found to be in apparent compliance with the applicableprrovi.sippslol law and the
Town Board has adopted a Resolution to set a public heari-ngltoLbefield at 7:00
p.m. on June 5, 2000 at the Town Hall at 101 Charlotte Street in Johnstown,
Colorado to determine if the proposed annexation complies with the applicable
requirements of law.
The Resolution adopted by the Town Board for such purposes is in words, letters
and figures as follows:

FINDING SUBSTANTIAL COMPLIANCE FOR INITIATING ANNEXATION
PROCEEDINGS FOR THE FAITH LUTHERAN CHURCH ANNEXATION
WHEREAS, a written petition, together with five (5) prints of an annexation map,
was heretofore filed with the Town Clerk requesting the annexation of certain
property to be known as the FAITH LUTHERAN ANNEXATION, more particularly
described as situate in the County of Weld, State of Colorado, to wit:

WHEREAS, the Town Board desires to initiate annexation proceedings in
accordance with the law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF JOHNSTOWN, COLORADO:
Section 1. That the Town Board hereby accepts said annexation petition, finds
and determines that the annexation petition and accompanying map are in
substantial compliance with CRS 31-12-107, and desire to initiate annexation
proceedings in accordance with law.
Section 2. The Town Board shall hold a hearing to determine if the proposed
annexation complies with CRS 31-12-104 and 31-12-105, or such parts thereof
as may be required to establish eligibility for annexation under the terms of Part
1, Article 12, Title 31, CRS. A hearing shall be held on the 5th day of June, 2000,
in the Board meeting room of the Town of Johnstown, 101 Charlotte Street,
Johnstown, Colorado at 7:00 p.m.
Section 3. The Town Clerk shall publish notice of such hearing once per week
for four (4) successive weeks in the Johnstown Breeze, with the first publication
at least thirty (30) days prior to the date of the hearing. The Town Clerk shall
also send a copy of this resolution and the petition for annexation to the Clerk to
the Board of County Commissioners, the County Attorney and to any special
district or school district within the area proposed.

PETITION FOR ANNEXATION
To the Town of Johnston
-The-undersigned,in ccordance with Article 12,Chapter 3.1;CRS;as-amended;-herebypetitionthe Town
Board of Trustees of the Town of Johnstown, Colorado,for annexation to the Town of Johnstown the
unincorporated territory more particularly described below,currently known as and in
support of said Petition,your petitioners allege that:
(1) It is desirable and necessary that the following described territory be annexed to the Town of
Johnstown, Colorado.
(See Exhibit A attached hereto and made a part hereof.)
(2) Not less than one-sixth(1/6)of the perimeter of that area proposed to be annexed is contiguous
with the Town of Johnstown, Colorado.
(3) A community of interest exists between the territory proposed to be annexed and the Town of
Johnstown, Colorado.
(4) The territory proposed to be annexed is urban or will be urbanized in the near future.
(5) The territory proposed to be annexed is integrated or is capable of being integrated with the
Town of Johnstown, Colorado.
(6) The signatures of the Petition comprise one hundred percent(100%)of the landowners of the
territory to be included in the area proposed to be annexed and said landowners attesting to
the facts and agreeing to the conditions herein contained will negate the necessity of any
annexation election.
(7) No land held in identical ownership,whether consisting of one grant or parcel of real estate or
two or more contiguous tracts or parcels of real estate:
(a) Is divided into separate parts of parcels without the written consent of the landowner
or landowners thereof unless such tracts or parcels are separated by a dedicated
street,road or other public way.
(b) Comprising twenty(20)acres of more and which, together with the building and
improvements situated thereon has an assessed value in excess of Two Hundred Thousand
($200,000.00)for ad Valero tax purposed to annexed without the written consent of
the landowner or landowners.
(8) No part of the area proposed to be annexed is more that three(3)miles from a point on
the municipal boundary, as such was established more that one year before the annex-
ation will take place.
(9) The area proposed to be annexed is less than ten(10)acres and is not subject to the
provisions of Section 31-12-105.5, CRS, as amended.
(10) The area proposed to be annexed is located within Weld County School District RE-5J,
Northern Colorado Water Conservancy District,Little Thompson Water District,
Johnstown Fire Protection District, Aims Junior College District, and Weld County
Library District,and no others.
(11) The mailing address of each signer,the legal description of the land owned by each signer
and the date of signing of each signature are all shown on this Petition.
(12) Accompanying this Petition are five(5)prints of the area proposed to be annexed and the
following information:

