The Weld County Council met in regular session in full conformity with the Weld County
Home Rule Charter at Weld Centennial Center, 915 10th Street, Greeley, CO, Tuesday,
September 19, 2000, 6:30 p.m.
ROLL CALL: The meeting was called to order by Vice President Dwaine Kurtz.
President Al Roberts was excused. Councilman Mitchell Martin, Councilman Dan Oster
were present constituting a quorum of the members. Councilwoman Joyce Smod
arrived at 6:45 p.m. Also present: County Attorney Bruce Barker, Linda Gustin, Gloria
Callow, Beverlee Dabney, Bill Hopkins, Cynthia Loftus, Steve Moreno, and the Coanc:il
secretary, Bev Thomas.
PRESENTATION BY EMPLOYEES OF DEPARTMENT OF MOTOR VEHICLES:
Employees of the Department of Motor Vehicles including Beverlee Dabney, Cynthia
Loftus, and Linda Gustin presented their concerns and questions to the Weld County
Council. Topics covered included questions and comments about their salaries;
reevaluation request of their salaries; $8,000 salary increase for the County
Commissioners; points in support of increased salaries for Department of Motor
Vehicles' employees; problems retaining employees due to low salaries: cost of training
employees only to lose them due to low pay scale; the stress and challenges inherent
to work at the Department of Motor Vehicles; increasing work load and knowledge bas,
required to work at the Department of Motor Vehicles; problems due to inexperienced
staff and lack of trained staff; December 1999 Management and Organizational St ady
of the Weld Ccunty Clerk and Recorder's Office by Organizational Development
Services; concern that no personnel are in training for when another Weld Motor
Vehicles office is opened and that employees working in Greeley may have to commit=
to south east Weld County to man the new office; request for guidance for their etc ctec
ofrcial; request for guidance as to "where to go` with their concerns.
Councilwoman Joyce Smock asked the Department of Motor Vehicles employees
where they had previously presented their concerns. Ms. Dabney said that they had
talked to the elected official of their department and to the Weld County Personnel
Department. She said that they thought coming to the Weld County Council was tie
next step. Councilwoman Joyce Smock recommended that the employees go directl .v
to the Board of County Commissioners with their concerns.
Councilman Mitchell Martin made a motion that the Council request the Board of
County Commissioners -eview the salaries and the staffing of the Clerk and Recorder s
Office. Councilman Dan Oster seconded the motion.

Vice President Dwaine Kurtz said that he would vote against the motion because he
didn't think the motion fell within the guidelines of the County Council's authority.
Councilman Dan Oster requested an opinion from the County Attorney Bruce Barker
about whether the motion over stepped the boundaries of the Council's authority.
Bruce Barker spoke to the Council about the parameters of the Council's -esponsibil t, .
The motion carried unanimously with a roll call vote.
Open Meetings
County Attorney Bruce Barker asked to present to the Council regarding his Septemc ,r
19, 2000-memo to the Council regarding open meetings. He reiterated that his
interpretation of Colorado Revised Statutes and the Weld County Home Rule Charter s
there are only two reasons the Council can meet in an executive session: to take lec H
advice or to deal with personnel issues related to staff employed by the Council
APPROVAL OF MINUTES: Councilman Dan Oster made a motion that the August �.
2000 Council minutes be approved as printed. Councilman Mitchell Martin seconded
the motion and it carried.
APPOINTMENTS: Vice President Dwaine Kurtz and Councilman Mitchell Martin wil ire
attending the September 25, 2000 Elected Officials' Meeting/Luncheon.
October/November 2000 Council Meeting Details
Councilman Mitchell Martin reviewed the details of the October 17, 2000 Council
meeting to be held in Ft. Lupton. Vice President Dwaine Kurtz will be inviting
Commissioner Barbara Kirkmeyer to be the speaker at the November 2000 Council
meeting to review county government before she retires from office.
COORDINATOR REPORTS:
Councilman Dan Oster - Canadian Thistle
Councilman Dan Oster reported that he had visited with Mr. Broda who is in charge of
the pest and weeds component of the Public Works Department. Councilman Oster
explained the procedures of Mr. Broda's program and the limits of staffing and supplies
to control eight species of noxious weeds along 6600 miles (both sides of 3300 miles of
county roads.) Councilman Dan Oster also reviewed policy with Mr. Broda regarding
letters Weld County sends to landowners regarding controlling noxious weeds on
private property. Councilman Dan Oster and Councilwoman Joyce Smock noted the
willingness of Mr. Broda and Mr. Frank Hempen to visit with the Weld County Council

