). The Town of Milliken lies to the north, east and south of this property. This proposal is very compatible with the existing surrounding land uses. 12. A statement explaining how the proposal is consistent with the intent of the district it is located within as expressed in the Weld County Zoning Ordinance, as amended, and the Weld County Comprehensive Plan. This proposal is consistent with the intent of the Agricultural zone district in the fact that the proposed split will not take any truly "prime" agricultural land out of production. This proposal allows the site to continue in agricultural uses. The applicant believes that this proposal meets the intent of the Agricultural zone district. 13.A statement explaining how the proposal is consistent with efficient and orderly development as defined in the Weld County Subdivision Ordinance, Section 1.3. This proposal is consistent with efficient and orderly development by direct and efficient access points on a local street system.
