Dear Ms. Chester:
The comments and concerns outlined in my letter of October 20, 1999 are still valid and have not been
addressed. Of particular importance is the presence of shallow ground water. Additional ground water
monitoring had not been submitted and it is not clear whether or not basements can be constructed at the site.
The gcotechnical engineer recommends that basements he set above the seasonal high ground water levels. In
addition,the engineer recommends that perimeter drains be installed around below grade areas. This is a
prudent recommendation, however, perimeter drains and sump pumps arc not intended to lower overall ground
water levels and such systems can fail over the life of the structure causing hooding of below grade areas. It
would he prudent for the county to either require no below grade construction or to determine the seasonal high
ground water levels and whether or not basement construction is feasible without area or interceptor drain
systems or the placement of additional fill.
The presence of.shallow ground water requires that septic systems be engineered and may require the use of
mounded systems. Without the additional ground water monitoring, the county should require that a registered
professional engineer design all septic systems.
The Colorado Geological Survey cannot recommend approval of the plat without addressing outstanding issues.

The Weld County Public Works Department has reviewed this PUD Final Plan request.
COMMENTS:
Plat: Sight distance triangles shall be shown on the plat with a note restricting the height of landscaping. Wetlands are
normally outside of lots. Several lots have wetlands within the lot. How does the developer plan to protect these wetlands
after the lots have sold? The easement width shall be provided for the Warren irrigation easement. The access to several
lots shall be restricted. Please indicate the access restrictions on the plat. Label the right-of-way of all roadways. Widen
lot 50's access to 30 feet.
External Roadways: All off-site improvements will be constructed to CDOT requirements. All landscaping in the
intersection sight distance triangle must be less than 3.5 feet high at maturity. The developer must provide evidence that
the land owners west of State Highway 257 have agreed to the relocation of the ditch.
Internal Roadways: All PUD roadways are paved. A typical section will be required. In a development of this size,
pedestrian circulation must be addressed. The developer can provide a widened roadway section. The ADA requires a
ninimum of four feet on each side of the road. This area must be delineated from the traveled road. The entrance roads
will need to maintain the two percent cross slope for 20 feet beyond the state highway Right Of Way. Please indicate the
length of all tapers. The maximum grade in a subdivision is six percent; the minimum grade is 0.4 percent.
Storm Water: The drainage map was illegible. Per Section 10.12.4,the drainage map can have a maximum scale of one
inch to 200 feet. Detention sizing shall be based on Section 10.13.4. The drainage report was not reviewed. Please include
an erosion control plan. A 404 permit will be required for the wetland destruction. Please provide a copy of the permit to
the Public Works Department. The storm sewer system will be maintained by the Home-owner's Association.

RECOMMENDATION: Approval
DEVELOPMENT CONDITIONS (If Approved):
❑ A signing and striping plan shall be included in the roadway plans.
❑ Landscaping within the intersection sight distance triangle shall be less than 3.5 feet at maturity.
❑ The entrance grades shall be adjusted.
❑ The right-of-way shall be acquired for the State Highway 257 realignment.
❑ The drainage report shall be resubmitted to meet the requirements of the subdivision regulations.
❑ The storm sewer system will be maintained by the Home-owner's Association.
The plat shall be incorporating the requirement stated above.
❑ A provision shall be made for pedestrian circulation.

Dear Ms. Chester:
The Town of Windsor Planning Commission reviewed this request at its regular meeting of
October 5, 2000. The proposal is consistent with the Town's Land Use Plan map depiction
as the subject property is delineated as Very Low Density Single Family Residential.
However, the property is located outside the Town's Growth Management Area (GMA), as
well as being located outside the Urban Growth Boundary area as recognized by Weld
County. The Town of Windsor Comprehensive Plan states "The GMA is intended to define
those specific areas within the planning area where it is most logical to extend urban
services in the near term, that is, within the next five to ten years." The Plan further
discourages annexation of areas outside of the Town's GMA boundary. Therefore, since
the property is located outside the Town's GMA boundary and urban services will not likely
be available to the property in the near term, annexation is not recommended.
Therefore, based upon the aforementioned information, the Town of Windsor Planning
Commission recommends approval of the request to the Weld County Department of
Planning Services, subject to the following condition:
• The applicant shall provide evidence to the Weld County Department of Planning
Services that all conditions of the Windsor-Severance Fire Protection District have been
addressed to the District's satisfaction.

