Permit No. USR 1172, Amendment
Dear Sir or Madam:
This letter and accompanying application documents are being sent to you on behalf of
our client, Hall-Irwin Construction Company (herein Hall-Irwin), for the amendment of
Weld County Special Use Permit No. USR 1172. This amendment proposes landscape
material sales on a portion of the Baseline Resource operation.
The amended area is located in the southeast 'A of Section 36, Township 1 North, Range
67 West, Sixth Principal Meridian, Weld County, Colorado (See Permit Plan Map, Page
1 of 2). As shown on the Permit Plan Map, Page 2 of 2, the amended area is located in
the southeast portion of the Baseline Resource site. The existing access road from the
sand and gravel operation to Weld County Road 2 is immediately east of amended area.
This access road will also be used to access the amended area.
This letter will supply the narrative segment of the Special Review application
requirements and is formatted in the same numerical order as the procedural guide for the
application requirements.
1. The use for the property is the sales of landscape materials. This material
includes large landscape boulders, gravel, colored brick, rock slates, and mulch.
The landscape boulders and mulch piles are located on the south side of the
amended area. The majority of the amended area consists of approximately 30
landscape gravel piles. All piles are placed approximately 20-30 feet apart. The
rock slates and bricks are located on the north west portion of the amended area.
The landscape rock slates vary from 1 —2 feet wide, 2—3 feet long, and
approximately IA inch thick. The gravel varies in color and ranges from
approximately 'A - 1 inch diameter in size. For further detail see the Permit Plan
Map, Page 2 of 2.

2. This Use by Special Review application is consistent with the Weld County
Comprehensive Plan as follows: C. Goal 2 states to ensure the compatibility of
commercial and uses with adjacent land uses. The sale of landscaping materials is
consistent with the surrounding land use which is predominately sand and gravel
mining. In addition, the landscaping sales is fulfilling a market demand in the
immediate area.
3. The amended area is not located in a Geologic Hazard or Weld County Airport
Overlay Districts. The entire site is located within the 100-year floodplain of the
South Platte River. A Weld County Flood Hazard Development Permit was
issued to the Baseline Resource operation. The amended area was included in this
permit. No permanent structures are proposed for the amended area.
4. Surrounding land uses are primarily agricultural with some residential. There are
permitted sand and gravel extraction operations in the general vicinity. This use
is not high intensity development, which would increase the amount of traffic in
the vicinity of the amended area. Due to high market demand for landscape
materials the location of this site is convenient for the local community. Setbacks
and noise limitations will assure compatibility with the surrounding uses.

a. Approximately 15 people use the amended area on a daily basis.
b. The maximum number of employees is 6.
c. Hours of operation are Monday through Saturday 6:30 a.m. to 5:30 p.m.
d. There will not be any proposed structures built on-site. There is currently
a mobile office and small shed on the northwest side of the amended area.
e. There are no animals on site.
f. Generally pickup trucks and haul trucks will be accessing the site for
landscape materials. The weight of these vehicles varies from one ton to
10 ton.
g. Fire protection is provided by Brighton Fire District.
h. Bottled water is provided on-site. There are no waterways on-site.
i. There is no sewage disposal system on the property. Two Port-O-Lets
exist east of the amended area near the scale house. The amended area
will be serviced by these two Port-O-Lets.
j. There is no storage or warehousing proposed on-site.
6. There is no proposed landscaping for the amended area.
7. This area will be mined according to the original USR. Prior to disturbance in
this area, the landscape materials will be removed. The reclamation for this area
is included in the Weld County Permit USR 1172 and Division of Minerals and
Geology Regular Operations (112) Permit No. M-97-058.
8. The amended area is at the highest elevation of the Baseline Resource operation.
All stormwater drainage will flow north towards the pit and into the dewatering
trenches. The landscape material piles are placed approximately 20-30 feet apart
to allow natural stormwater flow.
9. There is no construction needed for the amended area.
10. There will not be any storage and/or stockpile of wastes in the amended area.
Hall-Irwin wishes to amend Permit No. USR 1172 to rightfully sell landscape material
on-site.

In response to your letter dated January 28, 1999, the Department of Planning Staff has
determined that the proposed landscape materials sales area would require an amendment to
USR-1172. This amendment application must also cover all of the provisions pertaining to the
mining operation that were part of the original application.
I left a message with your secretary on February the 5th about staff's decision. This
letter is to follow up on last Thursday's staff meeting.

To Whom It May Concern:
Our firm represents Hall-Irwin Companies who owns and operates numerous sand and
gravel mining operations within Weld County.
Hall-Irwin would like to add to their existing permit, USR-1172, located on Weld County
Road 2 approximately 1 mile west of State Highway 85, the sale of landscape materials.
The following is a brief outline of the sales:

• The type of material to be sold would be a variety of decorative stone, bark
and mulch, topsoil,boulders and timbers;
• The amount to be sold would be determined by the market location;
• The majority of the material would be generated on site with some material
being from other rock and mulch manufacturers;
• Approximately 3 to 5 additional employees would be required to staff the
landscape sales; and
• Hours of operation will remain the same as the existing permit.
Indicated in green on the attached map, is the proposed area of the sales.
Please provide the correct procedure necessary to operate the sale of landscape material.
