NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that a Petition for Annexation of territories hereinafter
described as Riverbend Estates PUD Annextion (current owner Lucky 2 Enterprises)
have been presented to the Town Board of Johnstown, Colorado and found to be in
apparent compliance with the applicable provisions of law and the Town Board has
adopted a Resolution to set a public hearing to be held at 7:00 p.m. on Monday,
November 6, 2000 in the Town Hall at 101 Charlotte Street in Johnstown, Colorado to
determine if the proposed annexation complies with the applicable requirements of law.
The Resolution adopted by the Town Board for such purposes is in words, letters and
figures as follows:

FINDING SUBSTANTIAL COMPLIANCE FOR INITIATING ANNEXATION
PROCEEDINGS FOR THE RIVERBEND ESTATES PUD ANNEXATION.
WHEREAS, a written petition, together with five (5) prints of an annexation map, was
heretofore filed with the Town Clerk requesting the annexation of certain property to he
known as the RIVERBEND ESTATES PUD ANNEXATION more particularly
described as situate in the County of Weld, State of Colorado, to wit:

WHEREAS, the Town Board desires to initiate annexation proceedings in accordance
with the law.
NOW, THEREFORE, BE 1T RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF JOHNSTOWN, COLORADO:
Section 1_That the Town Board hereby accepts said annexation petition, finds and
determines that the annexation petition and accompanying map are in substantial
compliance with C.R.S. 31-12-107, and desire to initiate annexation proceedings in
accordance with law.
Section 2, The Town Board shall hold a hearing to determine if the proposed annexation
complies with C.R.S. 3 t-12-104 and C.R.S. 31-12-105, or such parts thereof as may be
I required to establish eligibility for annexation under the terms of Part 1, Article 12, Title

31, CRS. A hearing shall be held on the 6`h day of November , 2000 in the Board
Meeting room of the Town of Johnstown, 101 Charlotte Street, Johnstown, Colorado at
7:00 p.m.
Section 3. The Town Clerk shall publish notice of such hearing once per week for four
(4) successive weeks in the Johnstown Breeze, with the first publication at least thirty
(30) days prior to the date of the hearing. The Town Clerk shall also send a copy of this
resolution and the petition for annexation to the Clerk to the Board of County
Commissioners, the County Attorney and to any special district or school district within
the area proposed for annexation.

A tract of land in the East Half of Section 17, Township 4 North, Range 67 West of the
6th Principal Meridian, Weld County, Colorado, described as follows:
Considering the northerly line of the Northeast Quarter of Section 17 as bearing
S 88°41'01" E, as shown on the plat of Stroh Annexation 8, recorded as Reception No.
2751809 of the Weld County Records, said line being monumented as shown.
From the Northeast corner of Section 17; THENCE N 88°41'01" W, along the northerly

PETITION FOR ANNEXATION
To the Town of Johnstown
The undersigned, in accordance with Article 12, Chapter 31, CRS, as amended, hereby
petition the Town Board of Trustees of the Town of Johnstown, Colorado, for annexation
to the Town of Johnstown the unincorporated territory more particularly described below,
currently known as Riverbend Estates Annexation, and in support of said Petition, your
petitioners allege that:
(1) It is desirable and necessary that the following described territory be annexed to
the Town of Johnstown, Colorado.
See Exhibit A attached hereto and made a part hereof
(2) Not less than one-sixth (1/6) of the perimeter of that area proposed to be annexed
is contiguous with the Town of Johnstown. Colorado.
(3) A community of interest exists between the territory proposed to be annexed and
the Town of Johnstown, Colorado.
(4) The territory proposed to be annexed is urban or will be urbanized in the near
future;
(5) The territory proposed to be annexed is integrated or is capable of being
integrated with the Town of Johnstown, Colorado;
(6) The signatures of the Petition comprise one hundred percent (100%) of the
landowners of the territory to be included in the area proposed to be annexed and
said landowners attesting to the facts and agreeing to the conditions herein
contained will negate the necessity of any annexation election;
(7) No land held in identical ownership, whether consisting of one tract or parcel of
real estate or two or more contiguous tracts or parcels of real estate:
(a) Is divided into separate parts or parcels without the written consent of the
landowner or landowners thereof, unless such tracts or parcels are
separated by a dedicated street, road or other public way;
(b) Comprising twenty (20) acres or more and which, together with the
building and improvements situated thereon has an assessed value in
excess of Two Hundred Thousand Dollars ($200,000.00) for ad valorem
tax purposes to be annexed without the written consent of the landowner
or landowners.
(8) No part of the area proposed to be annexed is more than three miles from a point
on the municipal boundary, as such was established more than one year before
this annexation will take place;
(9) The area proposed to be annexed comprises more than ten acres and an impact
report as provided in Section 31-12-105.5, CRS, as amended, is required
(10) The area proposed to be annexed is located within Weld County, School District
RE-57, Northern Colorado Water Conservancy District, Little Thompson Water
District, Johnstown Fire Protection District, Aims Junior College District, and
Weld County Library District, and no others;
(11) The mailing address of each signer, the legal description of the land owned by
each signer and the date of signing of each signature are all shown on this
Petition;
(12) Accompanying this Petition are five (5) prints of the area proposed to be
following information:
(a) A written legal description of the boundaries of the area proposed to be
annexed;
(b) A map showing the boundary of the area proposed to be annexed, such
map prepared and containing the seal of a registered engineer or land
surveyor;
(c) Within the annexation boundary map there is shown the location of each
ownership tract in unplatted land, and if part or all of the area is to be
platted at the time of the effectiveness of the annexation (as opposed to
after such effectiveness), then the boundaries and the plat number of plots
or of lots and blocks are shown;
(d) Next to the boundary of the area proposed to be annexed is drawn the
contiguous boundary of the Town of Johnstown, and the contiguous
boundary of any other municipality abutting the area proposed to be
annexed;
(e) The dimensions of the contiguous boundaries are shown on the map.
(t) A proposed drainage plan and a proposed utilities plan.
(13) The territory to be annexed is not presently a part of any incorporated city, city
and county, or town;