The Weld County Health Department has reviewed this proposal. A member of our staff has also
observed the site.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will
be provided by the North Weld County Water District and sewer will be provided by septic systems.
The proposed lot sizes (minimum of 1.5 acres) and the overall density of septic systems per acreage (1
per 3.42 acres) complies with Ordinance No. 197 and our Departmental policy.
The environmental impact plan provided in the application materials and required in section 6.3.1 of the
PUD Ordinance appears to address all potential impacts described in the Ordinance.
The Department still has concerns with issues relating to shallow groundwater and bedrock and the
suitability for septic systems. We have asked for the most recent groundwater monitoring results, and
understand that those will be forwarded. The concerns with groundwater and bedrock separation
appear to be adequately addressed, provided the applicant follows the conceptual grading plans
submitted previously.
The draft of the Environmental Management Handbook states that the septic tank will be pumped by a
`qualified firm'. This company should be licensed in Weld County. The Department requests the
opportunity to review and comment on the final draft of the Environmental Management Handbook.
The Department recommends approval with the following conditions:
1. The applicant shall obtain water service from the North Weld County Water District.
2. Primary and secondary septic system envelopes and a building envelope were not designated on
each lot. Septic system envelopes should meet the setback to the Eaton Ditch as well as other
required setbacks as described in the Weld County Individual Sewage Disposal System
Regulations
3. Language for the preservation and/or protection of the second absorption field envelope in the
development covenants. The covenants should state that activities such as landscaping (i.e.
planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are
expressly prohibited in the designated absorption field site.
4. Each septic system shall be designed for site-specific conditions, including but not limited to
maximum seasonal high groundwater, poor soils, and shallow bedrock.

conditions are not created. If dust emissions create nuisance conditions, at the request of the
Weld County Health Department, a fugitive dust control plan must be submitted.
7. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and practical
methods which are technologically feasible and economically reasonable in order to minimize dust
emissions.
a) If land development creates more than a 25 acre contiguous disturbance, or exceeds 6
months induration, the responsible party shall prepare a fugitive dust control plan, submit an
air pollution emissions notice, and apply for a permit from the Colorado Department of Public
Health and Environment.
8. The most current "Right to Farm" covenant shall be placed on the plat. '
9. The site grading plan as outlined in documentation from Northern Engineering Services, Inc.
(dated 4-14-00), and Paragon Consulting Group (dated 4-25-00) shall be followed.
Prior to recording the Plat:
1. The applicant shall submit a final copy of the Environmental Management Handbook for review
and comment by the Weld County Department of Public Health and Environment.

Dear Ms. Chester,
In reviewing the final plan for the Soaring Eagle P.U.D., it appears the developer has
answered some of our requests, but I would like to review some others. The Everitt company has
addressed the bus stop being placed within the subdivision which is favorable. It also appears
the have addressed the ingress and egress traffic flow from the sub division.
It is essential, street names in the new development, not duplicate any existing street names
within the county. Individual house addresses must be prominently displayed and readily visible
from the street. Overall design must provide prompt, easy access for emergency response
vehicles into the development, and from the streets to individual residences.
Open space is aesthetically pleasing. However fencing or some other barrier is necessary to
separate the irrigation pond to mitigate potential drowning of the children living in the area and
the need for subsequent search and rescue.
Now that the plans are in there final development, and seeing this sub division is quite large,
I would like to see the design include features that reduce speed, on the residential streets.
A last item of concern, are the general mitigation features, these include elimination of
barriers that prevent easy detection of potential offenders or a crime in progress.(landscaping, or
other physical obstacles blocking the view of the residence from the roadway.) These are a few
suggestions that would deter the residences from becoming a crime target

