Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. In accordance with Weld County Public Works Ordinance #180, Lot A and B shall be granted one
residential/agricultural access. Lots A and B shall utilize the existing residential /agricultural access points.
No circle drives or additional accesses shall be granted. The access will be placed in such a location to
have adequate sight distance in both directions and not below the crest of a hill or where physical
obstructions are present. These roads will be graded and drained to provide all weather access.

B. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger
culvert, please contact the Public Works Department to adequately size your culvert.
C. The applicant shall meet the requirements of the Weld County School District RE-5J as stated in a referral
response received March 30, 2000.
D. The plat shall indicate setbacks from existing the existing tank battery and wellhead on the property. No
building or structure as defined and limited to those occupancies listed as Groups A,B,E,H,I,M and R in
Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank
battery or 150-foot radius of any wellhead. Any construction wihin a 200-foot radius of any tank battery or
150-foot radius of any wellhead shall require a variance from the terms of this ordinance in accordance with
Section 61.3.
-E. The applicant shall submit evidence from the Little Thompson Water District indicating that they have
sufficient capacity and are able to serve Lot B of this recorded exemption.
E. The applicant shall provide evidence to the Department of Planning Services that an access permit from
the Colorado Department of Transportation was granted for access to State Highwayl7or evidence that
the applicant has complied with the requirements of the Colorado Department of Transportation.
4. The applicant shall contact the oil and gas company to obtain, in writing, permission to utilize their access
road for residential access.
K The applicant shall provide the Department of Planning Services with a certificate from the County
Treasurer showing no delinquent taxes for the original parcel (mother parcel) area.
I. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the
future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) All construction or improvements occurring in the flood plain as delineated on FEMA Community
Panel Map 080266-0750C dated September 28, 1982, shall comply with the Flood Hazard Overlay
District requirements of Section 26 of the Weld County Zoning Ordinance.
4) The installation of any septic system within the 100-year flood plain shall comply with the Weld
County I.S.D.S. flood plain policy. In accordance with the Colorado I.S.D.S. Regulations, no septic
systems shall be installed within the floodway.
5) Prior to the issuance of building permits on Lots A or B of the recorded exemption, the applicant for
the building permit shall be required to submit to the Department of Planning Services,evidence that
the lots have an adequate water supply of sufficient quality, quantity and dependability.
6) Prior to the release of building permits on Lot A or B, the applicant will be required to submit a
recorded deed describing the lot upon which the building permit is requested with the building permit
application. The legal description on such deed shall include the lot and recorded exemption
number.
7) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.
8) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in the United States. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; dust from
animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning; flies and Mosquitoes; the use of pesticides and fertilizers in the
fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of
the way" of residential development without threatening the efficient delivery of irrigation to fields
which is essential to farm production.

Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)
with more than 3,700 miles of state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is based on
responses to complaints more than on patrols of the county and the distances which must be
traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not provide the same
kind of surface expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works or may be the private
responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and
livestock present real threats to children. Controlling children's activities is important, not only for
their safety, but also for the protection of the farmer's livelihood.
3. Prior to demolition of structures:
a. The applicant shall obtain any required demolition permits from the Weld County Building Inspection
Department and conduct any asbestos related inspections as required by Regulation 8 of the Colorado Air
Quality Commission.
4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
fees.
5. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should the
applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, this case will be
forwarded to the Board of County Commissioners with a recommendations for denial.

Dear Ken:
Thank you for referring the Darrell and Christina Felton Recorded Exemption to the School District. The projected student
impact upon the St. Vrain Valley School District of 1 new single family unit on 40 acres is a total of 1 student. Any students
living in this subdivision would attend Mead Elementary School, Mead Middle, and Skyline High School under the present
school boundaries. However, due to potential growth in these schools this development and other existing developments in
this feeder could be placed in another attendance area in the future. Bus transportation would likely be required.

