M., Weld County, CO. Dear Commissioners: This is a second request for a recorded exemption submitted by Craig A. Lindberg. The first request was submitted May 11, 1995. The parcel of land under consideration is described as Lot A of RE-1015 being in the E2, SW4 of Section 32, T3N, R68W of the 6th P. M., Weld county, CO. The property is located north of and adjacent to Weld county road 26 and east of an adjacent to Union Reservoir. RE-188 approved by the Board of County Commissioners, Oct. 29, 1975 created two lots of 225 acres and one acres, more or less. RE-1015, approved by the Department of Planning Services staff June 9th, 1987 further divided parcel be of RE-188 into to parcels of 222 and five acres, more or less, creating two additional lots. The applicant is now requesting to further subdivide Lot A of RE-1015 into two parcels of 2.4 acres and three acres, more or less. The land has no existing improvements on it and has been planted in row crop. The site lies within the Urban Growth Boundary of the City of Longmont and the Town of Mead. The Mixed Use Development Area lies directly south of the proposed recorded exemption. One access is to be provided for both lots from Weld County Road 26. Longs Peak Water District is the proposed water source. Longs Peak Water District has indicated that the I, the applicant, will need to make significant improvements to the system in order to provide service to the property. Septic systems are proposed for sewage disposal on both sites. In 1987 Longs Peak Water District promised a Water Tap to my property. At that time I also applied for a Septic Permit and upon completion of the soils analysis it was approved. I also had a home designed and the foundation engineered. Unfortunately some personal problems halted my plans for a new home. I knew that water taps were precious and I promptly attempted to purchase the water tap in order to preserve my rights to it. I was informed that"there would be no need to pay for it now. Once the Long's Peak Water Board approved a water tap for you, they will always make it available to you. If you paid for it now you would have to pay monthly charges on a water tap that you would not even be using. So just wait until you need it." I said "are you sure? I have no problem paying for the tap right now." I was assured to wait until I actually needed the water tap. I have waited 13 years for Longs Peak Water District and I have heard every story and excuse that exists. I have also endured the City of Longmont's aggression towards anyone attempting to improve the property around Union Reservoir. As you are already aware the City of Longmont states that they plan to"possibly"expand the reservoir. In my possession are potential plans from the City of Longmont to have an amusement park and a water park on my property! Further investigation pointed to the possibility that the City of Longmont never intends to actually expand the reservoir. What I surmise is that they really just want to secure land for open space and public recreation. According to sources that I deemed reliable and experienced in the matter, I was educated to how the'filing for expansion rights'was really only for the purpose of preventing another city or governing body from outside of the immediate area from filing for those rights. These information sources were City of Longmont employees in upper management positions and also attorneys familiar in Water law'. If my memory serves me right, it was the City of Thornton that was filing for and buying water rights outside of their area at that time. If any of you would like to see the plans for the amusement park that the City of Longmont bought and paid for I would be glad to provide them to you. What really bothers me to how the City of Longmont attempts to influence other goveming bodies towards making decisions that are favorable to Longmont's needs and wants. I am sure that most governing bodies try to be a -330 good neighbors, but I hate to see individuals get damaged or hurt by such rulings and decisions. In my opinion dividing this parcel Into two lots would improve the use of this land and is a very reasonable request. It is has pretty much been 'dry farmed" for many or its years and produces more in noxious weeds than useable crops. Being able to irrigate will produce a better enviroment. The City of Longmont has bought the property/farm that surrounds my acreage. I am confident that all of the property that Longmont has bought will never become a housing development. So in my opinion having these parcels of two to three acres each in the middle of hundreds of acres of open space would be a great use and fits everyone's guidelines. I probably should remind you that my original intentions were to start a tree farm and build my home. Thirteen years have now past and still I have no trees planted on this property. I would like to make sure that you know that not only has Longs Peak Water District denied me my 'promised' water tap, but you should also know that I have requested from the City of Longmont permission to pump enough water from the reservoir to keep my proposed tree farm alive. I informed them that I have some shares of water to my property but that I can only access that water when the water is being called for from the surrounding farm that the City now owns. The City of Longmont refused my request. So therefore my land still sets producing very little to the environment or to the public. I have endured many trials and tribulations in my life these past 13 years and one of the highlights in my life was meeting a man named Wendell Morey. Mr. "Morey" helped me in 1979 and as a result he and his wife Dorothy took ownership of 35 percent of this property. I am sorry to say that Mr. Morey has recently passed away and I will miss him very much as I am sure many, many others will miss him also. Mr. Morey helped many people over the years financially, spiritually and emotionally. I was so hoping that his investment in this property could have been returned before his death. Now I can only hope that I can help repay this emotional debt I have to Mr. Morey's widow, Dorothy. Dividing this parcel into two parcels will not only help in getting domestic water to my property but also greatly Increase the likelihood of my been able to sell one parcel so that Mrs. Dorothy Morey may be paid for this long-awaited investment. I respectfully resubmit this application and hope that the members of this Board can arrive at a favorable decision.
