HomeMy WebLinkAbout20002092 HEARING CERTIFICATION DOCKET NO. 2000-40 RE: RESUBDIVISION, S #518, FOR VACATION OF LOTS 2, 3, 4, 5, 6, AND 7, BLOCK 1, PETERSON-ALEXANDER SUBDIVISION, INCLUDING SOUTHERN PORTION OF 70TH AVENUE COURT - FAITH TABERNACLE CHURCH, CIO DANNY PERDEW A public hearing was conducted on September 20, 2000, at 10:00 a.m.,with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 14, 2000, a public hearing was conducted on August 30, 2000, to consider the request of Faith Tabernacle Church, do Danny Perdew, for Resubdivision, S #518, for vacation of Lots 2, 3, 4, 5, 6, and 7, Block 1, Peterson-Alexander Subdivision, including the southern portion of 70th Avenue Court. At said hearing on August 30, 2000,the Board deemed it advisable to continue said matter to September20, 2000, at 10:00 a.m., to allow adequate time for publication of the legal notice. At said hearing on September 20, 2000, Lee Morrison, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ogle reviewed the reasons for approval and proposed Conditions of Approval as indicated in the Administrative Review. In response to Commissioner Geile, Mr. Ogle stated the applicant is requesting vacation of the southern portion of 70th Avenue Court, not the City of Greeley. He explained the City of Greeley's request was concerning the provision of an easement for access to fire hydrants. Philip Johnson, church member, represented the applicant and stated they are attempting to construct a church for the benefit of the community, and they are willing to do what is necessary to complete the project. Responding to Commissioner Geile, Mr. Johnson stated there are fire hydrants at the south end of the property, as well as one at the entrance on 71st Avenue. Responding to Chair Kirkmeyer, Mr. Johnson stated the applicant has reviewed and agrees with the Conditions of Approval. Mr. Ogle clarified the hydrants are in place; however, they have not been tested. Mr. Johnson stated the hydrants are scheduled for testing tomorrow. In response to Commissioner Baxter, Chair Kirkmeyer stated Condition of Approval #4 requires the applicant to address water service to the site for fire hydrants, and tomorrow's test results need to be submitted to the Department of Planning Services. 2000-2092 ed , �°L /7/L 470) ) ) PL1325 HEARING CERTIFICATION - FAITH TABERNACLE CHURCH (S #518) PAGE 2 No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Faith Tabernacle Church,do Danny Perdew, for Resubdivision, S #518, for vacation of Lots 2, 3, 4, 5, 6, and 7, Block 1, Peterson-Alexander Subdivision, including the southern portion of 70th Avenue Court, based on the recommendation of the Planning staff, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 25th day of September 2000.