On February 7, 2000 this office responded to proposal to subdivide a 420-acre
parcel into 114 single-family residential lots. A copy of that letter is attached. The
information requested in that letter has yet to be received. Recently, this office recently
received what appears to be a final plat of the proposed development.
To respond to our statutory responsibilities, your agency is obligated to forward
the information needed so that the State Engineer can tender an opinion as to the
adequacy of the proposed water supply. In the absence of such information, pursuant to
Section 30-28-136(1)(h)(II), C.R.S., it is our opinion that sufficient evidence has not
been submitted documenting that the proposed water supply can be provided without
causing injury to existing water rights or that the proposed water supply is adequate.

We have reviewed the above referenced proposal to subdivide a 420-acre parcel into
114 single-family residential lots. The Water Supply Information Summary requested in the
State Engineer's memorandum of August 7, 1995 was not included and no other
information on projected water use was provided. In addition, the source of water supply is
to be the North Weld County Water District, however a letter of conpmitment was not
included in submitted materials. As outlined in 30-28-133(3), C.R.S:, the subdivider is
required to submit adequate evidence that a water supply that is sufficient in terms of
quality, quantity and dependability will be available to ensure an adequate supply of water.
The applicant has not provided adequate evidence to support this requirement.
Based upon the above and pursuant to Section 30-28-136(1 )(h)(Ill, it is our opinion
that sufficient evidence has not been submitted documenting that the proposed water
supply can be provided without causing injury to existing water rights or that the proposed
water supply is adequate.

1. Proper building permits shall be obtained prior to any construction, remodeling, demolition or
excavation.
2. Building permits are required for any accessory buildings being constructed or moved onto
property. Any accessory buildings containing livestock or poultry, shall be wired according to
Article 547 of the 1999 National Electrical Code (NEC).
3. Separate building permits are required for all monument signs, traffic signals, etc. Signs shall
adhere to Section 42 of the Weld County Zoning Ordinance and Section 2.8 of the Weld County
MUD Ordinance as applicable. Engineering may be required.
4. Separate electrical permits are required for electrical services and wiring to irrigation systems.
5. Engineered foundations are required for all primary residences and may be required for accessory
buildings. Engineered foundations shall be based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado licensed engineer. Any fill material shall contain no rock
or similar irreducible material with a maximum dimension greater than 12 inches. All fills shall be
compacted to a minimum of 90 percent of maximum density. Engineering reports shall be supplied
for all fill material.
6. All buildings or structures shall maintain distances from property lines and adjacent buildings as
outlined in Table 5-A of the 1997 Uniform Building Code.
7. Setbacks to oil and gas facilities shall be as required by The Weld County Zoning Ordinance.

8. Development documents shall be supplied to the appropriate fire district for their review. The fire
district may have additional requirements.
9. At the time an application is accepted for a building permit a plan review will be done. A complete
review of the building or structure by the Weld County Inspection Department or the Fire District
may reveal other building issues or areas needing attention.

