Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. In accordance with Weld County Department of Public Works Ordinance#180, Lot A shall be granted one
residential/agricultural access. Direct access from a public road shall be limited to one access per legal
parcel for residential use, no circle drives or additional accesses shall be granted. Access will be placed
in such a location as to have adequate sight distance in both directions and not below the crest of a hill or
where physical obstructions are present. This access shall be a minimum of 75 feet from any intersecting
County or State roadways. 7t1QO
B. Lot B shall utilize the existing agricultural /oil and gas /ditch road access points necessary for agricultural
operations. No circle drives or additional accesses shall be granted.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Department of Public Works to determine if a culvert is necessary at any approved access point. If a
drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place
a larger culvert, please contact the Department of Public Works to adequately size the culvert.
D. Weld County Road 19 is designated on the Southwest Study Capacity Improvement Needs as a collector
status road,which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way.
A total of 40 feet from the centerline of Weld County Road 19 shall be delineated on the plat as right-of-way
reservation for future expansion of Weld County Road 19. This road is maintained by Weld County.
E. Weld County Road 4 is designated on the Southwest Study Capacity Improvement Needs as a paved rural
road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way.
A total of 30 feet from the centerline of Weld County Road 4 shall be delineated on the plat. This road is
maintained by Weld County.
F. The plat shall indicate setbacks from existing wellheads on the property. No building or structure as defined
and limited to those occupancies listed as Groups A,B,E,H,I,M and R in Table 3-A of the 1997 Uniform
Building Code, shall be constructed within a 200-foot radius of any tank battery or 150-foot radius of any '
wellhead. Any construction within a 200-foot radius of any tank battery or within a 150-foot radius of a
wellhead shall require a variance from the terms of this ordinance in accordance with Section 61.3.
G. The applicant shall provide the Weld County Department of Planning Services with a certificate from the
County Treasurer showing no delinquent taxes for the original parcel (mother parcel) area.
H. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback and offset requirements for the
zone district in which the property is located. Pursuant to the definition of setback in the Weld
County Zoning Ordinance, the required setback is measured from the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) Prior to the issuance of a building permit on Lots A and/or B of the recorded exemption, the
applicant for the building permit shall be required to submit to the Department of Planning Services,
evidence that the lots have an adequate water supply of sufficient quality, quantity and dependability.
4) Prior to the release of building permits on Lots A and/or B, the applicant will be required to submit
a recorded deed describing the lot upon which the building permit is requested with the building
permit application. The legal description on such deed shall include the lot and recorded exemption
number.
5) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.
6) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in the United States. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
f
activities will generate off-site impacts, including noise from tractors and equipment; dust from
animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning;flies and mosquitoes; the use of pesticides and fertilizers in the
fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of
the way" of residential development without threatening the efficient delivery of irrigation to fields
which is essential to farm production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)
with more than 3,700 miles of state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is based on
responses to complaints more than on patrols of the county and the distances which must be
traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not provide the same
kind of surface expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works or may be the private
responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and
livestock present real threats to children. Controlling children's activities is important, not only for
their safety, but also for the protection of the farmer's livelihood.
7) Effective December 1, 1999, Building Permits issued on the proposed lots will be required to adhere
to the fee structure of the Southwest Weld Road Impact Program area 3, (Ordinance 211). The
application's land use type has been tentatively classified by Planning Services within the Single-
Family Detached land use type (Section VII.C.1). The current rate of assessment for this type of
land use is $2,031 per Dwelling .
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of
Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)days from
the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the
recording fees.
4. The Weld County Department of Planning Staffs approval of this recorded exemption is based upon satisfying
the above conditions. Should an applicant be unwilling or unable to meet any one of these conditions, within
60 days of approval, then this case will be forwarded to the Board of County Commissioners with a
recommendation for denial.

I have a question on what signatures need to be incorporated on this plat.
The property owners of Lots A and B of the recorded exemption are doing a
property line adjustment. National Exchange Service is facilitating the
property exchange and currently holds title to the property to be exchanged
(for the next 30 days or so before transferring to the property owners) .
There names and signatures were not included on the subdivision plat that was
turned in.
Question: Do signatures from National Exchange Service need to be
incorporated on the plat or can this be taken care with a letter from the
company or some other documentation because it is under temporary ownership of
the company?

1. Water Supply Statement
Domestic water will be supplied by an On-Site Water Well to Lot B. (Please
see attached Well Permit Exemption #219803 dated August 18, 1999.)
2. Sewage Disposal Statement
Lot B will utilize Individual Sewage Disposal Systems. The septic systems will
be installed in compliance with requirement and regulation of the A
(Agricultural) Zone District and Weld County Health Department at the time
construction is approved.
3. Description of Property Use
The land has been farmed with dry land wheat with fair to poor yield. The land
is not considered to be prime agricultural and has no existing outbuildings or
improvements.
4. Reason for Recorded Exemption Amendment and Explanation
This amendment is for the purpose of adjusting the property lines of the
building envelope for Lots A and B to accommodate a suitable residential
construction site. This proposal does not change the building envelope acreage

land wheat with no existing outbuilding or improvements.

There are no unique physical characteristics.
7. Setbacks and Offset Statement
All proposed structures are to meet the minimum setback and offset

The applicant does not wish to place a conservation easement on the property at

10. Weld County Comprehensive Plan Consistency
This proposal is consistent with the comprehensive plan. It conserves
surrounding farmland for agricultural purposes and does not change the
approved building envelope acreage.
11. Compatibility With Surrounding Land Uses
The proposed amendment does not change the original record exemption
application regarding land use. This property will coincide with the similar
uses in the area.
12. Consistency With Intent of District
This proposed amendment does not change the existing record exemption
information regarding land use. It will not interfere with agricultural work,
production or activities which make it consistent with the Agricultural Districts
intent. Use by Right within A District allows residential and farming activities.
13. Consistency With Efficient and Orderly Development
This proposal does not detract or take away from any of the natural beauty of
the area nor does it impact any fire, safety, rescue, or conveniences of any

COMMENTS:
WCR 19 is designated on the Southwest Study Area Capacity Improvement Needs as a collector status road,
which requires 80 feet of right-of-way at full build out. There is presently a 60 foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance
(Ordinance 89, as amended), the required setback is measured from the future right-of-way line.
WCR 4 is designated on the Southwest Study Area Capacity Improvement Needs as a paved rural road,which
requires 60 feet of right-of-way at full build out. There is presently a 60 foot right-of-way. This road is maintained

REQUIREMENTS:
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a
larger culvert, please contact the Public Works Department to adequately size your culvert. (Lot B)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No
additional accesses shall be granted. (Lot B)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) . This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action. -
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(11)(A)as the only well on a tract of land of 40 acres described as NW1/4 of the
NE1/4, Section 33,Township 1 North, Range 67 West, 6th P.M.,Weld County.
4) The use of ground water from this well is limited to fire protection, ordinary household purposes inside not more than
three (3)single family dwellings,the watering of poultry, domestic animals and livestock on a farm or ranch and the
irrigation of not more than one (1)acre of home gardens and lawns.
5) Production from this well is restricted to the Laramie-Fox Hills aquifer,which corresponds to the interval between 565 feet
and 870 feet below the ground surface. Plain casing shall be installed and grouted to prevent production from other zones.
6) The maximum pumping rate of this well shall not exceed 15 GPM.
7) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
8) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTE:To insure a maximum productive life of this well, perforated casing should be set through the entire producing
interval of the approved zone or aquifer indicated above.
NOTE:The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than
the 100 years upon which the amount of water in the aquifer is allocated, due to anticipated water level declines.
