Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The applicant shall provide the Department of Planning Services with a certificate from the County l.c1
Treasurer showing no delinquent taxes for the original parcel (mother parcel) area. KS
B. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the
Department of Planning Services for review. U approval by the Department of Planning Services, the

C. The applicant shall submit a sketch of the existing septic system in relation to the proposed lot line to the
Weld County Health Department. The applicant shall submit evidence of Health Department approval to
the Department of Planning Services.
,D. In accordance with Weld County Public Works Ordinance#180, Lot A and Lot B shall utilize the existing
residential access point. Lot B shall utilized the existing agricultural, oil and gas, and ditch roads that are
necessary for your agricultural operation. No circle drives or additional accesses shall be granted. These
roads will be graded and drained to provide all weather access.
E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger
culvert, please contact the Public Works Department to adequately size your culvert.
Both Lot A shall comply with the one (1) acre minimum lot size required by Section 11.8.5 of the Weld
County Subdivision Ordinance.
G. WCR 66 is designated on the Transportation Plan Map as a Collector Status road, which requires 80 feet
of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County.
• In a referral from the City of Greeley Planning Department, dated January 10, 2000, the City of Greeley is
asking that fifty feet(50') from the Centerline of WCR 66 be reserved for future expansion of WCR 66.
The plat shall be delineated to show 40 feet of right-of-way from center line of WCR 66, with an additional
ten feet(10')delineated with a label indicating that the additional ten feet(10') is to be"reserved" for future
road right-of-way. The total future road right-of-way designation shall be fifty feet(50') from the centerline
of WCR 66.
H. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. All proposed or existing structures will or do meet

Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as
amended), the required setback is measured from the future right-of-way line.
2) Prior to the issuance of a building permit on Lot B of the recorded exemption, the applicant for the
building permit shall be required to submit to the Department of Planning Services, evidence that
the lot(s) has (have) an adequate water supply of sufficient quality, quantity and dependability.
3) Prior to the release of building permits on Lot B, the applicant will be required to submit a recorded
deed describing the lot upon which the building permit is requested with the building permit
application. The legal description on such deed shall include the lot and recorded exemption
number.
4) The existing second residential structure located on Lot A, previously located on Lot B, shall remain
consistent with the definition of an Accessory Building in the Weld County Zoning Ordinance and
maintain compliance with the following conditions:
a) Electricity is the only utility which will be connected to the structure.
b) The structure shall not be used on any basis as a dwelling or as overnight or temporary
housing for any person.
5) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.
6) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in the United States. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; dust from
animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the
fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of
the way" of residential development without threatening the efficient delivery of irrigation to fields
which is essential to farm production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)
with more than 3,700 miles of state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is based on
responses to complaints more than on patrols of the county and the distances which must be
traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not provide the same
kind of surface expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works or may be the private
responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and
livestock present real threats to children. Controlling children's activities is important, not only for
their safety, but also for the protection of the farmer's livelihood.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
fees.
4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should the
applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, this case will be
forwarded to the Board of County Commissioners with a recommendations for denial.

This memo is in reference to the above referenced Recorded Exemption. Adjacent to the northerly
lot line there is an area between the lot line and the existing fence line (approximately 100-160 feet
in width). This portion was quit claimed to the property owner to the north of the recorded
exemption. To fix this, an amendment must be done to correct the northerly property line.
According to Lee Morrison, Assistant County Attorney, the time frame for applying for another
recorded exemption would be determined from the date of the Quit Claim deed. Fixing this lot line
will not effect an amendment to Lot A, as long as they were submitted at the same time.

Problem in that there are two homes depicted in the application for 2ndAmRE-263
on Lot A. RE-263 and AmRE-263 both show homes on separate parcels. One
home on Lot A and one on Lot B.
Address of large two or three story home is 19503 WCR 66.
Address of smaller home is 19505 WCR 66.
Application for 2ndAmRE-263 ostensibly for amending a lot line problem with
land owner to the north. Given this, there are no zoning violations on the site.
However, it remains to be seen how lot lines will be drawn for Lot A in 2ndAmRE-
263.