(14) The undersigned agree to the following conditions, which shall be covenants
running with the land, and which shall, at the option of the Town, appear on the
annexation map:
(a) Water rights shall be provided as mutually agreed to by the Town and the
undersigned;
(b) The owners shall participate in providing drainage plan and improvements
and payment of a unit drainage fee as may be required by the Town the
area;
( c ) The undersigned hereby waive any and all "vested rights"previously
created pursuant to Section 24-68-103, CRS, as amended.
(d) The undersigned and the Town may enter into an Annexation Agreement
prior to the effective date of this annexation, which agreement shall be
additional conditions as effectively as if set forth in this Petition.
(15) Petitioner represents that: (Check one)
X No part of the property to be annexed is included within any site
specific development plan approved by Weld County, Colorado.
_ A site specific development plan has been approved by Weld County,
Colorado, which has created a vested right
(16) Submitted with this Petition is the required annexation fee of$100.00.
(17) In the event that an Annexation Agreement satisfactory to both the undersigned
and TOWN is not agreed to on or before the date of the final reading of the
ordinance to effectuate the annexation contemplated by this Petition, the
undersigned shall have the right to withdraw this Petition at its option and this
Petition shall be deemed to be null and void as of the date of this Petition and of
no force and effect as if it had never been executed and never been filed with the
TOWN. In no event shall any filing fees be refunded in connection with any
withdrawal of this Petition. _

This annexation impact report has been prepared pursuant to Section 31-12-108.5
Colorado Revised Statutes. 1986 Repl. Vol. and the Town of Johnstown's annexation
criteria.

Riverbend Estates Annexation
The property is approximately 170.9 acres in size and is situated one mile south of the
Town of Johnstown at the southwest corner of Weld County Road 46 (WCR 46) and
Weld County Road 17 (WCR 17), Section 17, Township 4 North, Range 67 West, Weld
County, Colorado. The annexation plat is included as Exhibit A-1.
The area to be annexed includes 173.073 acres of agricultural land and road right-of-way.
Through this annexation, 2365.84 feet of WCR 46 will be incorporated into the Town o r
Johnstown. Currently, 1384.15 feet of WCR 17 adjacent to the subject site is within the
Town of Johnstown through the Stroh Annexation.
Project Concept
The parcel is proposed as a Planned Unit Development (PUD). This project concept
consists of commercial, residential units, and open space land uses (see Exhibit D).
A commercial area will be located at the southwest corner of WCR 17 and WCR 46 to
promote easy access and good visibility. The commercial area is anticipated to include
neighborhood commercial/retail and personal service uses to serve this development and
also adjacent neighborhoods.
Multi-family and single-family residential dwelling units are also proposed within the
development. The multi-family units will be located between the commercial area and
single-family residential area to provide a transitional buffer between these land uses.
The gross density of the multi-family development area is anticipated to be
approximately seven dwelling units per acre. The single-family lots will range in size
from approximately 6,000 square feet to 22,000+ square feet with a gross density of three
dwelling units per acre. The anticipated overall gross density for the development will be
approximately two dwelling units per acre.
A network of pedestrian and bike paths are proposed along the Little Thompson River
with a public park nestled in a meander of the river. Other paths will be interwoven

