RE: APPROVAL OF SUBDIVISION PARK FUND EXPENDITURES TO THE
WATTENBURG IMPROVEMENT ASSOCIATION.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, following the submission of an application by
the Wattenburg Improvement Association for assistance in the
project known as park development in the unincorporated town
of Wattenburg, Weld County has extended to said Association
a grant from Weld County Subdivision Park Funds in the amount
of $4 ,774 . 00, and
WHEREAS, said Association has informed the Board of County
Commissioners that it does not have available funds to pay for
supplies or services until the County reimburses the Associa-
tion for project costs, and
WHEREAS, the terms agreed upon are as follows :
A. The Association shall obtain at least three bids
on all project costs and accept the low bid unless
authorized by Board resolution to do otherwise.
B. Following completion of the project, the Association
shall report to Weld County its acceptance of the
materials and project.
C. Such reports shall include an accounting of actual
expenses for the project and a request for direct
payment of a specific dollar amount.
D. Upon receipt of this report and request for direct
payment, accompanied by an original invoice, the
County shall determine the amount of reimbursement
and will make payment to the provider for the
Association.
E. The Association agrees, as a condition of this grant,
to indemnify and save the County harmless from any

and all claims which may arise as a result of said
project.
WHEREAS, it has been further agreed that Weld County shall
reimburse the Association for such expenditures on or before
October 10, 1981 . It is therefore understood and agreed that
the project shall be completed and the request for reimburse-
ment forwarded to Weld County no later than September 30, 1981 ,
and
WHEREAS, upon consideration of the aforementioned request
from the Wattenburg Improvement Association, the Board of County
Commissioners deems it advisable and in the best interests of
Weld County to approve the same in an amount not to exceed
$4 , 774 . 00 to the Association through said Subdivision Park
Fund.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld, County, Colorado that said Board does hereby
approve Subdivision Park Fund expenditures to the Wattenburg
Improvement Association, Weld County, Colorado, as more fully
set forth above.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
September, A.D. , 1980 .

AGREEMENT
THIS AGREEMENT made and entered into this Zd day of
October, 1980, by and between BOARD OF COUNTY COMMISSIONERS
OF WELD COUNTY, COLORADO, hereinafter referred to as "County"
and the WATTENBURG IMPROVEMENT ASSOCIATION, hereinafter
referred to as "Wattenburg. "
For and in consideration of the mutual covenants herein-
after set forth, the parties hereto agree as follows :
1. County agrees to grant to Wattenburg the sum of
$4 , 774 . 00 from the Weld County Subdivision Park
Fund for the development of park improvements in
the unincorporated town of Wattenburg.
2 . Wattenburg agrees to obtain at least three (3)
bids on all project costs and accept the low bid
unless specifically authorized in writing by the
County to do otherwise.
3. Following completion of the project, Wattenburg
shall report to County its acceptance of the
materials and project.
4 . The above stated report shall include an accounting
of actual expenses for the project and requests for
direct payment of a specific dollar amount.
5 . Upon receipt of this report and requests for direct
payment accompanied by an original invoice, County
shall determine the amount of reimbursement and
will make payment to the provider for Wattenburg.
6 . Wattenburg agrees , as a condition of this grant, to
indemnify and save the County harmless from any and
all claims which may arise as a result of said pro-
ject.
7 . County agrees to reimburse Wattenburg for the above
stated expenditures on or before October 10 , 1981.
It is therefore understood and agreed that the pro-
ject shall be completed and the request for reim-
bursement forwarded to County no later than September
30, 1981.
IN WITNESS WHEREOF, the parties hereto have duly executed
this Agreement on the day and year first above written.