The following conditions shall apply to the proposed Soaring Eagle Ranch PUD. The
Windsor-Severance Fire District requires a current overall all utility plan to be submitted
for review and approval prior to final plan approval. Listed below are some of the
conditions that will be placed on this development.
1. Minimum hydrant flows shall be 1000gpm for homes up to 3600sq. ft. and
anything larger than this shall comply with Table No. A-III-A-I. A reduction in
fire flow of 50% is allowed when the structures are sprinklered.
2. Hydrants shall be 300' from structures and 600' spacing maximum.
3. Water mains supplying hydrants shall be looped whenever possible and be a
minimum of 8" in diameter.
4. All hydrants shall be in place, tested and operational before any combustible
material is brought on-site.
5. All hydrants shall have (5) sided operating nuts on bonnet and caps. Left rotation-
operating nuts to open hydrants.
6. A water model or plan shall be submitted to the Windsor-Severance Fire District
for review and approval.
7. Cul-de-sacs over 600' in length must have a secondary access system in
accordance with NFPA-13D/R.
8. Cul-de-sacs shall have a minimum of 55' turning radius. A B-40 turning template
shall be used to determine adequate turning radiuses.
9. All roadways shall have an approved all weather driving surface capable of a
design wheel load of 18,000 lbs (80,000 lbs GVW) (H2o loading).
10. Current District street standards provide that streets 34' and greater can allow
parking on both sides of the street. Streets 28' in width will allow parking on one
side only with "NO PARKING FIRE LANE" signs posted on one side of the
street. All streets less than 28' shall prohibit parking on both sides of the street
with"NO PARKING FIRE LANE" signs on both sides of the street.

Ben, I have reviewed the above proposal and offer the following comments:
RIGHT-OF-WAY Projected traffic along this portion of State Highway(SH) 257 indicates the need
for a 150 foot total right-of-way(ROW), 75 feet either side of the highway centerline.
Additional width to meet the projected need should be protected by reservation or preferably,
dedication as permitted by County regulations.
ACCESS 1 have had an opportunity to meet with Stan Everitt of Everitt Companies, developers of the
proposal, on at least two occasions. We have agreed to many of the major issues regarding this
site, including access location and highway improvements. Design specifics are anticipated in
the near future.
Thank you for the opportunity to review the Soaring Eagle proposal. My comments are based upon the
submittal received on September 29, 1999.

Dear Mr. Patton:
Thank you for the submittal of plans for the above referenced PUD. The proposal is to create 114
residential lots on approximately 390 acres. Lots range from L75 to 15 acres. The site will he served by
public water and individual septic systems.
According to the NRCS "Soil Survey of Weld County, Colorado, Southern Part, 1980"the site is
primarily underlain by sandy to clay loam soils. The soils can be of low strength and can have a moderate
shrink-swell potential. The survey indicates that a section of the southern portion of the property is
subject to flooding.
According to the Colorado Geological Survey publication "Environmental and Engineering Geology of
the Windsor Study Area, Latimer and Weld Counties, Colorado"the soils overlie the Pierre Shale. This
' formation consists ofclaystone, siltstone and sandstone. Claystone can have very high swell potentials
and it will he important that construction take into the account bedrock elevations and swell potentials.
The publication also indicates that a portion of the southern part of the PhD is subject to flooding.
The preliminary geotechnical report done by Earth Engineering Consultants, Inc. and dated May 7, 1999
(with addendum dated June I, 1999) indicates that the primary geotechnical constraints to the
development are expansive bedrock, low strength soils, and shallow ground water. It will be important
that site-specific soils and foundation testing and design be done for each individual lot and that
foundations be designed accordingly. The testing for each lot should determine the depth to bedrock in
relationship to foundation and floor levels and ground water levels. Swell consolidation testing should
also be done for each lot near foundation and floor levels.

The report indicates that ground water levels are currently being monitored. It will be important that an
adequate number of locations are monitored and that monitoring occurs for a long enough period to
determine seasonal high ground water levels. The results of the monitoring may require that below grade
construction be prohibited or that area and/or interceptor drains be installed to lower ground water levels.
Installation of these drain systems will need to occur during development of the subdivision and cannot
be done on a lot by lot basis. The results of ground water monitoring should be submitted prior to
approval of the plat.. If drains systems are required, it would be prudent to require such systems be
included in subdivision construction plans.
The MID shows lots being located within areas of historic flooding. Detailed drainage plans were not
included with the submittal. It will be important that such plans be provided prior to final lot and building
envelope layout and that septic systems and building envelopes be located out of areas subject to
flooding.