throughout the development to link other open space areas and to connect with adjacent
neighborhoods (i.e., Stone Ridge PUD).
Development Phasing and Schedule
It is anticipated that this development will proceed in four phases, commencing generally
in the northeast corner of the site. Multi-family and portions of the single-family homes
north of the river will be constructed in Phase 1. The remaining single-family homes
north of the river will be completed in Phase 2. The development of the single-family
homes south of the river and the commercial area will comprise Phases 3 and 4.
It is anticipated that build out of this development will occur over a 5-10 year period,
subject to market conditions.
Statement of Conformance with the Johnstown Comprehensive Plan
The Applicant is requesting annexation and zoning to the Town of Johnstown, Colorado.
The Comprehensive Land Use Map designation of the property, known as Riverbencl
Estates PUD, is residential and park. The proposed development conforms to the land
use map designation by including residential and park/open space.
This application conforms to the following goals of the Johnstown Comprehensive Plan
as follows:
Goal #2: Preserve and enhance the Town's sense of community, including the
assimilation of newcomers into the community.
The proposed development provides a range of attached and detached housing
opportunities, combined with a linear park, open space,preservation of the Little
Thompson River corridor, and a neighborhood commercial area to enhance the sense of
community and provide for newcomers in the community.
Goal #5: Within the growth constraints established by the Comprehensive Plan, ensure
that property owners have equal opportunity to realize the fair market value of their
property throughout the Planning Area.
The Applicant is submitting this proposal as a responsible development that meets and
exceeds the objectives listed within the Comprehensive Plan and allows a fair market
valuation of the property's development.
Goal#6: Achieve a balanced mix of housing in terms of life-style and affordability.
Riverbend Estates PUD will contain a mix of single-family detached units on lot sizes of
approximately 6,000 square feet to 22,000+ square feet. The development will also
contain multi-family units on approximately 7 acres. This mix of dwelling units prcvides
a wide range of housing prices in the area.

Goal #7: Establish a sustainable economic base to meet the needs of the Town's citizens
and to enable the Town government to provide a high level of municipal services.
The development of commercial area at the southwest corner of WCR 46 and WCR 17
furthers the 'Town's goals to establish a sustainable economic base.
Goal #9: Balance social impacts to achieve a livable community.
The proposed development demonstrates a combination of opportunities to shop, recreate
and live within a balanced community.
Goal #10: Ensure a viable, economic transportation system within the planning area,
which provides all transportation forms, and is integrated into the regional
transportation system.
The proposed development facilitates the use of multiple modes of transportation through
an integrated trail system which provides links to surrounding developments, trails along
the Little Thompson River open space area, and a street pattern that provides an efficient
design and minimizes the number of ingress/egress points onto major streets.
Such adherence to the mentioned Comprehensive Plan goals will help manage traffic,
maintain a significant amount of open space, promote a prosperous economy, and
maintain a high quality of life within the Town of Johnstown.
This application also conforms to the following intents of the Comprehensive Plan:
Population Projections
The annexation of this area will allow the Town to manage the annual growth densit)
within the Johnstown Planning Area and allow the Town's zoning to determine
development densities rather than be subject to County control of population rates
(pages 12 and 13 of Comprehensive Plan).
Control of Development in the Planning Area
Annexation of the property will place control of development within the Johnstown
Planning Area to the Town rather than the County. Annexation of the property will
also allow the Town to control the zoning and development regulation policies, arid
offer proper zoning and growth management alternatives than would otherwise be
managed by the County (page 14 of Comprehensive Plan).
Housing
Riverbend Estates PUD will provide diverse types of housing to homebuyers and
renters. This proposal assists in helping achieve the Town's intent of establishing a
wide range of diversified housing by providing multi-family, attached single family and
rental housing in Johnstown (page 15 of Comprehensive Plan).