Councilman Mitchell Martin and Vice President Dwaine Kurtz reported on the pants a'
discussion at the September 11 , 2000 Elected Officials' Meetings. Topics included
were: County Assessor Stan Session having to prepare as if every Kodak. assessment

will be challenged in court and the budget implications of that; new policy of the county
is that both sides of a road will be paved when paving by developer is necessary; status
of the new south east county office.
UNFINISHED BUSINESS:
Commissioners' Salaries for Years 2003 & 2004
Council members shared opinions regarding Commissioners' salaries reported to them
by Weld County citizens. The demands of the job and qualifications of County
Commissioners were discussed. Weld County citizen Bill Hopkins urged the Council to
vote on the side of generosity in the Commissioners' salaries as he felt there would be
great return on the investment.
The timing of the final vote for the salaries was discussed. Councilman Mitchell Martin
pointed out that he would not be on the Council after the November 7 h General Eiecrion
to participate in the salary-setting process since he is not on the ballot to continue as
Council person from District 3.
Councilman Mitchell Martin made a motion that the Board of County Commissioners
salary for the year 2003 be increased 5 percent over the salary for 2002, and the salary
for the year 2004 be increased 5 percent over the salary of 2003. Therefore, the salary
for the Board of County Commissioners' for the year 2003 will be $58,800. and for the
year 2004 will be $61 ,740. Vice President Dwaine Kurtz seconded the motion for
purpose of discussion. The motion was defeated with the following vote: Councilman
Vice President Dwaine Kurtz, Councilman Dan Oster, and Councilman Joyce Smock
voted no. Mitchell Martin voted yes.
Councilman Dan Oster made a motion that the Board of County Commissioners' salary
for the year 2003 and 2004 be $56,000. The motion died for lack of a second.
Councilman Joyce Smock made a motion that the Board of County Commissioners'
salary for the year 2003 will be $58,000 and for 2004 will be $60,000. Vice President
Dwaine Kurtz seconded the motion for the purpose of discussion. The motion failed
with only Councilman Joyce Smock voting yes.
Vice President Dwaine Kurtz made a motion that the Board of County Commissioners
salary for the year 2003 and 2004 be $60,000. Councilman Mitchell Martin seconded
the motion. The motion failed with the following vote. Vice President Dwaine Kurtz and
Councilman Mitchell Martin voted yes. Councilman Dan Oster and Councilman Joyc:;
Smock voted no.
Councilman Mitchell Martin made a motion that the Board of County Commissioners'
salary for the year 2003 will be $59,000 and for 2004 will be $61,000. Vice President

Dwaine Kurtz seconded the motion. The motion carried with a roll call vote. Vice
President Dwaine Kurtz, Councilman Mitchell Martin, and Councilwoman Joyce Smock
voted yes. Councilman Dan Oster voted no.
NEW BUSINESS:
Data Processing Requests Due
The Council had no data processing requests for the year 2001 .
Payment of Bills
Councilman Dan Oster made a motion that the bills be paid as follows:
Mileage for Councilman Mitchell Martin $32.94
Mileage for Councilman Oster $42.70
Mileage for Councilwoman Joyce Smock $36.60
Johnstown Breeze Subscription $20.00
Councilman Joyce Smock seconded the motion and it carried.
ADJOURNMENT: The meeting was adjourned at 9:20 p.m.
