WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public meeting on the 11th day of August, 1980 at the hour of 9 : 00 o'clock a.m. for the purpose of hearing the application of Eugene and Margie Yates for a Conditional Use Permit for a single family residence on the following described real estate, to-wit: A tract of land being the EzNE4 Section 30, Township 11 North, Range 66 West, 6th P.M. , except a tract of land as described at Recep- tion No. 1812099, Weld County Records, Weld County, Colorado being more particularly described as : Considering the North line said Section 30 to bear S. 89°40 ' 06" E. , and all other bear- ings contained herein being relative thereto: Beginning at the Ea Corner said Section 30; thence, N. 89°38 ' 24" W. , 1319. 55 feet to the SW Corner E#NE4 said Section 30; thence, N. 00°23 ' 04" E. , 2636. 54 feet to the NE Corner NWgNE¢ said Section 30; thence, S. 89°40 ' 06" E. , 957 . 23 feet along the North line said Section 30; thence, S . 00°21 ' 59" W. , 361 . 50 feet; thence, S . 89°40' 06" E. , 361. 50 feet to a point on the East line EIINE4 said Section 30; thence, S. 00°21 ' 59" W. , 2275 . 68 feet to the point of beginning. The above described tract contains 76. 853 acres , more or less including rights-of-way reserved for County Road purposes along a portion of the North line said Section 30 and is subject to any easments and/or rights- of-way of record or as now exists on said tract. WHEREAS, the petitioners were present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a single family residence, and WHEREAS , Section 3. 3 .D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural Zone District upon approval of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioners and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully in- formed, is satisfied that the request for a Conditional Use Permit for a single family residence on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3 .D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Eugene and Margie Yates for a Conditional Use Permit for a single family residence on the hereinabove described tract of land be, and here- by is, granted subject to the following: 1. The Development Standards contained in the Conditional Use Permit; 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the attached Development Standards for the Conditional Use Permit have been placed on the Conditional Use Permit Plat and said Plat has been delivered to the Office of the Department of Planning Services. This soil is moderately to severely limited for use as septic tank filter fields due to the slope and moderately rapid permeability which does not produce =_noggh fines in subsoil material to effectively filter effluents, which could .... cause ground water contamination. The Eaverson soil is subject to -periodic flooding, as is the floodplain soil -of the tittle Owl Creek. For this reason, it is severely limited? for use as a hornesite and septic tank filter ₹ield. The proposed improvement area is located on what appears to be Ascalon fine san-dy loam and Olney fine -sandy loam soils. Both soils have characteristics that _are compatible with intended uses. Both s-oils do have -moderate wind blowing hazard. Site preparation Tor construction should be limited, if possible, to lessen the wind - - soSl erosion potential . I can see no further concerns.