Land Use
The development is designed in an manner consistent with the"village development"
concept described on page 16 of the Comprehensive Plan, and provides the following
benefits:
1. The dispersal of growth within the community of Johnstown helps the Town
retain its small-town character;
2. Such development permits better utilization of the Johnstown Planning Area and
allows the Town to better mange development of the planning area;
3. The development allows the existing downtown area to retain its central identity
while allowing the overall Planning Area to be large. This enables the Town t:o
further its economic base and support a high level of governmental services and
facilities.
Transportation
The Riverbend Estates PUD incorporates an integrated transportation network within
the development. Multiple connections to open space trails are provided from streets.
Trails will extend along a proposed linear park along the Little Thompson River. Trai I
links will be included throughout the development. These trails will connect to trails
within the development to the south, and future street access will be provided to
potential future development to the west. Collector streets within the development an
used to collect traffic from the local streets and convey traffic to arterial streets. The
proposed street and trail design furthers the Comprehensive Plan's intents of ensuring
that streets, greenbelts and other public use areas properly align and interconnect with
both existing and undeveloped land (pages 20 and 22 of Comprehensive Plan).
Community Facilities
Parks and Open Space
Multiple "pocket" parks/tot lots are distributed within the Riverbend Estates PUD. A
linear park and open space will also be provided along the Little Thompson River. This
meets the Comprehensive Plan's intent of preserving the land along rivers and
providing trails which access the riparian environment. This also meets the
Comprehensive Plan's intent to have greenbelts that follow existing rivers and contaii
bike/pedestrian paths to accommodate a variety of recreational activities (page 27 of
Comprehensive Plan).
Approximately 52 acres of open space with trails will be maintained throughout the
development. The amount of parks and open space provided within the development
meets the Comprehensive Plan's intents of protecting floodplains, preserving view
corridors, enhancing recreational opportunities and pedestrian and bicycle circulation.

Property Ownership Information
Attached as Exhibit B is the ownership portion of the title insurance commitment issued
by Weld County Title Company, Order Number CS52498, effective January 5, 2000. An
additional record search was conducted on the subject property effective August 11, 2000
since the January title commitment is older than three months from the date of submittal.
This search found no new documents recorded.
Site Features—Natural and Manmade
Natural
The majority of the site slopes gently to the north and east. However, a portion of the
property along the south and eastern perimeter exhibits steep slopes on the downhill side
of the Hillsboro Ditch. The site is also bisected by the Little Thompson River, which
meanders from west to the east in a deep channel. The river is approximately 15-20 feet

wide and three feet deep with embankments up to 15 feet high along portions of the
corridor on average.
Native vegetation is limited since the property is presently being farmed. Several large
cottonwoods and herbaceous groundcover are found along the river corridor and
Hillsboro Ditch.
Manmade
The site contains a farm residence with several service buildings. Miscellaneous concrete
pads and wooden corrals associated with the existing farming operation are located neat
the residence and along WCR 17.
Three oil/gas wells and associated appurtenances are also located on the property: two
north of the Little Thompson River and one adjacent to the Hillsboro Ditch in the east
central portion of the site. The well and related surface works south of the river appear to
have been decommissioned and partially dismantled. The wells and related piping,
watering and storage tanks north of the river are functioning. The wells will be preserved
when developing the site.
Several concrete irrigation canals are located adjacent to the Hillsboro Ditch in the south
portion of the site and within the designated 60-foot right-of-way (Book 48, page 93)
located along an east-west alignment in a central area of the site. These will be
decommissioned and removed as residential development replaces farming uses.
Existing Land Use and Zoning
The current zoning is Weld County Agricultural (A) and the current land use is
agriculture.
Proposed Land Use and Zoning
The proposed zoning is Planned Unit Development--Mixed (PUD-MU) and the
proposed land use is single-family and multi-family residential, commercial, and open
space.
Public Use Dedication
The land and facilities to be dedicated for public use includes a linear park along the
Little Thompson River, and a public neighborhood park adjacent to the river. Land and
facilities developed for the private use of the homeowners includes a buffer south of the.
Hillsboro Ditch and several pocket parks within the development's residential areas.