The District is on record as not opposing growth so long as the growth is planned and is manageable from a student enrollment
stand point. While the high school currently has a small amount of capacity,this development would impact the elementary
school and possibly the middle school which are currently overcrowded. In addition,there are other approved developments
in these attendance areas which would, together with this proposal, have a significant cumulative impact on these schools.
As the volume of developments increases in this attendance area with no alleviation of the existing overcrowded conditions,
the ability to provide the same quality education for these new students that is provided students in other areas becomes
increasingly difficult. Therefore, the District would oppose this development because it adds to the enrollment of an already
overcrowded school. Should this proposal be considered for approval, the District would request the cooperation and
participation of the developer and County in working to'wads mitigating the impacts on the schools. This mitigation would
include the calculation and payment of an appropriate cash in-lieu of land dedication fee to address the capacity concerns and
the need for future school sites(per the attached chart). This fee would need to be paid prior to recording the plat. Please let

SUPPORTING STATEMENT FOR
RECORDED EXEMPTION APPLICATION OF
BRENT J. EATON AND BECKY LYNN EATON
The subject 80 acre parcel,being the N'/2NWY<of Section 24-67, is presently used sparingly for dry
land farming. The property is not at all productive, and it is particularly difficult to farm those areas
which may be farmable, due to the terrain and the slope of the property. The property has been in
the Wagner Family for many years, and is presently owned by Beck Lynn Eaton's grandparents,
Henry and Pauline Wagner. Brent and Becky Eaton have received an option from Mr. and
Mrs. Wagner for their purchase of the smaller lot, if the recorded exemption is approved. The
Applicants will be able to provide care and assistance to her grandparents who continue to live on
nearby property.
It is estimated that the farmable acreage in the 80 acre parcel is \t acres. There exists on
the 80 acres a roadway which enters onto Highway 257, oil well production facilities and storage
facilities and the property is in part divided by the St. Vrain River.
The reason for the proposed recorded exemption is that Brent and Becky Eaton wish to reside on the
historic family property, developing an approximate ten acre parcel into a home site on that
homesteaded property. The existing home and other structures on the property were ruined by a fire
many years ago and should in fact be razed. In replacement thereof, Mr. and Mrs. Eaton wish to
construct their home and utilize the additional portion of the ten acres for livestock grazing purposes.
The 80 acre tract is immediately east of the Mad Russian Restaurant and Golf Course and the
residential lots which are being developed as part of the Mad Russian Project. Highway 257 divides
the subject property from the Mad Russian Development. The site does have an existing road which
has been utilized for many years,exiting from Highway 257 to the homes which existed there as well
as to the remainder of the acreage in the area. The subject site has a particularly good view of the
mountain range, as it sits somewhat higher than the Mad Russian Project property. This is an added
feature of attractiveness to the development of the property as the home site for the Eatons. The
proposed home site and any additional structures which may at some point be built in conjunction
with the home site, will of course meet the minimum setback and off-set requirements for the zoned
district, as it is planned that the building site will consist of no less than ten acres. Such is believed
to be certainly ample for the setback requirements. The applicant is presently not willing to place
a conservation easement on the property in order to maintain farm production or open space.
The smaller acreage (consisting of approximately ten acres more or less) will be utilized as the
building site for the Eatons' home. The Applicants' proposal is not inconsistent with the Weld
County Comprehensive Plan in that it does not take productive agricultural property out of
agricultural use, but, rather, serves to make greater and more productive use of the ten acre lot as a
home site bordering Highway 257. Further,the existing, dilapidated structures on the property will
be razed and removed, thereby enhancing the tax base of the property as well as the appearance of
the general neighborhood. The Applicant's proposal is also not inconsistent with the development
or comprehensive plans of Milliken and Johnston, as such municipalities have already approved
•
other development of much smaller lots for single family residences,being located immediately west
of the subject site, across Highway 257.
The proposed use of the two lots will be compatible with surrounding uses, as there are a number
of dry land and grazing properties nearby, as well as a number of single family residences on much
smaller lots. The approximate ten acre site will be utilized by the Eatons as their home site, with
perhaps other out buildings supporting their use of the land, and the larger lot will continue to be
utilized as in the past, for dryland farming and grazing purposes. The two lots will continue to
utilize a single access route off of Highway 257, which access route has been in use for many years.
The Applicants' proposal is not inconsistent with the intent of the district in which it is located as
expressed in the Weld County Zoning Ordinance and the Weld County Comprehensive Plan, in that
it contemplates the use of the lots as continued agricultural property, with the smaller ten acre lot as
a single family home site together with the remaining utilized as a grazing area for livestock. This
is consistent with the agricultural zoning of the entire parcel and is also compatible with the
surrounding uses and long-term county comprehensive plan.
The proposal is consistent with efficient and orderly development as defined in the Weld County
Subdivision Ordinance, in that any new construction will not require a new access road from
Highway 257, and yet will be construction right along an existing and very sound public access
route. The welfare of the residents of the county, and the county as a whole, will be benefitted in
that the tax base will be increased and the beneficial use of the ten acres will arise. The planned
subdivision plans of the county and Milliken and Johnston will not be adversely affected. because
the parcel has previously been utilized as a home site (even though the buildings are now
dilapidated) and it is not contemplated that the remaining acreage consisting of the larger lot will
ever be built upon. The overall benefit to the Applicants, the Wagners, the County and the nearby
municipalities,as well as the residents in the area,will be enhanced because of the fact that there will
be persons living directly on site, will be better able to address the various concerns about weeds,
maintenance of the natural beauty of the area, and the natural enhancement of the beauty and use of
the area. The parcel presently has no irrigation water, so the water use or water supply will not be
adversely affected. The presence of the Eatons upon the parcel will also serve to help control
erosion, sedimentation and possible pollution of the subsurface water, in that they will be able to be
present and monitor any such occurrences. The location of the anticipated home site for the Eatons
should not create any difficulty for flood damage concern, and will all be far from landslides, mud
flows or other geologic hazards. There is adequate space near the parcel for any anticipated schools
or parks which might in the distant future become necessary. Presumably, the Mad Russian
Development immediately west of the parcel has created its own plans for parks and schools and
other open space if deemed necessary.

