RE: APPROVAL OF RECORDED EXEMPTION NO. 465 - AUGUST AND FREIDA
SCHNEIDER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 10th day of December, 1980 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the
division into two parcels of land, as shown on the plat known
as Recorded Exemption No. 465, being the property of August and
Freida Schneider, described as part of Section 5, Township 6
North, Range 67 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows :
The Northeast Quarter (NEa) of Section Five
(5) , Township Six (6) North, Range Sixty-seven
(67) West of the 6th P.M. , and except a par-
cel of land containing 3 . 52 acres more or
less, as conveyed to the Department of High-
ways, State of Colorado, by special warranty
deed recorded in Book 568, Reception No.
1489974, Weld County Records
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" Pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations
subject to the recorded exemption plat being amended to reflect
a 75 foot reservation or dedication along the west side of High-
way 257.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by August and Freida Schneider be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended, subject to the recorded
exemption plat being amended to reflect a 75 foot reservation or
dedication along the west side of Highway 257.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of
December, A.D. , 1980.

Re: Recorded Exemption #465
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from August and Freida Schneider for a recorded exemption. The
parcel of land on which this request has been made is described as the NE1,
Section 5, T6N, R67W of the 6th P.M. , Weld County, Colorado. This property
is located 21/2 miles north of Windsor. The property contains approximately
160 acres of Class II, III and IV irrigated soils. The request is to split
the property into parcels of approximately 1 acre and 159 acres. Mr. and
Mrs. Schneider wish to retire from farming, sell the proposed Lot B and
build a home on Lot A.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemption
procedure) , Section 3-3 A. of the Weld County Zoning Resolution
(intent clause of the Agricultural Zone District) , and the Weld
County Comprehensive Plan in that the use will be compatible with
surrounding agricultural uses. The request will allow agricultural
and related uses to be the predominant land use.
2. The Town of Windsor has reviewed this request and has no objections
to it.
3. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.
The Department of Planning Services staff further recommends that the recorded
exemption plat be amended to reflect a 75 foot reservation or dedication along
the west side of Highway 257 as requested by the Colorado Division of Highways
in their letter dated November 25, 1980.

Dear Sirs;
We are asking for your consideration on the attached application
for a recorded exemption on our farm.
At this time we are in the process of placing our farm for sale.
We are at retirement age and due to health reasons we cannot
continue our farming operations. During the past two farming
seasons we have had to get considerable help because of recurring
health problems for Mr. Schneider. We do not feel that we can
take care of the farming operations another year under these
conditions.
This farmland has been farmed by the Schneider family since 1933.
We took over the farm and its operation in 1946 from my father,
Mr. Phillip Schneider Sr. and have farmed it to the present time.
In 1966 we purchased the farm. Since we consider the farm to be
where our roots have been for the past 36 years we find it to be
of great sentimental family value.
In addition to the personal meaning to us, the location of the
recorded exemption would be of practical value also. Our son,
Mr. Gerald Schneider, who owns the adjoining land, would live
about $ of a mile from our retirement home.
The portion of ground, which we wish to get the recorded exemp-
tion on, is located in a corner of the farm which is not prac-
tical to farm. This piece of the field is brought to a narrow
point at the corner of the farm by an irrigation supply ditch
for the adjoining farm. Being cut into a small corner by prop-
erty boundries and existing irrigation ditch right of ways, this
one acre of ground is not practical to farm with large farming
equipment. The removal of this one acre would not effect the
agricultural production of the farm in any measurable amount.

Since we have spent the greatest portion of our lives in the
country, we find it difficult to change our life style by
moving to town. After farming this ground for the past 36
years, we feel that we should be allowed to remain here.

Dear Ms. Traxler:
We have reviewed the August and Frieda Schneider application for a recorded exemption,
and we have the following comments.
1 . Projected traffic volumes on State Highway 257 indicate the need for a total
of 150 feet of right of way, 75 feet each side of the highway centerline. We
ask that additional right of way necessary to meet this need be protected by
reservation or dedication, preferably the latter, as permitted by County regulations.
2. A Driveway Permit was issued to Mr. Schneider on November 5, 1980, for the reloca-
tion of an existing driveway. The new driveway location will apparently provide
access to proposed Lot "A". No new access to State Highway 257 should be necessary
for Lots "A" or "B" if this exemption request is approved.
