RE: APPROVAL OF RECORDED EXEMPTION NO. 502 - FLOYD AND DOROTHY
MARTIN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 29th day of July, 1981 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 502 , being the property of Floyd and Dorothy Martin,
described as part of Section 18, Township 1 North, Range 65 West,
of the 6th P. M. , Weld County, Colorado, being more particularly
described as follows:

A part of the NW' of Section 18, T1N, R65W, of the 6th P. M. ,
County of Weld, State of Colorado, more particularly described
as follows:
Commencing at the NW corner of the said NWa of Section 18; thence

of Beginning also being a point on the East right of way line of

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-18-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that the particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA (3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Floyd and Dorothy Martin, and hereby is,
exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of
July, A. D. , 1981.

Re: Recorded Exemption #502
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Floyd and Dorothy Martin for a recorded exemption. The
parcel of land on which this request has been made is described as part
of the N1, Section 18, T1N, R65W of the 6th P.M. , Weld County, Colorado.
This property is located three miles north of Lochbuie. The property
Contains approximately 180 acres of Class IV and VI nonirrigated soils.
The request is to split the property into parcels of 2.24 acres and
177.76 acres.
The Martin's wish to convey the smaller tract to their son to constuct a
home. The property is generally nonirrigated pasture as is most adjoining
property. West and south and southwest from the property are several
nonconforming subdivisions which have been platted since the middle to
late 1960's.
Based upon the submitted information, referral responses and County
policies, the Department of Planning Service's staff recommends approval
for the following reasons:
1. The proposal appears to be consistent with the intent of the
Recorded Exemption procedure in that the property consists
largely of nonirrigated lands of low productivity which can
inpart be utilized as a second family residence. Furthermore,
the second residence would not appear to be incompatible with
existing uses in the area;
2. While not directly consistent with the Comprehensive Plan
policies regarding residential useage, the home is to be
occupied by a family member who can assist part-time with the
upkeep of the property. Further, based upon State Engineer
comments, further well permits on the property are highly
unlikely meaning that any further development potential is
extremely limited; and

Subdivision regulations.

Re: Martin Exemption (RE-502)
Dear Mr. Honn:
We have received the Martin Exemption proposal. This proposal
would split a 2.2498 acre parcel from a tract of approximately 180
acres. The larger tract has a well which would predate registration
requirements. A domestic well permit (#113701 ) has been issued as the
only well on a tract of 40 acres. This well would serve the small parcel ,
and a tract of land including a strip along the north side of the section
and a portion of the NWT NEB. of the same section are shown on the permit
as being the tract of land committed by the well permit.
While we can recommend approval of this proposal , we would ask the
county to note that no additional well permits will be issued on the piece
of land committed by this permit and that this may restrict future use of
the land.