The Weld County Public Works Department has reviewed this project; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 48.5 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-
way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant
to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
REQUIREMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any
additional requirements that may be needed to obtain or upgrade the permit. (Lots A; St. Hwy. 257)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No
additional accesses shall be granted. (Lot B)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.
The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their access

1. A Weld County Septic Permit is required for the proposed home septic system(s) and shall
be installed according to the Weld County Individual Sewage Disposal Regulations.
2. The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S.flood plain policy(attached). In accordance with the Colorado I.S.D.S.
Regulations, no septic systems shall be installed within the floodway.
3. The applicant shall obtain any required demolition permits from the Weld County Building

T have briefly reviewed the above-described referral and have the following comments:
The property is within 400' of a Town of Milliken Sanitary Sewer Main,such being the force main from the lift
station in the Mad Russian area,
The property is adjacent to a segment of the Town of Milliken 16"Potable Water Transmission that is designed
to ultimately serve this general area including the specific subject site.
A large part of the property is located within the Big Thompson River Floodplain.
Access to the property is proposed to be via ST-1 257, which in this vicinity could pose safety issues unless
traffic impacts are mitigated.
I suggest the applicant meet with Town staff through it's Technical Review Committee process prior to further
action with Weld County to discuss the availability of Town services which may trigger a review for the
possibility of an annexation of this site.

Permission To Use Access Road

I, Henry C. Wagner and I, Pauline Wagner, sole owner of the 80 acre
parcel containing the pre-existing access road located (land discription)
North 1/2, Northwest 1/4 of section 2, Township 4 North, Range 67 West of
the 6th P.M. in Weld County, Colorado. (The pre-existing access road was
developed back in the early1960s. )
Previous permission has been granted to Southwestern Production
Corporation, Blue Chip Oil, Incorporated and Associated Natural Gas,
Incorporated to utilize the access road to service their facilities.
At this time I am granting permission to Brent J. Eaton and
Becky L. Eaton to utlilize the formentioned access road for a residential
access to their single family home development.

