RE: APPROVAL OF INTERGOVERNMENTAL AGREEMENT BETWEEN THE
CITY OF BRIGHTON - REGARDING LAND DEVELOPMENT AND
WASTEWATER SERVICES
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the City of Brighton has been awarded a Step II
Sewage Works Grant to design the expansion of the City' s
wastewater treatment plant, and
WHEREAS, the area designated by the City of Brighton, State
Health Department, Environmental Protection Agency, and Denver
Regional Council of Governments includes land outside and beyond
the current corporate limits of the City of Brighton, and
WHEREAS, as conditions of the Step II grant award, the City
must formalize the management and use of its interceptor sewer
system and treatment capacity, and limit sewerage connections to
Brighton' s sewer system within the designated Brighton Service
Area, and
WHEREAS, the local jurisdictions existing within Brighton' s
Service Area include undeveloped land in Adams and Weld Counties,
therefore, an Intergovernmental Agreement, which is attached hereto
and incorporated herein by reference, has been presented to the
Weld County Board of County Commissioners for their consideration,
and
WHEREAS , the Board of County Commissioners, after studying
said agreement deems it advisable to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Intergovernmental
Agreement between the City of Brighton - Adams and Weld County
regarding land development and wastewater services be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman
of the Board of County Commissioners of Weld County, Colorado,
be authorized to sign said agreement. PL0079

REGARDING LAND DEVELOPMENT AND WASTEWATER SERVICES
WHEREAS, the City of Brighton has been awarded a Step II Sewage Works
Grant to design the expansion of the City's wastewater treatment plant, and
WHEREAS, the area designated by the City of Brighton, State Health
Department, Environmental Protection Agency, and Denver-Regional Council of
Governments includes land outside and beyond the current corporate limits
of the City of Brighton, and
WHEREAS, as conditions of the Step II grant award, the City must (1)
formalize the management and use of its interceptor sewer system and treatment
capacity, and (2) limit sewerage connections to Brighton's sewer system within

the designated Brighton Service Area, and
WHEREAS, the local jurisdictions existing within Brighton's Service Area
include undeveloped land in Adams and Weld Counties, therefore; the following
understandings and consensus have been reached between the City of Brighton
and the County of Adams and County of Weld:
A. The population within that portion of the Brighton Service Area not
currently within the Brighton city limits is estimated to be 12,000 by the
year 2000. The current population within the corporate limits of Brighton
is 13,000, resulting in a total Service Area population by 2000 of 25,000.
Population growth will occur through in-City land development, future
annexations to the City, and the result of the following City-Counties
cooperative land development process:
1. All subdivision plats and rezoning requests within the unincorporated
portion of the Brighton Service Area will be sent to the Brighton City Manager
for staff, Planning Commission, and City Council review and cemnents, which
Adams and Weld County shall consider in its final actions and decisions.
2. If development is approved by Adams or Weld County in the Service
Area, it shall be conditioned on the availability of sewer service from the
City or alternative non-public sewer service such as private septic systems
or private service.
B. The City Council does hereby contiuit itself to limiting sewerage
service to the designated Brighton Service Area. Should changing circum-
stances necessitate a need and request for service beyond the designated
Brighton Service Area boundaries, a request will be made by the City to the
Environmental Protection Agency and Denver Regional Council of Goveinments
for modifications to the Denver Regional. Council of Goveizunents Growth and
Development Plan prior to the City's approval of such service requests.
C. By entering into this agreement, neither Adams County nor Weld
County are hereby assenting to any future annexations by Brighton nor are
they guaranteeing that all future pertinent zoning determinations will be
consistent with this agreement.

Agreement between the City of Brighton, Adams, and Weld Counties
pertaining to Land Development and Wastewater Services which was
approved by the Board of Weld County Commissioners on March 22.
The Board of Weld County Commissioners would like to thank
you for your cooperation in making the requested revisions which
we hope resulted in a mutually satisfactory agreement.