To whom it may concern,
Review of History and Events leading to this Request.
This property has been in the ownership of the Monsons/Moro Farms since 1969. On August 12, 1977
Moro farms deeded a parcel of ground to David Lawrence Monson and Patricia Lynn Monson(David
Lawrence Monson being part of Moro Farms).This Recorded exemption was done for the purpose of
separating the Monson residence from the rest of the farm property. It was assumed that Mr.&Mrs.
Monson would always live here and no consideration was given to what would happen if the residence
were ever to be sold.You will see that the configuration of the yard makes it unreasonable for a subsequent
owner to own this property without some lot line adjustments. We are hereby asking Weld County Planning
and Zoning to approve our Amended Recorded Exemption Application
We have been made aware that on March 24th, 1987 a Quit Claim Deed was executed and recorded without
approval from the Weld County Planning and Zoning department It was not the intent to create a separate
deedable parcel by doing so.This request was made to reestablish boundary lines as had been the nature of
fanning practices and was actually an adverse possession issue in the first place. If desired by the Planning
and Zoning Department,other deeds can be produced to prove that this was actually done with properties
throughout the whole section creating a straight boundary line following an existing Irrigation Ditch in
approximately the middle of the section. Discussion has taken place and has been suggested that an
additional amended exemption be allowed and dated back to the date of the original Quit Claim Deed to

The following are answers to the Recorded Exemption Questionnaire.
WATER SUPPLY Enclosed is a letter from North Weld County Water District regarding water services
available.Lot A is currently on North Weld Water and has no irrigation water in its current configuration or
its proposed amendment.North Weld County Water District can provide a water tap to Lot B,however it is
currently irrigated farm ground and will remain so.
SEWAGE DISPOSAL The home on Lot A is connected to an existing septic system. See Enclosed copy of
ISDS permit.The labor house currently on Lot B is also connected to the same ISDS but is being requested
to be amended to become be part of Lot A. Upon you approval of the Amendment,we will inform any
potential purchasers that the labor house may no longer be used as a permanent residence without prior
written approval from Weld County Planning and Zoning. In the event a residence would be built on Lot B,
it would need to be serviced by a separate ISDS.
CURRENT USE Lot A is currently used primarily as a residential use as well as the proposed amendment.
Lot B is irrigated farm ground and will remain the same.
REASON FOR LOT LINE ADJUSTMENT(AMENDMENT)The current owner has purchased a home in
town and is not currently using the residence.The configuration of Lot A is not appealing to any
prospective purchaser due to the yard being shared with Lot B.This is not appealing to the farmer/operator
of Lot B to be responsible for maintenance of a residential yard.In summary this is not an appealing
situation for owners of either Lot once they are not one and the same owners. In addition this amendment is
made to clear up a property line problem to the North.

DESCRIPTION OF LOCATION, SIZE,AND PRESENT USE. Lot A is currently 1.09 ages more or less
and only includes the larger 3 story home. Lot B is mainly Irrigated farm ground,but part of the current
residential yard is also part of Lot B. Allowing a lot line adjustment(amendment)this will allow for a
much cleaner division of Lot A and Lot B.There is some concern about including all of the yard with the
large shop or leaving it with the farm parcel(Lot B). We would ask that some flexibility be allowed during
the marketing of this property to determine which Lot the Large shop will be included. In any event,we
understand that Lot A must remain a minimum size of 1 acre,the largest the parcel would be is just under 2
acres.
A PLAT OF PROPOSED ADJUSTMENTS IS ATTACHED.
SETBACK AND OFFSET REQUIREMENTS. A review and survey has been conducted with Freese
Engineering and the attached plat indicates that all structures meet minimum setbacks for current district.
CONSERVATION EASEMENT Applicant does not wish to place a conservation easement on the
property. This property will remain in agricultural production as long as the surrounding area remains
agricultural.
BUILDING ENVELOPE Lot A currently has a residence and no building envelope is necessary. Lot B has
no current plans for any buildings so no envelope is feasible at this time.
WELD COUNTY COMPREHENSIVE PLAN The proposed lot line adjustment is consistent with the goal
of preserving prime farmland for agricultural purposes in that both parcels will not change as to what they
are now being used for.Lot B AG production,and Lot A residential.
COMPATIBILITY Both parcels are currently compatible with surrounding uses and will remain the same
as now used.
WELD COUNTY ZONING ORDINANCE AND COMPREHENSIVE PLAN The uses now are
compatible and comply and will remain the same.
WELD COUNTY SUBDIVISION ORDINANCE, SECTION 1.3;As stated above,no changes are
proposed for either parcel.

Thanks for the opportunity to review this recorded exemption. The City of Greeley Planning
staff has reviewed the application for a recorded exemption from David Monson, located north of
and adjacent to WCR 66 and approximately 1/4 mile west of WCR 41 and wish to forward the
following comments.
Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review
authority to the Greeley Planning staff for review of recorded exemptions (RE). The resolution
indicates we cannot recommend approval on any application where the overall gross density
exceeds one dwelling unit per 20 acres outside of the 2010 growth ring. Since this application
creates two lots through the exemption process on a 71 acre parcel, we can recommend approval
of the request based on Resolution 7. The Greeley Public Works Department noted a reservation
of a minimum of 50' of right-of-way from the centerline of WCR 66 would be appropriate to
facilitate future development of this area if the proposal is approved. Also, the appropriate
setbacks under the applicable zone should also be maintained within the subdivision.

This letter is in response to your inquiry regarding water service to the following described property,