(a) A written legal description-of the'boundari'es ofthe-area proposed to annexed.:
(b) A map showing the boundary of the area proposed to be annexed, such map prepared
and containing the seal of a registered land surveyor.
(c) The annexation boundary map indicates the proposed area is not platted and lots are not
plotted.
(d) The boundary of the area proposed to be annexed indicated the contiguous boundary
to the Town of Johnstown.
(e) The dimensions of the contiguous boundaries are shown on the map.
(13) The territory to be annexed is not presently a part of any incorporated city, city and county,
or town.
(14) The undersigned agree to the following conditions,which shall be covenants running with the
land,and which shall,at the option of the Town, appear on the annexation map:
(a) Water rights shall be provided as mutually agreed to by the Town and the undersigned.
(b) The owners shall participate in providing drainage plans and improvements and
payment of a unit drainage fee if required by the Town for the area.
(c) The undersigned and the Town may enter into an Annexation Agreement prior to the
effective date of this annexation,which agreement shall be additional conditions as
effectively as if set forth in this Petition.

plan approved by Weld County, Colorado.
A site specific development plan has been approved by Weld County,Colorado,which has
created a vested right.
(16) Submitted with this Petition is the required annexation fee of$100.00.
(17) In the event that an Annexation Agreement satisfactory to both the undersigned and the Town
is not agreed to on or before the date of the final reading of the ordinance to effectuate the
annexation contemplated by the Petition, the undersigned shall have the right to withdraw this
Petition at its option and this Petition shall be deemed to be null and void as of the date of this
Petition and of no force and effect as if it had never been executed and never been filed with the
Town. In no event shall any filing fees be refunded in connection with any withdrawal of this
Petition.

This Annexation Statement and Outline Development Plan is for the purpose
of requesting annexation to the Town of Johnstown 7.98 acres located West of
Johnstown, Colorado on Highway#60. Legal description is attached as Exhibit A
and also shown on the maps attached to the application. The warranty deed is
attached as Exhibit B. The,attached zoning request is for residential designation.
The proposed use of the land is for the building of a church and surrounding
grounds.

Property Ownership Information
The property is presently owned by the Rocky Mountain District of the Lutheran Church-
Missouri Synod.
Water Rights Information
Water to the existing house on the property is now being supplied by the Town of Johnstown.
The existing Faith Lutheran Church, located in the Town of Johnstown,is presently being
supplied with water by the town free of charge. When a new church building is erected on the
property, an additional water meter will have to be installed and the proposed church will pay for
water that is used.
Project Concept
The overall project will be the construction of a church/educational facility.

Existing Land Use and Zoning
Residential use and zoned agricultural. However,no crops have been harvested in the last three
years.
Proposed Land Use and Zoning
Zoned residential and leave the home on one and one half acres and build a church on six and
one half acres.
Public Use Dedication
No public use dedications are made. Long range plans for facility development will be those for
use by the church.
Vehicular,Bike and Pedestrian Circulation
A 70 foot wide access will be developed off the Highway#60 to provide access to the church as
well as to the existing home.
Development Phasing and Schedule
Phase One of our development plan is to build a 5000-5500 square foot worship church facility
to be used for worship services and education. Building could begin as early as the summer of
2000.
Fiscal Impact
We invision no fiscal impact. This will be typical of churches in the area. No ad valorem tax
but water and sewer revenue.
Johnstown Facilities
Water supplied by the Town of Johnstown is now in existence. Connection to a sewer system
will depend upon the development of adjacent properties. ( Carlson Farms, Harding Addition,
and any planned additions West of the property. Historically churches use less water and sewer
facilities than does a three or four family home.