Vehicular, Bike and Pedestrian Circulation
The Outline Development Plan illustrates the dominant vehicular circulation routes
through the property and the main access points to the site. The roads shown on the cited
plan are collectors and will provide connections between interior local streets and
perimeter arterials.
Pedestrian and bike paths will be included along roadways. These will be further defined
as part of the preliminary plan and plat process. A pedestrian/bike path is proposed along
the Little Thompson River and a bridge(s) will provide access throughout the
development and to adjacent neighborhoods.
Fiscal Impact
The site plan provides for approximately seven acres of commercial/retail with a
maximum gross leaseable area(GLA) of approximately 75,000 square feet. Based on a
ratio of 2.5 to 3 employees per 1,000 square feet of floor space, it is anticipated that
approximately 187 to 225 jobs could be generated in this area.
Potential annual sales tax revenue to the Town based on average annual retail sales of
$123 per square foot of GLA at the Town's tax rate of two percent would be
approximately $184,500. State and County tax revenues would be in addition to this
amount.
Water Rights Information
Water rights appurtenant to the property include two shares of Hillsboro Ditch Company
and 64 units of Colorado Big Thompson(CBT) water. The listed water rights have
historically been used to irrigate crops grown on the proposed annexation parcel.
An evaluation is currently being conducted by the Town's water attorney to assess the
acceptability of the Hillsboro Ditch Company shares and to establish an appropriate
exchange rate for such shares, for the purpose of determining the number of Raw Water
Credits available to the Applicant. All water rights appurtenant to the property will he
dedicated to the Town at the time of annexation, as required by Town of Johnstown
Ordinance No. 99-590. No additional water rights, other than those appurtenant to the
property, are available to the Applicant for dedication to the Town. Any shortage of Raw
Water Credits, required in support of the proposed annexation, will be adjusted by
payment of a cash-in-lieu fee by the Applicant, as provided for by the Ordinance.
Existing and Proposed Infrastructure
Access to the site will be from existing county roads. The northern one-third of the site is
bounded on the east by Weld County Road 17 (WCR 17), which is currently a two-lane
paved road with gravel shoulders centered in a 60-foot right-of-way. This road is

scheduled to be upgraded to arterial standards as development progresses in the area, and
primary access to the site is proposed from this route. The southern two-thirds of the site
is bounded on the east by the Great Western Railroad right-of-way and the Stone Ridge
Subdivision(former Stroh Farm) and on the south by the Hillsboro Ditch. No access to
the site is anticipated in this area. Weld County Road 46 extends completely across the
northern boundary of the site as a two-lane gravel road in a 60-foot right-of-way. This
road will also be upgraded in conjunction with this and other proposed developments in
the area, and will provide access to the portion of the site north of the Little Thompson
River. The site is bounded on the west by undeveloped agricultural land. Provision is
made in the development concept plan for a future road connection to this property,
should it be developed, but no immediate access to the site from the west is anticipated at
this time.
The Little Thompson Water District via a 1.5-inch line flowing eastward along WCR 46
currently provides potable water to the farmhouse on the site. A new trunk water main is
scheduled be constructed south along WCR 17 from the Town system to serve the
Riverbend Estates PUD. It is also understood that new water mains are to be extended
south along WCR 15 to serve the proposed Red Mountain Annexation 1 & 2, and that a
further main is to be constructed along WCR 46 between WCR 15 and WCR 17 to
connect the two new mains and loop the system. It is anticipated that these new mains
will also supply potable water to the Riverbend Estates PUD.
Sanitary sewer infrastructure is not currently located in the vicinity of the site. However,
it is understood that a sanitary sewer trunk main is to be constructed along WCR 17 to
connect the Riverbend Estates PUD to the Town collection and treatment works. It is
anticipated that this new main will also serve to convey sanitary sewage from the
Riverbend Estates PUD and other developments in the area to the Town treatment works.
It is understood that if the new main were to serve only the Riverbend Estates PUD, there
is sufficient hydrostatic head between that subdivision and the Town for the line to
convey the flow without aid of a lift station, with the line being pressurized through the
Little Thompson River valley and in the vicinity of the Riverbend Estates PUD.
Therefore it is recognized that a lift station will be required in the vicinity of WCR 17
and the Little Thompson River crossing. The lift station will pump sewage from the
Riverbend Estates PUD and other possible developments at lower into the new main and
onward to the Town system.
Electric power is available to the proposed development from the existing overhead grid
maintained by Public Service of Colorado. The grid in the vicinity of the site has
recently been upgraded in anticipation of serving the Riverbend Estates PUD. New
primary-voltage lines have been extended south along WCR 17 to WCR 46 and west
along WCR 46. It is understood that the new overhead lines will be extended further
south along WCR 17 to the Riverbend Estates PUD.

Natural gas is available to the site via an existing intermediate-pressure distribution maia
located along the east side of WCR 17. Public Service of Colorado maintains this line.
Telephone service to the site will be provided by U.S. West, which maintains
underground lines along the east side of WCR 17.
A general map showing the approximate locations of existing or planned utility
infrastructure is included as Exhibit"E". All access to the property will comply with the
Town's Access Code.
Johnstown Utilities
It is intended that water and sanitary sewer service for the proposed development be
provided by the Town of Johnstown. The extent of such services is set out in the Water
and Sewer Demand Analysis, which is included as Exhibit "C".

Pre-Annexation Agreements
Currently there are no pre-annexation agreements between the Owners/Developers, and
the Town. A formal Annexation Agreement will be prepared by the Owner/Developer
according to the Town of Johnstown's standard format. This Annexation Agreement will
