A water tap is currently available to the proposed lot by North Weld County Water, see attached letter dated April 20, 1999, from North Weld County Water. This will insure a sufficient quality, quantity, and dependability of water to the proposed lot. As of May 1st, 1999, the cost of the water tap is $9,000.00. b. Irrigation water. Irrigation water is provided to the larger tract by the Good Lateral Ditch. The proposed site is located above this ditch, therefore no irrigation has been provided or removed to/from the proposed site in the past. 2. Disposal of Sewer. An on site septic system/leach field is used by the current house. An on site septic system/leach field would be used for sewer disposal for the proposed lot. 3. Description of the current use of the property. The exsting larger tract is currently being used as a working farm and principle residence with 2 barns, misc. sheds and outbuildings. Estimate approximately 140 acres of prime farm land, currently being put to productive use in agriculture, and approximately 4 acres of nonprime farmland. Of the nonprime farmland, about 2 acres are where the house and outbuilding are located, and about 2 acres is the proposed lot # 2 which is located above the ditch and currently not being used for any purpose, agricultural or otherwise. 4. The reason for the proposed recorded exemption, and how each lot would be used. The reason for the proposed recorded exemption is to create a buildable homesite from unused, un-irrigated land. The land, lot 2, is too small of a parcel, about 2 acres, to be farmed using modern day farming methods, being bordered by the county road on two sides and the ditch on the third side. The proposed lot would be used as a single family residential building site for 1 home. The larger tract would still be used for agriculture. 5. Location, size and present use of proposed lot. The land is located about a mile north east of Pierce at the southwest corner of Weld County road 90 and Weld County Road 37, bordered by a Ditch on the west side. The land is about 2.2 acres in size, and has not been used for any purpose, agricultural or otherwise, for some time. 6. Unique physical characteristics on the site. The land has good access from County Road 90 and water for household use is readily available, however irrigation water is not. The land is level with a few • r trees by the ditch and nice mountain views to the west. Power is along the east side of the land on County Road 37. For these reasons we feel the site would make a nice spot for a country home. 7. Set back requirements. Propoed Lot, The shape of the land is triangular with sides of about 325' and 525' and the longest side being on the ditch. This will enable a house or structures to be placed on the parcel within the minimal setback requirements per the zoning. There are no existing structures on the proposed lot. 8. Conservation Easement. The applicant is not willing to place a conservation easement on the property. 9. Building Envelope. A building envelope on the proposed lots shall be, if required, established to ensure the required setbacks from the county roads and existing ditch. 10. This proposal is consistent with the Weld County Comprehensive plan in that it would put the land to its highest and best use. The land, proposed lot, is not suitable for farming using modern techniques,but would make a suitable homesite with a very small impact on productive farming lands in the county. 11. The proposed use would be compatible with the existing land uses in that the land in the area is being used primary for agricultural and secondary for rural homes. This proposal will help meet a growing demand of rural homesites in the area, and would not impact the existing agricultural use of the surrounding land in any nominal way. 12. The proposal is consistent with the intent of the district it is located within, in that, it would put the land into productive use and it would not interfere with the current agricultural use of the land in the area. The proposal makes sense because the land, proposed lot, is not able to be farmed and has little to no commercial or retail value. It would remove none ogf the the exsisting irrigated farm land on the extsisting parcel. The land does have power and household water available to the proposed lot. This proposal is consistent with the concept of highest and best use of the land. The proposal would keep the larger acre tract under its current agricultural use. 13.