OPTION
THIS OPTION, made and entered into this a(r�h day of JUt 1 UCir , 2000, is by
and between Henry C. Wagner and Pauline Wagner (Sellers) and Brent J. Eaton and Becky Lynn
Eaton(Buyers).
WHEREAS, Sellers are the owners of certain real property described as the N'/:NW'/ of
Section 2, Township 4 North, Range 67 West of the 6th P.M. in Weld County, Colorado; and,
WHEREAS, Buyers wish to obtain an option to purchase the above described real property
from the Sellers; and,
WHEREAS, Sellers wish to enter into an option whereby Buyers have the exclusive, non-
assignable option to purchase the above described real property from Sellers under certain terms and
conditions.
NOW, THEREFORE, the parties hereto agree as follows:
1. The foregoing recitals are incorporated herein fully by this reference.
2. In exchange for $10 and other good and valuable consideration, the receipt and
sufficiency of which are hereby confessed and acknowledged, Sellers hereby grant and convey to
Buyers the exclusive,non-assignable option to purchase from Sellers a ten acre tract in the aforesaid
Ni/:NW'/ in exchange for a payment of$1,000.
3. The Buyers' ability to exercise this option shall be expressly contingent upon Buyer's
obtaining a recorded exemption from Weld County, Colorado for the said ten acre tract (plus or
minus) which ten acre tract shall be located in the NW corner of the said N%ZNW1/4 of said Property.
4. The said recorded exemption shall be obtained no later than May 1, 2000, and if the
said recorded exemption has not been obtained by that date, then this option shall expire and no
longer be enforceable.
5. Further,if this option is not exercised by the Buyers by May 1,2000,then this option
shall lapse and terminate, and Seller shall be entitled to retain all things of value hereunder.
6. This option shall be construed under the laws of the State of Colorado and shall inure
to the benefit of and be binding upon the parties hereto and their respective, successors and assigns.

This letter is in response to your request for a water service
commitment for 1 residential lot, in the proposed Recorded
Exemption in the location described as follows :
N 1/2,NW 1/4, SEC.2 , T4N, R67W -- WELD COUNTY, CO
The District provides water service within its service area as
defined by the District . The provision of water service by
extension of existing water lines of the District to the above
property and the installation of taps for lots is done under the
terms of the Rules and Regulations of the District established by
the Board of the District from time to time . You may obtain a copy
of the Rules and Regulations fron the District . This letter
outlines the povisions of the Rules and Regulations, however this
letter does not change any provisions of the Rules and Regulatuons .
The Board of the District may alter and amend the Rules and
Regulations at any time, and the provisions of this letter are
subject to alteration and amendment based on changes in the Rules
and Regulations of the District .
we currently have a 2" Dia. water line, located along the
Railroad Tracks South of the River and East of the tracks that
serves the Wagner tap at 23646 S . uwl 257, with additional capacity
available Therefore, we can commit to provide service to the above
property, subject to the limitations in this letter, for one
standard residential 5/8" X 3/4" water tap; and the following
additional limitations on the provision of water service are :

1 . In August of 1993 the Little Thompson Board implemented
a "system impact" fee of $:050 per lot for all lots to be
added to the system. This is due upon application for the tap.
2 . All improvements to District facilities required to
provide service will be the financial responsibility of the
developer in accordance with the District Rules and
Regulations . All improvements must conform to District
Specifications .
3 . You will be responsible for running your own water line
to the proposed lot A.
4 . As an option you could install a minimum 6" Dia. Water
line along Hwy 257 from just South of the Mad Russian entrance
to your property. This line would be built for the District
and maintained by the District . It is possible that the cost
of this 6" Dia. Line would be less than you crossing the Big
Thompson river and running a mile of your own service line.
This commitment letter will expire one year from the date of
this letter if the tap has not been purchased, paid for and
installed by that date of expiration. The current fee for the
domestic 5/8" X 3/4" tap is 17, 000 . 00 . YOU ARE HERESY ADVISED THAT
THE RULES, REGULATIONS AND TARIFFS OF THE DISTRICT ARE SUBJECT TO
CHANGE WITHOUT NOTICE; AND THIS LETTER IS ISSUED WITH THE SPECIFIC
LIMITATION THAT THE DISTRICT MAY CHANGE THE RULES, REGULATIONS AND
TARIFFS APPLICABLE TO THE ABOVE PROPERTY AT ANY TIME WITHOUT NOTICE
