RE: APPROVAL OF AGREEMENT BETWEEN THE WELD COUNTY AMBULANCE
SERVICE AND THE TOWN OF FORT LUPTON TO ESTABLISH A GARAGE
AND DORMITORY IN FORT LUPTON AND AUTHORIZATION FOR CHAIR-
MAN TO SIGN THE SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Weld County Ambulance Service desires to
establish a garage and dormitory in Fort Lupton so that the
Weld County Ambulance Service may serve the southern portion
of Weld County, and
WHEREAS, an Agreement between the Weld County Ambulance
Service and the Town of Fort Lupton has been prepared and pre-
sented to Board of County Commissioners for approval, and
WHEREAS, the term of said Agreement shall be from February
1, 1981 to and until January 31, 1982, and
WHEREAS, the Board of County Commissioners has studied
said Agreement and deems it advisable to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Agreement between
the Weld County Ambulance Service and the Town of Fort Lupton
to establish a garage and dormitory in Fort Lupton be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the Chairman of the Board be, and hereby is, authorized to
sign said Agreement.
The above and foregoing Reoslution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
January, A.D. , 1981.

AGREEMENT

THIS AGREEMENT is made and entered into this 529e - day of
December, 1980 by and between THE WELD COUNTY AMBULANCE SERVICE,
a Department of Weld County, Colorado, hereinafter referred to
as "Ambulance Service" and the TOWN OF FORT LUPTON, a statutory
town of the State of Colorado, hereinafter referred to as "Fort
Lupton" .
WITNESSETH:
WHEREAS, the Weld County Ambulance Service desires to
establish a garage and dormitory in Fort Lupton so that the Weld
County Ambulance Service may serve the southern portion of Weld
County, and
WHEREAS, Fort Lupton desires to have Ambulance Service
locate a gargage and dormitory facility in Fort Lupton in order
to provide better response to medical emergencies in Fort Lupton.
NOW, THEREFORE, for and in consideration of the promises and
mutual agreements contained herein, the Ambulance Service and
Fort Lupton mutually agree as follows:
1. Term of Agreement.
The term of this Agreement shall be from Februrary 1,
1981 to and until January 31, 1982 .
2. Duties of Fort Lupton.
Fort Lupton agrees to the following duties and responsi-
bilities:
a. Fort Lupton shall furnish a garage and dormitory
facility for Ambulance Service, shall make all
rental payments, and shall provide all utilities
with the exception of telephone service.
b. Prior to entering into any lease or purchasing
any proposed garage and dormitory, Ambulance
Service shall inspect said proposed facility to
determine whether said facility is adequate to
meet the needs of Ambulance Service and the appro-
val of said facility by Ambulance Service shall be
a requirement of this Contract.
c. Fort Lupton agrees to make full payment to Ambu-
lance Service on all uncollectable accounts for
individuals who, at the time Ambulance Service
rendered service, were residents of the city of
Fort Lupton. The parties hereto mutually agree
that an account shall be deemed uncollectable in
accordance with established Ambulance Service
policy. Fort Lupton agrees to make payments on
such uncollectable accounts within thirty (30)
days of being formally notified of the fact that
such accounts have been deemed uncollectable.
3. Duties of Ambulance Service.
Ambulance Service agrees to the following:
a. Ambulance Service shall maintain a 24-hour a day,
7-day a week ambulance service in Fort Lupton and
shall equip such service with one (1) ambulance
vehicle with necessary attendant equipment and a
crew sufficient to man said service.
b. In connection with said service, Ambulance Ser-
vice agrees to provide substantially the same
service out of its Fort Lupton station as it pro-
vides out of its Weld County General Hospital
location.
c. Ambulance Service agrees to provide its own tele-
phone service and its own furniture for its facility
in Fort Lupton.
d. Ambulance Service agrees to assign all uncollectable
accounts to Fort Lupton and specifically agrees that
subsequent to payment of such uncollectable accounts
by Fort Lupton, Fort Lupton shall be entitled to
pursue legal action to make collection on such
accounts.

4 . Calls Outside of Fort Lupton.
The parties hereto mutually agree that Ambulance Ser-
vice may respond to calls from outside of the city
limits of Fort Lupton from its Fort Lupton station.
It is mutually understood that the Fort Lupton sta-
tion is designed to serve the entire south Weld
County area.
5. Salaries for Ambulance Service Personnel .
Ambulance Service agrees that all salaries and fringe
benefits for Ambulance Service personnel shall be paid
by Ambulance Service and Ambulance Service employees
shall not be deemed employees of Fort Lupton but shall
be independent contractors and Ambulance Service shall
be solely responsible for its actions and those of its
employees .
6 . Amendment.
This Agreement may be amended at any time provided
such amendment is reduced to writing and signed by
both parties to this Agreement.
WHEREFORE, the parties have set their hands hereto on the
day and year first above written.
