RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1291
FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (NATURAL GAS
PROCESSING PLANT) IN THE A(AGRICULTURAL)ZONE DISTRICT-HS GATHERING,
LLC
A public hearing was conducted on December 20, 2000, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 4,2000,and duly published December 7,
2000, in the South Weld Sun, a public hearing was conducted to consider the request of HS
Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit #1291
for an Oil and Gas Support and Service Facility(natural gas processing plant)in the A(Agricultural)
Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris
Gathman, Department of Planning Services, presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written and
stated eight entities responded to referrals indicating no conflict with their interests. Mr. Gathman
stated the application is consistent with the Comprehensive Plan,the intent of the Agricultural Zone
District, and will be compatible with surrounding land uses and future uses of the area. He stated
the site lies within the Fort Lupton referral area; however, no conflicts were indicated by the City.
Mr. Gathman requested deletion of Condition of Approval#2.C,since the Waste Handling Plan has
already been approved. He also indicated in regards to Condition #2.E that the applicant has
discussed a Weed Management Plan with Ron Broda and they have no issues.
Jeff Fisk, Attorney, represented the applicant and stated this is an ideal location for this type of
facility. He indicated there is an existing facility on the north portion of this site currently being
operated by HS Gathering, and one across the road being operated by Narco. Responding to
Commissioner Geile, Mr. Fisk stated there is a fire extinguishing system which totally shuts down
the system in case of leakage or fire. Joe Baumberger, HS Gathering LLC, stated the compressor
station on the north side of the site has gas detectors and fire extinguishers and everything shuts
down in case of leakage or fire; however, the plant under consideration has fire detectors, and gas
detectors inside. Responding to Commissioner Geile, Mr. Baumberger stated the facility is certified
to operate in a temperature range from 40 to 120 degrees below zero temperatures. Responding

to Chair Kirkmeyer regarding Development Standard#11, Mr. Morrison stated the ownership is the
same for the two facilities on this site. Mr. Fisk stated this was addressed in Condition of Approval
#2.D, which has already been completed. Responding to Chair Kirkmeyer, Mr. Morrison clarified
there are two Use by Special Review Permits, operated by HS Gathering, for one lot. Mr. Fisk
stated he agrees with the Conditions of Approval and Development Standards.
No public testimony was offered concerning this matter. Mr. Morrison stated Development
Standard #11 and 12 should have the words "on this parcel" inserted after the word "site."
Commissioner Baxter moved to approve the request of HS Gathering, LLC, for a Site Specific
Development Plan and Use by Special Review Permit #1291 for an Oil and Gas Support and
Service Facility (natural gas processing plant) in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record, with Condition of Approval #2C
deleted, and Development Standards #11 and #12 modified as stated above. The motion was
seconded by Commissioner Hall, and it carried unanimously.
This Certification was approved on the 27th day of December 2000.
